These are to be related to climate change, among other things.</strong></p> <p><strong>- A resolution was drafted calling on member states to "strengthen the global health architecture" and become more involved in the work of the World Health Organization, including the preparation of a so-called "anti-pandemic treaty.</strong></p> <p><strong>- The resolution was adopted with 54 votes in favor and eight against.</strong></p> <p class="text-align-justify">During the meeting of the General Assembly of the Council of Europe, a debate was held titled. "The state of public health emergency: the need for a holistic approach to multilateralism and health care." The aftermath of the discussion resulted in the adoption of a resolution by members of the Assembly, according to which countries are to urgently learn lessons from previous health crises by strengthening the global health architecture and developing strategies at the national level.</p> <p class="text-align-justify"><br /> The Parliamentary Assembly recognized the need for a holistic, multilateral effort, bringing together the World Health Organization (WHO), the World Trade Organization (WTO) and others to revise the rules governing the health sector in the provision of essential medicines, vaccines and health care services at the national and international levels, including the diversification of medical supply sources. These rules should ensure that both the public and private sectors in health care anchor their actions in human rights, particularly the right to health, and guarantee equitable access to quality treatment and vaccinations for all.</p> <p class="text-align-justify"><br /> The parliamentarians further pointed out that "the world has entered a new era of pandemics, in which Covid-19 is seen only as a harbinger of further - and possibly worse - public health emergencies. New threats to public health are expected to be linked to the climate crisis, coupled with declining biodiversity and the consequences of armed conflicts waiting to unfold and likely to hit the world unexpectedly. It is therefore urgent that countries learn from previous health emergencies by strengthening the global health architecture and developing the necessary strategies at the national level to respond quickly to emerging global health threats."</p> <p class="text-align-justify">The text adopted stresses that ongoing processes to transform global health governance must be based on the principle of justice and the protection of human rights and fundamental freedoms in public health emergencies, calling on member states to commit to ensuring sustainable financing for WHO and making it independent of voluntary contributions.</p> <p class="text-align-justify">- The content of the resolution indicates that the interest in the treaty under preparation and in giving the WHO a major role in the field of global health policy is also viewed positively by members of the General Assembly of the Council of Europe. The Grand Chamber of the Strasbourg Court found a violation of the right to respect for private and family life of a group of same-sex couples due to the inability to formalize their relationship.</strong></p> <p class="text-align-justify"><strong>- The Ordo Iuris Institute has prepared an analysis in which it points out that although the Grand Chamber's judgment is formally addressed to the Russian Federation, in practice it may affect Poland and other European countries.</strong></p> <p class="text-align-justify"><strong>- This is because the Strasbourg Court derived from Article 8 of the Convention a general obligation of states, not limited to Russia, to create a "legal framework" for "stable and committed" same-sex couples.</strong></p> <p class="text-align-justify"><strong>- The Grand Chamber's ruling sets the standard for interpreting the Convention for the Court's smaller panels, which are currently hearing complaints by LGBT activists against Poland.</strong></p> <p class="text-align-justify"><strong>- The Ordo Iuris Institute has prepared an analysis on the subject.</strong></p> <p class="text-align-justify">The case involved three same-sex couples who unsuccessfully attempted to marry in Russian registry offices between 2009 and 2013, despite unambiguous laws providing for marriage only for the union of a man and a woman.   The first couple in 2010, and the second and third in 2014, filed complaints with the European Court of Human Rights in Strasbourg, accusing Russia of violating their right to respect for private and family life (Article 8 of the ECHR). In 2021. Court upheld their complaint, but Russia appealed to the Grand Chamber of the ECHR, which upheld the earlier judgment in early January this year. The verdict was adopted by a 14-to-3 majority, but of the three, only two judges voted against the merits of the ruling (including Judge Prof. Krzysztof Wojtyczek of Poland).</p> <p class="text-align-justify">In a prepared analysis, the Ordo Iuris Center for International Law points out that although the Grand Chamber's judgment is formally addressed to the Russian Federation, in practice it will also affect Poland and all other Council of Europe states. This is because the Grand Chamber of the ECHR sets de facto standards for the interpretation of the Convention, which are followed by the Court's smaller adjudicatory panels, including those considering the very complaints of Polish LGBT activists against Poland, demanding the institutionalization of same-sex relationships.</p> <p class="text-align-justify">The ECHR Grand Chamber derived from Article 8 of the Convention a positive obligation on all European states to create a "specific legal framework" for "stable and committed" same-sex unions. At the same time, it disqualified all the basic arguments against the institutionalization of same-sex unions that could be raised so far to evade this obligation - in the Grand Chamber's view, neither the will of the majority of society, nor the protection of the family, nor the protection of minors from the promotion of homosexuality justifies it. The Grand Chamber merely left it up to the states to decide on the form and content of formalizing same-sex unions, which need not be completely equated with marriage.</p> <p class="text-align-justify">According to the Grand Chamber of the ECHR, "stable and committed" homosexual relationships constitute "family life" within the meaning of Article 8 of the Convention, because they are no different in substance from relationships between a man and a woman.  In its analysis, however, the Ordo Iuris Institute points out that the Court's understanding of family differs significantly from its meaning derived from the text of Article 8 of the Convention, which, according to its preamble, must be read in light of Articles 16(1) and (3) and 25(2) of the Universal Declaration of Human Rights. In turn, it is clear from these provisions that a family is a community based on the union of a man and a woman striving to become parents.</p> <p class="text-align-justify">The ECHR's position is the fruit of the technique of interpreting the Convention as a "living instrument," which assumes that the understanding of the concepts contained therein is not fixed, but evolves with the views of society. In its analysis, the Ordo Iuris Institute points out that the Court does not have the authority to adapt the provisions of the Convention to society's views - that is the domain of the legislature, which in the case of the treaty is the body of state parties that can revise it through the appropriate procedure. Therefore, also the Committee should formulate any comments on the implementation of the Convention by Poland in a manner consistent with the Polish constitutional axiology, which considers the equality of all citizens and the family, being a fundamental social cell built on the relationship between a woman and a man, as fundamental values. The date of the Committee’s meeting, during which the issues concerning the implementation of the Convention will be discussed, is June this year. It is also worth noting that the references to the concept of <i>gender, </i>used by the Convention, are reduced to a minimum in the report (are present in three parts). The substantive rules contained therein on preventing and combating domestic violence are completely covered by the principles on which the Convention was built. As it has already been demonstrated many times, the Convention presents the phenomenon of violence as a problem arising from the very structure of society. The central term used in the document is the concept of <i>gender</i> (sometimes incorrectly translated into Polish as “socio-cultural gender”). According to its definition set out in the preamble to the Convention,<span style="color:black"> “violence against women is a manifestation of historically unequal power relations between men and women, which have led to domination over, and discrimination against, women by men and to the prevention of the full advancement of women.”</span> </span></span><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">A group of specialists of the Council of Europe spoke out in a similar tone and indicated that “gender is not only a socially constructed definition of a woman and a man, but also a socially constructed definition of relationship between the sexes, which includes an unequal relation of power resulting in the domination of men and the subordination of women in most spheres of life.”<a name="_ftnref4" id="_ftnref4"></a><a href="#_ftn4"><sup><span style="font-family:&quot;Calibri&quot;,sans-serif"><span style="color:black">[4]</span></span></sup></a></span></span> <span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">These definitions fully correspond to the views that have been promoted since the 1970s by radical groups, according to which gender is a social construct, created by a male-dominated society in order to oppress women. It is worth pointing out that these concepts are directly related to the dialectic assumptions of Marxism – changing, however, class struggle into sex struggle. Ignoring the biological and objective dimension of human gender, its impact on social roles, and finally breaking with the assumption that these roles are complementary, are extremely radical and dangerous demands expressed explicitly in the Istanbul Convention.</span></span></span></span></p> <p style="margin:0cm; margin-bottom:.0001pt; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; margin-bottom:.0001pt; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">At the same time, building its rhetoric on the ideological battle of sexes, the Convention completely ignores the real causes of violence, which are actually due to the pathology of social life. The Convention does not include provisions on, for example, combating alcohol, drug or other addictions (e.g. pornography), sexualisation of women, or demands to strengthen family ties. It is worth pointing out that these factors of research are indicated as the major catalysts for the occurrence of violence against the closest relatives</span></span><a name="_ftnref5" id="_ftnref5"></a><a href="#_ftn5"><sup><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif"><span style="color:#0563c1">[5]</span></span></span></sup></a><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">. The institution also requires the collection of information about hospitals where doctors invoke the conscience clause. The Committee demands easier methods for objecting to decisions by physicians who refuse to perform abortion. The officials want the authorities to hold the healthcare facilities that do not perform abortions accountable.<p></p></span></b></p> <p style="margin-top:0cm;margin-right:0cm;margin-bottom:8.0pt;margin-left:0cm;&#10;text-align:justify"><span lang="EN-GB" style="font-size:11.0pt;font-family:&quot;Calibri&quot;,sans-serif;&#10;mso-bidi-font-family:&quot;Times New Roman&quot;" xml:lang="EN-GB">The Committee of Ministers is the body of the Council of Europe that is responsible for monitoring the enforcement of the judgements of the European Court of Human Rights by member states that lose a case. The requirement is connected with Poland’s alleged failure to execute judgements of the Tribunal in Strasbourg. The Tribunal in Strasbourg obligated Poland to introduce a procedure to verify the decisions of physicians, including decisions on no grounds for legal abortion, and Polish authorities responded with the introduction of not one but two such procedures. The Tribunal clearly emphasised that the protection of human life at the prenatal stage was an issue decided by the countries-parties to the Convention. So the Committee has no right to demand any specific solutions from Poland which could in fact impair that protection in Poland. They raise the violation of the parents' right to respect for family life. All of them pertain to the actions of the same institution – Norway's child protection agency, Barnevernet.</strong></p> <p class="text-align-justify">The parents have criticised Barnevernet, arguing that the officials have taken their children for no adequate reasons, banning the parents completely from keeping in touch with their children or radically restricting their right to do so. Some of <a href="https://hudoc.echr.coe.int/eng#{&quot;appno&quot;:[&quot;56271/17&quot;]}">the aggrieved</a> are parents whose contact with the child has been limited to three four-hour meetings a year, a mother who has been allowed to contact her son for only two hours six times a year, a father granted just a single three-hour meeting a year with his own children, and a mother completely banned from contacting two of her children and for whom the right to see her third child has been restricted.</p> <p class="text-align-justify">The Norwegian government can now respond to the allegations and non-governmental organisations have been asked to submit their legal opinions of amicus curiae as regards the legal issues related to individual complaints. The Ordo Iuris Institute is going to apply to the President of Section II of the ECHR, which is going to examine the complaints, for permission to take part in the 16 proceedings and to present its observations. The Institute lawyers are going to submit the arguments proving the utmost importance of a parent-child relationship for the proper child development to the Court, as well as present the international case law pointing out that taking children away from their parents is the last resort and ought to be applied in the most extreme cases only.</p> <p class="text-align-justify">“The cases to be examined give us a lot of hope for reforming the Norway's childcare system, which assumes the total supremacy of the state over families. The situations described are an example of the application of measures that are totally inadequate to the circumstances the children and their parents find themselves in. In the recent ruling of the Strasbourg Court regarding Blondina Jansen's case, it was clearly stated that placing the child in alternative care serves the purpose of reuniting the family, so the relationship between the child and their biological parents should be maintained. Such a stance gives us the reason to assume that the verdicts in these 16 cases will be in favour of the complainants as well”, Bartosz Zalewski from the Ordo Iuris Institute remarked.</p> <p class="text-align-justify">The reasons for which Barnevernet separates children from their parents are often petty, by way of illustration a mother's “chronic fatigue”, a three-year-old's low attendance at nursery school, and a parent's supposed paracetamol overuse. The Romanian-Norwegian Bodnariu family case is one of the most media-covered cases demonstrating extreme anti-family practices of the agency, where five children were taken away (one of whom was barely a few weeks old) and placed in three different foster families. Eventually, Barnevernet bowed to the public and Romanian government pressure and returned the children to their parents, who left Norway shortly afterwards. Recently, the Bodnariu family has filed a complaint to the ECHR, and the Ordo Iuris Institute has also submitted its opinion regarding the case. The Institute's experts have also been developing a report describing Barnevernet's practices from the system perspective, in terms of international human rights standards. Beforehand, they also represented a Norwegian woman Silje Garmo in court, who was granted asylum in Poland. In the court's decision it was directly stated that the woman's fundamental rights had been violated in Norway.</p> <!-- END OUTPUT from This has been proved by the case of Silje Garmo, a Norwegian woman who was granted asylum in Poland after she escaped unjustified intrusion into her family life by the Child Welfare Services – Barnevernet. This case was the main topic of a meeting in Strasburg visited by politicians, experts and representatives of social organisations from different countries brought together under the Council of Europe. It was organised by Valeriu Ghiletchi, Vice-President of the Moldavian Parliament during the 2014-2019 term, and Pavel Ungaryan, a Ukrainian MP and initiated by Jan-Aage Torp from Kristen Koalisjon Norge. Valeriu Giletchi is the author of a report adopted by the European Committee of Social Rights which presents a critical view of the oppressive Barnevernet system. The document, which reverberated in the entire Europe, was the fruit of a high-profile case of the Romanian-Norwegian Bondariu family whose five children were seized and placed in three different foster families, as it turns out, without reasonable grounds. The report by the Moldavian politician helped the Polish government issue a favourable decision in the case regarding Silje Garmo – a Norwegian citizen who obtained asylum in Poland together with her daughter. The report demonstrates the legal basis and practice employed by the authority compiled in the course of studies which lasted for many months and were partly confined to the realm of documents and analyses of dozens of international and Norwegian court rulings but also included a visit in Oslo incorporating a number of meetings with the affected families, experts and local social activists. The Republic of Poland granted asylum to the Norwegian and her daughter owing to the fact that their basic rights guaranteed by international acts were infringed by Norwegian authorities. The Ordo Iuris Institute helped the Norwegian in seeking asylum.
