The decision is in response to mass protests by the population expressing opposition to the amnesty of Catalan separatists.</strong></p> <p class="text-align-justify"><strong>- States, by introducing legislation criminalising silent prayer, are violating the right to freedom of thought and conscience, which is a fundamental human right.</strong></p> <p class="text-align-justify"><strong>- Until now, there has been a widespread belief that the internal sphere of freedom of conscience and religion is absolute and remains unfettered.</strong></p> <p class="text-align-justify"><strong>- The legal system cannot under any circumstances restrict the freedom to hold, change or not to hold one's own worldview in religious matters.</strong></p> <p class="text-align-justify"><strong>Praying the rosary banned in Spain</strong></p> <p class="text-align-justify">A few weeks ago, Spain was gripped by protests against the government due to its deal with Catalan separatists. The opposition of Spaniards was sparked by the plans of the Pedro Sanchez government, which took office thanks to the support of Catalan separatists. After winning a vote of confidence, the head of Catalonia's autonomous government, Carles Puigdemont, who heads the separatist Together for Catalonia (Junts) party, called on Sanchez to immediately announce amnesty legislation for the secessionists. He threatened that if the new regulation was delayed, the party would vote for the resignation of the Sanchez government. As part of their peaceful resistance, a number of Catholics decided to organise a prayer demonstration in front of one of Madrid's churches. Soon more people joined the prayers. The event, which was broadcast worldwide, attracted international attention. This, in turn, aroused the concern of the Spanish authorities, who sent the police against the Catholics praying the rosary. Threats and harassment by the police did not extinguish the spirit of resistance among Catholics and the incidental gathering turned into regular prayer meetings. The position of the authorities remained firm to the extent that a ban on public prayer was imposed. Despite the ban, Catholics continue to meet for prayer. Last week, the first fines were issued by the police. The reason given was that the organisers had "missed the deadline" to apply for a prayer permit.  </p> <p class="text-align-justify">Participants in prayer meetings, even before the ban, faced police brutality: they were repeatedly detained, beaten with batons by the police and threatened with fines. During the trial, the Catholics will be represented by the organisation Christian Lawyers. The association stressed that "the fundamental rights to religious freedom, to publicly profess one's faith, as well as the right of assembly have been violated".</p> <p class="text-align-justify"><strong>Removal of religious symbols from public spaces, ban on prayer... persecution of Christians in Spain escalates</strong></p> <p class="text-align-justify">This is not the first decision by the Spanish government to hit Catholics. On the third of February 2023, on the initiative of Pedro Sanchez's party, the Congress of Deputies passed an amendment to the Penal Code introducing criminal liability for praying outside abortion clinics. According to the amendment, anyone who prays outside an abortion clinic will be liable to a prison sentence of three to twelve months. This punishment will be amendable to community service of between 31 and 80 days. Importantly, the prosecution of 'perpetrators of this type of harassment' does not require a complaint from the victim himself. The adopted amendments also provide for the possibility of banning members of pro-life organisations from certain public places for six months to three years. Catholic organisations stress that the consequence of the new legislation will be that Catholics will be tried for prayer on a par with those who use physical or psychological violence in their relationships.  </p> <p class="text-align-justify">In 2017, liberal political groups tabled a motion to remove religious symbols from the Senate and called for a ban on invoking God when taking the oath of office. In the end, these demands were not granted. The justification stated that everyone has the right to take the oath in accordance with his or her own religious convictions, and that the attempt to ban this would undermine freedom of conscience and religion, which is one of the fundamental human rights.</p> <p class="text-align-justify">In April 2021, in Spanish provinces, local authorities launched grassroots initiatives to remove crosses from public spaces. An example is the case of the mayor of the municipality of El Casar in the province of Cáceres. In his opinion, the stone cross placed in one of the main squares of this town "promotes the views of supporters of the Francoist regime that ruled in Spain in the years 1939-75."</p> <p class="text-align-justify">It is worth recalling that a similar situation occurred in 2019 in Poland, when it was proposed to remove religious symbols from public space, in particular from schools. Ordo Iuris lawyers then prepared a legal opinion on this subject. In turn, in 2021, the Institute's intervention prevented the removal of the cross from a school in Wrocław.</p> <p class="text-align-justify"><strong>Silent prayer is also banned in Australia, Great Britain and Northern Ireland</strong></p> <p class="text-align-justify">In recent years, several countries have considered adopting the so-called buffer zones around abortion facilities. Australia was the first to introduce them. In Northern Ireland, the ban, depending on the location, applies within a radius of 100 to 250 meters from the center where abortions are performed. Apart from prayers, even conversations about abortion are prohibited in the zone, as well as handing out literature or materials with a pro-life message. Representatives of pro-life organizations emphasize that "the criminalization of citizens' peaceful activities not because of antisocial behavior, but because of the desire to exercise the right to express their religious and political views, constitutes a serious threat to the civil rights of every member of our society."</p> <p class="text-align-justify">In March 2023, an amendment to the Public Spaces Protection Order was adopted in Great Britain. According to the new regulations, you cannot pray within a radius of 150 meters from such facilities. Any suspicious person may be fined or sued. Catholic organizations and the Episcopal Conference of England and Wales claim that the new law "discriminates against believers, also harming freedom of speech." Moreover, according to activists, "the new law criminalizes activities that should never be punished, such as prayer, thought, peaceful presence, voluntary communication and practical support, if they are considered obstacles to access to abortion." Ordo Iuris lawyers have prepared a legal analysis on this subject.</p> <p class="text-align-justify">Last year, the case of Isabel Vaughan-Spruce, who was arrested for silently praying outside an abortion clinic in Birmingham, became famous. The woman stood alone outside the clinic, silent and focused. She was not holding banners or posters. However, the police found her behavior "suspicious" and arrested her for "incorrect thinking." The proceedings ended in September 2023 with an apology from the police. Earlier, however, the court of first instance commented on her case, rejecting the hypothesis that Vaughan-Spruce could have broken the law.</p> <p class="text-align-justify"> </p> <p class="text-align-justify"><strong>“Thoughtcrime” becomes a fact</strong></p> <p class="text-align-justify">Freedom of conscience and religion is considered a fundamental human right in democratic societies. This is confirmed by documents and acts of international law, both created within the UN system and in both systems of European law. This right is also included in the Polish Constitution (Article 53(1)). All its restrictions must be introduced by statute and only in special circumstances (Article 53(5) in connection with Article 31(3) of the Constitution). However, they do not concern religious freedom in the internal sphere, which is absolute. Also in this respect, international legal regulations present a uniform position.</p> <p class="text-align-justify">The criminalization of "mental prayer" introduced into the legal systems of individual countries violates this immutable principle. In this context, the question arises how far governments will go in the framework of "political correctness" glorifying neutrality - also in the religious aspect. Since it is no longer allowed to pray in silence, soon it will no longer be possible to organize, for example, a Corpus Christi procession, which is an external presentation of specific religious views. The institute has participated in 112 proceedings.</strong></p> <p class="text-align-justify"><strong>- There are still 11 cases pending in which Ordo Iuris is awaiting admission to proceedings.</strong></p> <p class="text-align-justify"><strong>- These include complaints about the ban on eugenic abortion in Poland, converts from Islam to Christianity facing deportation, or the organizer of a pro-abortion demonstration convicted of allowing the insult of the symbol of Fighting Poland.</strong></p> <p class="text-align-justify">In the vast majority of cases in which the Institute intended to participate, it was allowed to proceed. Ordo Iuris lawyers have so far intervened in 135 cases. In 112 proceedings, the Institute has been admitted by the Court, and in 11 cases it is still awaiting the ECHR's decision on admission. Of the 112 cases in which the Institute has successfully intervened and submitted its legal opinion, 37 cases have already been resolved, and 75 are awaiting the Court's ruling.</p> <p class="text-align-justify">One of the already settled cases concerns a judgment affirming the right of a German pro-life activist to call abortion a murder committed by doctors. In the opinion, the Institute recalled that freedom of speech also includes the right to proclaim shocking, controversial and even offensive views. The fact that doctors who perform abortions may feel offended by this in no way justifies banning pro-life activists from using such terms. (Annen v. Germany);</p> <p class="text-align-justify">The Strasbourg Court has also issued a series of judgments affirming violations of parental rights by Norway's Barnevernet office. In its opinion, the Institute pointed out the systemic nature of the problem in Norway, which, instead of helping parents in difficult situations, takes children away from them, transferring them to foster families and taking away the parents' chance to improve (e.g., A.L. et al. v. Norway, M.L. v. Norway).</p> <p class="text-align-justify">Another example is a judgment finding a violation of Moldova's prohibition of torture, degrading and inhuman treatment. One hospital there performed forced abortions on three women, despite their explicit opposition, taking advantage of their intellectual disabilities. The institute stressed in its opinion that there is an indisputable and worldwide consensus that forced abortion can never be justified (G.M. et al. v. Moldova).</p> <p class="text-align-justify">The Court also decided a case in which it dismissed the complaint of a Danish doctor who was sentenced to a suspended prison term for encouraging patients to commit suicide. One of his victims was an 85-year-old old woman who did not suffer from any serious illness, but was tired of life. Svend Lings advised her on what pharmaceuticals she should take, and recommended that "for 100% certainty" she put a plastic bag over her head, tightening it around her neck with a rubber band with a prescription cord.  A few weeks later, the old woman was found dead in her apartment with the plastic bag on her head.  In the opinion, the Institute reiterated that freedom of speech does not entitle one to encourage and support others to take their own lives (Lings v. Denmark).</p> <p class="text-align-justify">There are still 11 cases pending in which the Institute has applied to the Court for admission to proceedings. Five of them concern complaints against Poland's ban on eugenic abortion, resulting from the Constitutional Court's October 22, 2020 ruling (K 1/20). The ruling declares incompatible with the right to life a provision allowing the killing of an unborn child due to developmental defects such as Down syndrome (I.Z. v. Poland, A.K. v. Poland, B.H. v. Poland, B.W. v. Poland, J.S. v. Poland). The Ordo Iuris Institute intends to present arguments to the Court indicating that the European Convention on Human Rights does not guarantee anyone the right to abortion, instead it guarantees everyone the right to life.</p> <p class="text-align-justify">Also still pending are two cases initiated as a result of complaints by Christians from other countries about bans on public religious services instituted by many governments during the COVID-19 epidemic. The complainants accuse the authorities of violating religious freedom (Figel v. Slovakia, Megard v. France). The Ordo Iuris Institute plans to present documentation of the results of international scientific studies confirming the ineffectiveness of bans on meetings and gatherings to counter the epidemic.</p> <p class="text-align-justify">Another two cases concern converts from Islam to Christianity who fled Iran for Europe and are now facing deportation, with imminent danger to their lives (B.S. v. Turkey, H. R. v. Belgium). The Institute is ready to present to the Court the situation of Christians in Iran whose lives, freedom and dignity are threatened by Islamic fundamentalists.</p> <p class="text-align-justify">Another case relates to a same-sex couple who wanted to settle in Romania after being "married" in an EU country. Only one of the men was a Romanian citizen, while his common-law partner wanted to exercise his right to settle together with his "spouse" under EU law. Romanian authorities refused, pointing out that, under domestic law, marriage is a union between a man and a woman. However, the Court of Justice of the EU ruled that EU law requires a homosexual cohabitant to be treated as a spouse. The men have filed a motion to reopen the proceedings in their case, which was rejected by the court because it was filed out of time. They complain of violations of their right to a court, their right to privacy, their right to marriage and the prohibition of discrimination (A.B. and K.V. v. Romania). The Institute intends to reiterate that the ECHR has no jurisdiction to assess the state's implementation of the CJEU judgment.</p> <p class="text-align-justify">The latest case concerns the organizer of the so-called Black March in 2016 in Kielce. During the demonstration, some participants carried banners with an altered anchor of the Fighting Poland, to which images of women's breasts were attached. The organizer was sentenced by the court to a PLN 2,000 fine for failing to ensure that the demonstration was conducted in accordance with the law (Article 52 para. 3 of the Code of Offenses), which prohibited insulting national symbols such as precisely the Fighting Poland sign. The woman appealed, seeking acquittal, but the second instance court only reduced the fine from 2,000 to 500 zlotys. The activist alleges that her freedom of speech and freedom of assembly were violated (Bunzel v. Poland). Such a report should aim to conduct an objective study of the relationship between religious freedom and discrimination data. However, the author assumes at the outset that there are undefined "human rights of LGBT people" to be threatened by the free exercise of freedom of religion and belief. Such a view not only contradicts the legislation of many UN member states, but also wrongly elevates concepts of gender ideology (e.g., recognition of multiracialism ) to the status of international human rights. This may suggest that those pursuing these demands are deprived of the protections afforded by the human rights system to all people, or that they should be entitled to some special "human rights." In this context, religious freedom - when it comes into conflict with gender theories - is identified as a threat to the full realization of the ideology's goals and its spread in society.</p> <p class="text-align-justify"><br /> The very questions outlined by the independent expert to gather information put freedom of religion, belief and conscience (i.e., universally recognized human rights) on the same level as "freedom from discrimination based on gender identity." Moreover, the language used by the expert not only fails to define what is meant by discrimination, but fails to distinguish discrimination and violence against individuals from opposition to ideology. It thus equates a dispute of views with persecution of persons, misleading those called upon to present a position.</p> <p class="text-align-justify"><br /> The Ordo Iuris Institute responded to the inquiry, rejecting the wording used by Victor Madrigal-Borloz to present the subject of the report. In particular, the Institute stressed that Poland has not accepted gender theory in its legal order and has remained with the natural distinction of gender through biological characteristics. Finally, the prohibition of discrimination, equal treatment and protection from violence, are subject to constitutional protection in the Republic of Poland, which covers all citizens. The Polish legal system fully protects everyone. Diversity, equality and, above all, the right to privacy and the belief in the dignity of every person, have been embedded in Polish culture and tradition for centuries.</p> <p class="text-align-justify"><br /> - The assumptions on which the report is based foreshadow a highly ideologized final document. Its purpose seems to be to indicate how "gender identity" should be perceived by lawmakers, religious leaders and individual citizens, rather than to collect objective data on the subject. The language used, ignoring the existence of differing positions on gender theory, classifies as discrimination anything that is not an affirmation of the claims made by proponents of rejecting the anthropological and biological basis of gender identification. The report contains a description of attempts to disturb the service in Świdnica or Płock. After the "equality march" in Gdańsk, due to glaring provocations and iconoclastic anti-Christian banners, these acts were condemned by current city officials. indicate that the number of religiously motivated hate crimes is on the rise, both in Poland and the rest of Europe. The Organisation for Security and Co-operation in Europe published its annual hate crime report, which also included crimes against Christians reported by the Ordo Iuris Institute. Nearly 600 crimes of this type were registered in 2018 in the countries studied.</span></span></b></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">The report shows that the number of criminal offences against Christians in 2018 increased by nearly 20% compared to 2017. 485 such cases were reported in 2017, and 592 in 2018. An overwhelming majority of these – 447 incidents – involved vandalism, damage to property and places of religious worship. In addition, 100 incidents of physical violence and 37 cases of unlawful threats were registered. 39 such incidents took place in Poland. Similar criminal offences against Christians were reported by 10 other countries, including France, Germany, Ireland, Great Britain and Ukraine. Organization encourages all member states and international organizations to celebrate the day in such a way as to raise social awareness of the phenomenon of religious persecution, the scale of which is increasing throughout the world. This concerns in particular violence against Christians.</strong></span></span></span></span><br />  </p> <p style="margin-bottom:12.0pt; text-align:justify; margin:0cm 0cm 0.0001pt"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:11.0pt" xml:lang="EN-US"><span style="color:#333333">According to the report of The Pew Research Center Christians are the most persecuted religious group in the world.  The research indicates that acts of persecution of Christians were committed in 108 countries throughout the world in 2014, in 128 countries in 2015, while in 2016 christianophobia spread to 144 countries.  The incidents in question included discrimination, verbal abuse, physical assaults, arrests and destruction of places of worship.  The report of the Open Doors foundation confirms these conclusions.  The data gathered by this organization show that monthly an average 345 Christians die for reasons associated with their faith, 105 churches and other Christian buildings are burned or attacked, 219 Christians are held without trial, arrested, condemned and imprisoned.<br /><br /> Visible hostility towards Christians in the world is growing from year to year.  It transpires through acts of vandalism, arson, burglary, theft, sometimes also physical aggression and violence against the clergy or the faithful.  Crosses and statues of saints are toppled; the Eucharist is desecrated.  Christians are beginning to struggle with marginalization and hostility caused by their faith and convictions held.  Violations of the religious freedom, the freedom of speech, the academic freedom, the freedom to contract which affect Christians or are specifically targeting them are becoming more and more widespread not just in other European countries but in Poland as well.</span></span></span></span></p> <p style="margin-bottom:12.0pt; text-align:justify; margin:0cm 0cm 0.0001pt"><br /><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:11.0pt" xml:lang="EN-US"><span style="color:#333333">The UN resolution which introduced the International Day Commemorating the Victims of Acts of Violence Based on Religion or Belief aims to draw attention to the fact that the problems of violence and aggression due to religious reasons are of international nature and that it is the obligation of states to undertake steps assuring a more effective control and verification of observance of human rights in terms of religious freedom.  The goal is to counteract aggression and acts of violence motivated by religious or confessional prejudice and to undertake every kind of assistance and victim support possible.<br /><br /> In the adopted document the United Nations point to a growing number of acts of religious intolerance and violence against members of religious communities and minorities throughout the world and the increasing intensity of such incidents which are frequently criminal in nature.  The resolution decisively condemns continued violence and acts of terrorism and expresses regret regarding all acts of violence motivated by religious or confessional prejudice and all such acts directed against homes, businesses, real property, schools, culture centers and places of worship as well as attacks against people, religious sites and temples.</span></span></span></span></p> <p style="text-align:justify;
