Already the initial draft indicated that the aim of the regulation would be to bring about the acceptance of adoptions made in another country by same-sex couples. At the beginning of December 2022. The European Commission released a draft regulation to regulate the mutual recognition of a child's origin by EU Member States. </p> <p class="text-align-justify">From the moment the EC announced its legislative initiative related to the regulation of cross-border parental situations, the Ordo Iuris Institute monitored the status of work on the project. Lawyers submitted their comments and participated in public consultations, pointing to the lack of competence of the EU to regulate this matter and the contradiction of the proposed regulations with the Polish constitutional order.The Institute also prepared a detailed analysis of the proposed document.At the invitation of the organisers of the Conference "Let's stop child trafficking", organised in the European Parliament in June this year, the discussion was attended by representatives of the Ordo Iuris Institute, who in their speech pointed out the threats to the sovereignty of Member States and that the project may aim directly at introducing changes in substantive family law, which remains outside the competence of the European Union. </p> <p class="text-align-justify">On 7 November, the Committee on Legal Affairs (JURI) adopted its opinion on the draft (14 votes in favour, 4 votes against, no abstentions). According to the Commission, the revision of the legislation aims to maintain but also strengthen the fundamental rights of both children and adults, as well as to increase legal certainty and reduce costs and bureaucracy. </p> <p class="text-align-justify"><strong>Interference with family law</strong></p> <p class="text-align-justify">The draft regulation provides for the recognition in all EU countries of parenthood established in one member state.MEPs stressed that the public policy clause, which is an exception to the application of these rules, must not lead to discrimination against the child, making it clear that it refers to "parents "of the same sex", and its application must be considered on a case-by-case basis and by way of exception.In addition, in cases where national authorities oppose recognition, established parenthood is to remain in force until all national and EU legal remedies have been exhausted and a final decision has been issued. It should be made clear that the public policy clause is an expression of state sovereignty and a tool to protect national legal order.In the draft regulation, this clause, which could protect the Polish constitutional order, is subject to a number of limitations which may make its application impossible in practice.Attention was also drawn to the issue of the European Parentage Certificate (EPC), which would be available in all official languages of the EU and would operate in both traditional and digital form, with a time limit of no more than two weeks for its preparation and issuance. </p> <p class="text-align-justify">Attention was also drawn to the issue of the European Parentage Certificate (EPC), which would be available in all official languages of the EU and would operate in both traditional and digital form, with a maximum of two weeks for drafting and issuing.The regulation would specify which court and which law applies in parentage disputes. </p> <p class="text-align-justify">MEP Maria-Manuel Leitao-Marques said that the proposal solves the problem of establishing parentage in individual Member States and that it aims to eliminate the situation where, from a legal point of view, a child would lose his or her parents if they enter another Member State. Furthermore, it considered unacceptable the practice of not recognising parent-child relationships in 'LGBTIQ+ families' in some Member States. </p> <p class="text-align-justify">- The European Union shall act only within the limits of the competences conferred on it by the Member States in the Treaties in order to achieve the objectives set out therein. At the same time, any competence not conferred on the Union in the Treaties remains with the Member States. Family law falls within the competence of the Member States, and any pressure on the States to create the legal possibility to formalise same-sex unions, whether in the form of civil partnerships or by referring to the concept of marriage or by granting marriage privileges to such unions, may constitute an unauthorised attempt to interfere in the family law of the Member States,' points out Dr Przemysław Kulawiński, an analyst at Ordo Iuris.</p> <p class="text-align-justify">The regulations included in the draft will also have an impact on the normalisation of surrogacy - the purchase from a 'surrogate mother' of a child to whom the purchasers then obtain parental rights. Although surrogacy is not currently allowed in EU countries, once this regulation is adopted, changes to the national laws of one Member State will be sufficient to open the way for wider acceptance of surrogacy. </p> <p class="text-align-justify"><strong>State sovereignty at risk</strong></p> <p class="text-align-justify">The European Parliament will vote on the project in December. Once it has been completed, the final decision will rest with member state delegates. Unanimity will be required for the adoption of this regulation. The father remained in Norway, but visited his family on several occasions.</strong></p> <p class="text-align-justify"><strong>· Information about the mother provided by Norwegian services has not been confirmed by the Polish side. However, on August 9, after a European Arrest Warrant was issued, police detained both parents, and the girl was taken to an orphanage.</strong></p> <p class="text-align-justify"><strong>· The next day the parents were questioned in the presence of a lawyer and released. On August 11, the court allowed the daughter to leave the orphanage and return to her parents.</strong></p> <p class="text-align-justify"><strong>· Legal assistance to the family was provided by the Ordo Iuris Institute.</strong></p> <p class="text-align-justify">The mother, who has full parental authority over her daughter, moved to Poland in September/October 2022. The daughter's father remained in Norway without objecting to his daughter's relocation. The move involved the risk of the Norwegian children's agency (Barnevernet) taking the girl away. The reason the service was watching the family in Norway was that the mother grew up in an orphanage and had a history of drug use episodes. During the child's stay in Poland, the daughter was repeatedly visited by her father and other family members.</p> <p class="text-align-justify">The fact of the move led Barnevernet to initiate proceedings to take custody of the girl while she was already in Poland. Norwegian services alerted the Polish police to the fact that the minor was in the care of a person who is a drug addict and a danger to the child. This information led officers to intervene at the mother's residence with the child in October 2022. According to police notes, the information about the mother provided by Norwegian services was not confirmed.</p> <p class="text-align-justify">The mother presented documents showing that she does not use drugs, as well as a number of certificates confirming that the child has a stable situation in Poland. The girl is in her mother's care, and is provided with medical care, kindergarten and extra-curricular activities.</p> <p class="text-align-justify">The Polish police's verification of the child's situation led to the abandonment of the action and was limited only to providing information about the situation to the Polish family court. The District Court verified the girl's situation. On the basis of the probation officer's interviews and evidence attached by the child's mother, the Warsaw District Court waived the initiation of proceedings to review the mother's family situation over her daughter.</p> <p class="text-align-justify">Since then, the situation of the child and mother was stable. The minor continued her education in kindergarten and developed properly under the care of her mother. Despite the child's normal situation, in July 2023, the law enforcement authorities of the Kingdom of Norway issued a European Arrest Warrant after the mother due to the alleged kidnapping of her daughter by the mother. This prompted Polish police to detain the mother and the father visiting the daughter on August 9, 2023 in Warsaw.</p> <p class="text-align-justify">The parents were detained and taken into custody to await questioning, while the child was taken to the Janusz Korczak Children's Home No. 2 in Warsaw. Norwegian services were informed of the parents' detention and that the child was in foster care. Although the minor was in the proper care of her mother in Poland, there was a risk that a Norwegian official would take custody of the minor and return with her to Norway without the parents.</p> <p class="text-align-justify">On August 10, the parents were questioned with the participation of their defense attorney Maciej Kryczka. After giving explanations, evidence and legal arguments, the District Prosecutor's Office decided to release the parents to freedom.</p> <p class="text-align-justify">Despite their stay at liberty, the parents were unable to take their daughter from the Children's Home due to the lack of a Polish court decision in this regard. The child missed her mother in particular. She refused to eat meals, cried and demanded contact with her mother.</p> <p class="text-align-justify">On August 11, 2023, at the request of the mother's attorney, the National Prosecutor's Office and the management of the orphanage where the daughter was staying, the District Court issued a decision to release the minor from the orphanage and hand her over to her mother.  Currently, the parents are staying with their daughter at large.</p> <p class="text-align-justify">"Thank you to all those involved in helping Norwegian citizens. Once again, the Kingdom of Norway is instrumentally using the criminal law to take custody of a child and isolate him from his family in a manner contrary to his welfare without any rational reason. Special thanks are due to prosecutors Filip Wolski, Malgorzata Slowinski of the National Prosecutor's Office, and the District and Regional Prosecutor's Office, who joined the request for the surrender of the daughter to her mother before the family court. Many thanks to the Children's Ombudsman Nikolai Pawlak for his intervention, and to the management of the Janusz Korczak Children's Home No. 2 in Warsaw for their cooperation while taking care of the child. The efficient cooperation of all entities in the case led to a happy conclusion of this stage of the proceedings and the safeguarding of the interests of the child and the parents." - commented the family's attorney, Maciej Kryczka, who cooperates with the Ordo Iuris Trial Intervention Center.</p> <p class="text-align-justify">The proceedings in the family's case have not ended. The cases concern two families broken up by the child protection office - Barnevernet, on the basis of false accusations of mental problems of the parents. In the first case, the evidence for this was supposed to be "excessive" concern for the children's health. These rulings confirm the phenomenon of systemic violations of human rights in Norway.</span></span></b></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">The first case concerned the marriage of a Swede and a Romanian, who moved to Norway in 2013. They moved to the country with their three sons, who were 13 years old, 8 years old and 6 years old. Shortly after the move, Barnevernet issued an order to immediately take the three boys from their parents because of alleged "insufficient insight into their problems." According to officials, the parents' concern for the children's health was excessive. In the eldest son, the parents began to notice symptoms that might indicate the occurrence of Ehlers-Danlos syndrome, a genetic disease manifested by excessive flaccidity and tenderness of the skin and by joint instability. The parents also noticed similar symptoms in their younger sons.</span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">After Barnevernet's intervention, the children were transferred to foster care, and the parents were granted the right to two hours of meetings per month, which were soon limited to four half-hour meetings per year. During the meetings, the parents could not communicate with the boys in their native language - Romanian. The couple appealed the decision to court. In the course of the proceedings, the expert's opinions confirmed that, contrary to Barnevernet's suggestions, the parents did not have mental problems, and their oldest son actually required special care, although it was not determined whether he suffered from EDS. Moreover, it was determined that the eldest boy did not handle well the separation from his parents and wished to return home as soon as possible.</span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">In 2015 the Superior Court ruled that Barnevernet's decision to take the children from their parents was unfounded. However, the court also ruled that only the eldest boy could return home because the other two allegedly had already bonded with their new place of residence. At the same time, the court granted the parents the right to six six-hour meetings with the two sons per year, under the supervision of a social worker.</span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">Due to this decision, the children's father lodged a complaint with the European Court of Human Rights in Strasbourg. The ECHR ruled that Norway had violated the father's right to respect for his family life, as guaranteed by Protocol No. 8 to the Convention for the Protection of Human Rights and Fundamental Freedoms. The court drew attention to the inconsistency in the Norwegian court's ruling, which on the one hand declared Barnevernet's decision to be entirely unfounded, and on the other hand annulled it only in the part concerning the oldest boy. In addition, the judges reminded that the state has the duty to make efforts to reunite the child with its biological parents. Meanwhile, throughout the whole separation period, the authorities did not make any efforts in this direction - the allowed meetings between the parents and their children were rare and they could not communicate with each other in their native language.</span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">The second case concerned a Norwegian married couple, who in 2008 had their 2.5-year-old son taken away by Barnevernet, because of their alleged mental illness. In 2014 The Superior Court upheld Barnevernet's decision, indicating that after six years of separation, the child allegedly felt more connection with his foster carers than with its biological parents. The Strasbourg Court has clearly condemned this reasoning. If the state is the cause of the loss of family ties, it cannot justify keeping children in foster care on this basis.
