Their primary purpose is to prevent and counter the spread of communicable diseases that pose an international threat and to jointly strengthen the broader international health system. They regulate, among other things, the transmission and exchange of information on health threats between Member States and rules to counter the spread of communicable diseases, which refers in particular to the detection, assessment, notification and response to such threats in cooperation with the WHO. An important task of the International Health Regulations is also the protection of international trade and transport, as the objectives of this regulation should be pursued in a way that does not cause undue interference and disruption in these two economically vital areas. In terms of legal nature, the International Health Regulations are a WHO regulation, adopted on the basis of Article 21 of the World Health Organisation Constitution.</p> <p class="text-align-justify">The current version of the International Health Regulations, adopted by the World Health Assembly in 2005, has from the outset been met with far-reaching criticism, which referred, among other things, to its excessive interference in the sovereignty of states or its failure to adapt to the realities and capabilities of individual countries. A particular wave of criticism fell on the regulation in question after the outbreak of the COVID-19 pandemic, which referred in particular to the assessment of the actual possibility of preventing the spread and combating infectious diseases of global reach in its current form. The economic consequences of the restrictions introduced at the time were also negatively assessed, especially in terms of hindering international trade and transport.</p> <p class="text-align-justify">Therefore, a process was initiated in 2022, the final outcome of which is expected to be the adoption of a new version of the International Health Regulations. The result so far of the work of the Working Group on Amendments to the International Health Regulations, the special body in charge of developing the new version of the IHL, was a Report, published in February this year, and containing the amendments submitted. Recently, there has been false information in the media space that the deadline for countries to reject the new version of the International Health Regulations currently under development would be 1 December this year.</p> <p>In fact, at the 76th session of the World Health Assembly in May 2022, amendments to Article 55, Article 59, Article 61, Article 62 and Article 63 of the ICCPR were adopted through resolution WHA75.12, and it is for States to object to their adoption by 1 December.</p> <p>Of the amendments adopted at that time, the most significant is the addition of paragraph 1bis to Article 59, which modifies the time limit for States to make reservations or reject future amendments to IHR, reducing it to 10 months (it is currently 18 months). In addition, the wording of Article 59(1) of the IHR has been slightly amended, thus establishing two separate modes for rejection or reservations:</p> <p>1. a procedure relating to the adoption of new regulations (new IHR), where the time limit in question is still 18 months (Article 59(1) IHR),<br /> 2. and a new procedure for the rejection of amendments to IHR already in force (amendments to IHR), where the deadline in question is 10 months (Article 59(1bis) of IHR).</p> <p>On the other hand, Article 59(2) IHR shortens the time for future amendments and amendments to IHR to enter into force - from 24 to 12 months.</p> <p class="text-align-justify">The rest of the adopted amendments, concerning Articles 55, 61, 62 and 63 of the IHR, are primarily technical in nature, being in fact the completion of the amendment to Article 59 of the IHR. Thus, in Articles 55(3) and 61 of the IHR, insignificant changes have been made relating to the modification of the aforementioned deadlines. Article 62(4)(c), on the other hand, requires the WHO Director-General to request notification from States Parties in the event that they object to amendments to the IHR. Article 63(1), on the other hand, deals with the case where a State, after initially making reservations, finally decides to withdraw them. The wording added in 2022 as part of the amendment, provides that, in such a case, IHR may not enter into force, with respect to that State, earlier than 24 months after the submission of reservations under Article 59(1) and not earlier than 12 months, in the case of reservations under Article 59(1 bis), counted from the date of notification by the WHO Director-General.</p> <p class="text-align-justify">Significantly, the amendments to the IHR provisions in question (from 2022) will enter into force on the basis of the pre-amendment rules, i.e. after 24 months. Only after the expiry of this period will the subsequent amendments enter into force under the new regime, i.e. after 12 months.</p> <p>Thus, States Parties intending to reject or object to any of the amendments may notify the Director General within 18 months of the date of circulation of the notice of amendments, i.e. by 1 December 2023. Importantly, the final decision on Poland's position on the amendments to the International Health Regulations is made by the Minister of Health.</p> <p>- "Changes to the International Health Regulations and other WHO regulations raise serious concerns. But the changes affected by the deadline of 1 December 2023 are marginal changes of a technical nature. The draft is the result of two INB meetings, held consecutively in a hybrid format (in-person and online) on 4-6 September and 22 September this year. Work on the treaty is taking place concurrently with the preparation of amendments to the International Health Regulations, the WHO's regulation of the prevention, detection and prevention of the international spread of infectious diseases, which together are intended to be the main tools for conducting health policy in the transnational area.</p> <p class="text-align-justify">Work on the treaty to date has generated discussions that have focused primarily on the proposal to give the WHO a central role in global health governance, while possibly limiting the competences of member states in this regard. According to previous amendments tabled in June of this year, the WHO Director-General would be given the authority to declare pandemic status on his or her own, which could result in serious consequences for the economies of individual countries, among others. Doubts have also been raised about the provisions under which treaty signatory states undertake to combat 'false' information related to the spread of infectious diseases. Bearing in mind the experience of the COVID-19 pandemic, such proposals have raised natural concerns from the point of view of fundamental rights and civil liberties, on the grounds that, if wrongly designed, they could result in restrictions on freedom of expression.</p> <p class="text-align-justify">Earlier, the Polish Ministry of Health announced its official position in relation to the negotiations on the text of the so-called pandemic treaty.</p> <p class="text-align-justify">"The Polish side's position is that the future so-called pandemic treaty should be a document that is as concise and operational as possible, focusing on the most important issues for global health security, including, above all, addressing the areas most relevant to the fight against pandemics, not infringing on the sovereignty of states and leaving a wide margin for decision to member states. The final document should, in the first instance, be acceptable to and implementable by the vast majority of WHO member states" - emphasised the MZ.</p> <p class="text-align-justify">- As the Polish delegates rightly pointed out, international cooperation in addressing public health threats must not, at the same time, infringe on the sovereignty of Member States. Both Poland and the other signatory states of the document should have the decision-making power to shape their own health policies, cooperating at the international level to the extent that will enable more effective implementation of the objectives and countering the threat. However, it is essential that the agreement takes into account the multifaceted diversity of member states, as well as respect for fundamental rights and civil liberties, pointed out Patryk Ignaszczak, an analyst at the Ordo Iuris International Law Centre.</p> <p class="text-align-justify">On 6 November, the next INB meeting began. <p class="text-align-justify"><strong>· The New York meeting will discuss goals relating to, among other things, recovery from the COVID-19 pandemic, access to water and energy sources, and improving infrastructure.</strong></p> <p class="text-align-justify">From July 10 to 20, the High Level Political Forum (HLPF), a special global platform to strengthen and coordinate the UN's Agenda 2030 sustainable development policies, is meeting in New York.</p> <p class="text-align-justify">The 2030 Agenda is the abbreviated and commonly used name of the UN resolution known formally as "Transforming Our World: the 2030 Agenda for Sustainable Development with Sustainable Development Goals" (The Sustainable Development Goals). It contains a plan of action set by the UN and member states that includes an agenda for solving the most pressing, in the opinion of its authors, economic, social and environmental problems of the world today. The document in question establishes 17 such goals and 169 tasks, relating to matters related to various and very broad issues such as people, planet, prosperity, peace or partnership. All of them are to be achieved by 2030.</p> <p class="text-align-justify">The 2030 Agenda is a highly controversial document, due in part to the language used there and the vague and ideologically charged terms. These include, first and foremost, terms such as "reproductive rights" or "reproductive and sexual health," which, according to the wording of many international documents, include within their scope the so-called right to abortion. </p> <p class="text-align-justify">The theme of this year's regular meeting will be recovery from the COVID-19 pandemic and implementation of Agenda 2030 for sustainable development.</p> <p class="text-align-justify">The Forum's upcoming meeting will discuss 5 goals:</p> <p class="text-align-justify">Goal 6 Ensure access to water and sanitation for all through sustainable management of water resources.<br /> Goal 7. Ensure access for all to sources of stable, sustainable and modern energy at an affordable price.<br /> Goal 9 Build stable infrastructure, promote sustainable industrialization, and foster innovation.<br /> Goal 11 Make cities and human settlements safe, stable, sustainable, and inclusive.<br /> Goal 17 Strengthen the means of implementation and revitalize the global partnership for sustainable development.<br /> Much attention is drawn to the use of very general and imprecise language used to formulate the text of the resolution containing the goals set under Agenda 2030. The terms used therein, especially in the context of the articles cited, are ambiguous. Significantly, the 2015 resolution does not include definitions explaining the meaning of each term. In addition, many of the 5 goals mentioned overlap, at least in part, in terms of their meanings, such as the identical environmental provisions in Tasks 6.6 and 11.4, respectively.</p> <p class="text-align-justify">Secondly, a large part of the issues under discussion relate to developing countries in the broadest sense, as well as to completely failed states. For it suffices to mention the provisions relating to issues of lack of access to drinking water or sanitation (Tasks 6.1 and 6.2), or the explicitly expressed need for developed countries to support developing countries (Task 17.2).</p> <p class="text-align-justify">In addition, the 2030 Agenda is accused of a lack of coherence between its various elements, which refers especially to the differences that exist between socio-economic goals and those relating to environmental protection. The biggest controversy, however, is over the aforementioned vague issues relating to gender, sexual and reproductive health or sexual education contained primarily in goals 3 and 5, which are not the subject of the meeting to be held in July.</p> <p class="text-align-justify">At the upcoming meeting of the High Level Political Forum (HLPF), the goals under discussion will be presented in very general terms, often in terms of links to other goals and against the background of selected and equally generally portrayed selected issues. public health emergency and the need for a holistic approach to health care.</strong></p> <p><strong>- The Assembly stressed that new threats to public health, perhaps worse than Covid-19, are to be expected. These are to be related to climate change, among other things.</strong></p> <p><strong>- A resolution was drafted calling on member states to "strengthen the global health architecture" and become more involved in the work of the World Health Organization, including the preparation of a so-called "anti-pandemic treaty.</strong></p> <p><strong>- The resolution was adopted with 54 votes in favor and eight against.</strong></p> <p class="text-align-justify">During the meeting of the General Assembly of the Council of Europe, a debate was held titled. "The state of public health emergency: the need for a holistic approach to multilateralism and health care." The aftermath of the discussion resulted in the adoption of a resolution by members of the Assembly, according to which countries are to urgently learn lessons from previous health crises by strengthening the global health architecture and developing strategies at the national level.</p> <p class="text-align-justify"><br /> The Parliamentary Assembly recognized the need for a holistic, multilateral effort, bringing together the World Health Organization (WHO), the World Trade Organization (WTO) and others to revise the rules governing the health sector in the provision of essential medicines, vaccines and health care services at the national and international levels, including the diversification of medical supply sources. These rules should ensure that both the public and private sectors in health care anchor their actions in human rights, particularly the right to health, and guarantee equitable access to quality treatment and vaccinations for all.</p> <p class="text-align-justify"><br /> The parliamentarians further pointed out that "the world has entered a new era of pandemics, in which Covid-19 is seen only as a harbinger of further - and possibly worse - public health emergencies. New threats to public health are expected to be linked to the climate crisis, coupled with declining biodiversity and the consequences of armed conflicts waiting to unfold and likely to hit the world unexpectedly. It is therefore urgent that countries learn from previous health emergencies by strengthening the global health architecture and developing the necessary strategies at the national level to respond quickly to emerging global health threats."</p> <p class="text-align-justify">The text adopted stresses that ongoing processes to transform global health governance must be based on the principle of justice and the protection of human rights and fundamental freedoms in public health emergencies, calling on member states to commit to ensuring sustainable financing for WHO and making it independent of voluntary contributions.</p> <p class="text-align-justify">- The content of the resolution indicates that the interest in the treaty under preparation and in giving the WHO a major role in the field of global health policy is also viewed positively by members of the General Assembly of the Council of Europe. Although the draft is still only a prototype for a future agreement and many gaps have been left, already in this form it proposes solutions worth noting. Among other things, the document emphasizes the central role of the WHO, and even proposes giving the Director General the right to declare a pandemic.  In addition, while the principle of sovereignty is identified as one of the guiding principles of the document, it comes with a condition - countries have autonomy in shaping health policy, provided they do not harm their own people or other countries.</strong></p> <p class="text-align-justify">The document is expected to form the basis of discussions at the fourth INB meeting, which will begin on February 27. The contents of the draft were drawn up based on a previous conceptual document and on the basis of discussions held at the third meeting of INB members, which included delegations from member states.</p> <p class="text-align-justify"><strong>WHO's central role</strong></p> <p class="text-align-justify">As in the conceptual version, the Preamble to the document emphasizes the WHO's role as the guiding and coordinating body for international health activities, in pandemic prevention, preparedness, response and reconstruction of health systems, and in gathering and generating scientific evidence, as well as, more generally, fostering multilateral cooperation in global health governance. WHO's competence in this area is also highlighted twice later - similar content appears in Article 4, titled "Guiding principles and rights," and then in Article 15, "Global coordination, collaboration and cooperation." It is worth noting that in the latter provision, it is additionally proposed that it is the WHO Director-General who is equipped with the right to declare a pandemic. In addition, it was indicated that the agreement also applies to health systems at the national and regional levels.</p> <p class="text-align-justify">Regardless of the assessment of the appropriateness and effectiveness of centralized management of the health systems of the 194 countries (that's how many members WHO has at the moment) - potential signatories to the agreement - it is worth noting that in most of the positions presented during the international public consultation of the document, the centralization of the coordination of future health emergencies was criticized.</p> <p class="text-align-justify"><strong>Principle of sovereignty of states</strong></p> <p class="text-align-justify">Although the first words of the Preamble emphasize the sovereignty of individual States Parties in dealing with public health issues, especially pandemic prevention, the rest of the document carries this principle with the condition. States have the sovereign right to determine and manage their approach to public health, particularly pandemic prevention, preparedness, response and restoration of health systems, in accordance with their own policies and legislation, provided that actions within their jurisdiction or control do not cause harm to their peoples and other states. This raises questions as to whether, how and to what extent a state's sovereignty to decide on public health, both during and outside of a pandemic (since the document defines coordination powers also outside the pandemic period), can be limited in case it "causes harm to the public or other states." At the same time, the drafters - at least at this stage - have not defined how the said harm is to be understood.</p> <p class="text-align-justify"><strong>Fight against disinformation</strong></p> <p class="text-align-justify"> </p> <p class="text-align-justify">The document also includes a chapter on the signatories' commitment to promote pandemic and public health knowledge, under which States Parties will be required to increase scientific knowledge, public health and pandemic awareness among the population and counter false, misleading or disinformation, including by promoting international cooperation. To this end, states are recommended, among other things, to conduct regular social media analyses to determine the prevalence and profiles of disinformation, which will contribute to the preparation of communication strategies to counter disinformation and so-called "fake news. Although the phenomenon of disinformation in social media - or on the Internet more broadly - is on the rise, the experience of the COVID-19 pandemic, during which some experts were marginalized in the public debate simply because they did not share the position of the majority and proposed alternatives to the accepted ways of countering the pandemic (at least partially correct, as the passage of time has shown) has shown that, in the name of countering disinformation, there can be censorship of free scientific debate on ways to combat the spread of infectious diseases. What is particularly important when introducing such regulations is to approach the problem rationally and correctly identify its sources. </p> <p class="text-align-justify"><strong>Costs</strong></p> <p class="text-align-justify">Possible ratification of the document will also involve financial expenses for the parties. Countries are to plan and provide adequate financial support, in accordance with their budgetary capabilities, to strengthen pandemic prevention, implement national plans, programs and priorities, and strengthen health systems. The parties also pledge to allocate in their annual budgets no less than 5 percent of their current health expenditures to issues related to pandemic prevention and health system repair, particularly to improve and maintain adequate capacity and activities to achieve universal health coverage. In the future, they are also to allocate a certain percentage (not yet indicated in the draft) of GDP for international cooperation and assistance on pandemic prevention, particularly for developing countries, including through international organizations.</p> <p class="text-align-justify"><strong>Treaty bodies</strong></p> <p class="text-align-justify">In order to effectively implement the treaty provisions, under its provisions, it is proposed to establish a Governing Body, made up of two members: The Conference of the Parties (COP), which would be the sole decision-making body, and a body of an administrative nature - the Officers of the Parties (Officers of the Parties).</p> <p class="text-align-justify">As a policy-setting body, the COP has the authority to regularly review (every three years) the implementation of the document and decide on its effective implementation. It is composed of delegates representing the States Parties. It convenes regular sessions of the Governing Body and adopts its internal rules of procedure. The Officials of the Parties, on the other hand, will serve as the administrative body, consisting of two chairpersons, four vice-chairpersons and two rapporteurs, elected by the COP for a term, the length of which the project proponent has not yet determined.</p> <p class="text-align-justify">While the two aforementioned bodies, are to be comprised exclusively of individuals with the legitimacy of national governments, it is also planned to establish a Consultative Body (devoid of decision-making power, but aimed at providing advice and technical input into decision-making processes), which, due to its composition, lacks such strong legitimacy. In addition to delegates representing the parties, it is to include representatives of the United Nations and its specialized agencies, as well as states that are members or observers of the Organization, even though they are not signatories to the treaty. Moreover, by formal request, representatives of any body or organization, national or international, governmental or non-governmental, private or public sector, who are "qualified in matters covered by the treaty" may also participate in the Consultative Body's work.</p> <p class="text-align-justify">The content of the document under review is not final, and the model presented will be discussed by member states at the upcoming fourth meeting of the Intergovernmental Negotiating Body. The next draft replicates the document's previously stated goals, such as establishing a central role for WHO in coordinating health policy and coordinating scientific information. During discussions, the need to take into account so-called reproductive rights was emphasized. At the third INB meeting, member country delegations adopted the new draft, pointing out the need to define the term "pandemic." The INB office is working on preparing a "zero" draft based on additional information received from member states. The draft will be in circulation as of February 2023, and negotiations are scheduled to begin at the fourth INB meeting - February 27.</strong></p> <p class="text-align-justify">From December 5-7, 194 WHO member states met in Geneva for the third meeting of the Intergovernmental Negotiating Body (INB), established to draft a binding international agreement on the management of future health threats and pandemics. Before each meeting with member states, the INB delegation sends them a new draft based on what was achieved at the previous meeting.</p> <p class="text-align-justify">The delegations discussed the content of the agreement on the basis of a draft previously prepared by the INB Office, which compiled comments submitted by member states and stakeholders at previous meetings and the results of public consultations, in which the Ordo Iuris Institute also participated.</p> <p class="text-align-justify">Contrary to most of the positions expressed during the public consultations, the latest draft of the agreement reiterates the intention to centralize the coordination of future health emergencies in the hands of the WHO.</p> <p class="text-align-justify">Among the agreement's main points, it emphasizes that policies and interventions for prevention, preparedness, response and recovery of health systems should be supported by the best available scientific evidence, and that global, regional and national policy decisions should be based on science and evidence. The draft recognizes the WHO as the most appropriate body "to generate scientific evidence."</p> <p class="text-align-justify">During a discussion held recently in Geneva, countries welcomed the draft presented by the INB Bureau, stressing in particular the need for a common definition of a pandemic and ensuring the principle of transparency and equity as key points for future negotiations. Some delegations also explicitly stressed the need to include provisions protecting so-called reproductive health in the agreement. At the end of the three-day meeting, member states agreed to draft toward a legally binding agreement to be published in February 2023, in order to start negotiations at the fourth INB meeting, scheduled for Feb. 27</p> <p class="text-align-justify">"In light of the new content published by the INB, it appears that the new agreement is increasingly moving toward global health coordination under the control of the WHO, where there is a risk that the actions of public authorities will be based solely on information provided by the WHO itself. Such an approach - although currently outlined only in general content - leaves room for serious questions on the grounds of freedom of expression and future ways and means of managing health crises. The risk of equating scientific information only with globally accredited information, in fact, threatens to transform medicine from a science based on free and fair scientific debate to one based on authority," commented Veronica Turetta, an analyst at the Ordo Iuris Institute's Center for International Law.</p> <!-- END OUTPUT from style="color:black">The second round of public hearings of the Intergovernmental Negotiating Body (INB), set up to negotiate an international agreement on pandemic prevention, preparedness and response, provided an opportunity for civil society organisations to make their voices heard in the drafting process of the new international agreement and to express their views and experiences on the Covid-19 pandemic. On the INB side, the public consultations should be an opportunity to gather input from citizens around the world in order to better take into account the experiences of civil society during the past health emergency and incorporate them into the content of the agreement. The consultations took place at the end of September and over 250 video contributions were recorded in response to INB’s question: “Based on your experience with the COVID-19 pandemic, what do you believe should be addressed at the international level to better protect against future pandemics?”. The Institute of Legal Culture Ordo Iuris also contributed to the debate with a video statement. </span></span></span></span></span></span></strong></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><strong><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">Will the voices of societies be heard?</span></span></span></span></span></span></strong></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">In contrast to the majority position taken by the delegations of the Member States during the negotiating phases of the agreement – the majority of which were strongly in favour not only of the creation of the agreement, but also of its binding nature – a large number of submissions of the second phase of public consultations expressed strong criticism of the need for an international agreement that would strengthen the role of the WHO, especially in light of the inconsistencies encountered in the management of Covid-19.</span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">The same Dr. Tedros Adhanom Ghebreyesus, Director General of the WHO, in the opening speech of the second round of public hearings, stated that “Part of the civil society organizations and of the public is critical on the development of this accord that will affect everyone”. </span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><strong><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">Who is behind WHO?</span></span></span></span></span></span></strong></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">In this context, many of the interventions from the public have first of all pointed out that the WHO is an institution financed by private institutions, pharmaceutical industries or corporations which however are major players in the pharmaceutical companies. This factor, many pointed out, leads to an inevitable conflict of interest and prioritisation of donor programmes that contribute the bulk of the WHO budget. </span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">Of all the statements critical of the strengthening of the role of the WHO, many also emphasised that in providing scientific information and recommendations, the WHO should be obliged to evaluate all evidence from all human virology and epidemic experts, especially considering discussions with doctors with different opinions. Within this framework, the medical researches considered should be available to all and WHO decisions or recommendations should only be based on scientific evidence. </span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">Moreover, many speakers suggested a return to a definition of pandemic based on mortality rates rather than the level of contagiousness. Some of them also emphasised, from the point of view of recommended pandemic treatments, that investigational vaccines should not be recommended until short- and long-term reactions are known. In this framework, Ordo Iuris Institute of Legal Culture has underlined in its intervention the </span></span></span><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%"><span style="color:black">inefficiency, witnessed during Covid-19, of manage pandemic at the global level and stressed on the respect of freedom of choice of every individual when it comes to medical treatment as well as the need to separate political interests from the field of scientific research, supporting an independent funding of international organizations that would have any impact on the rights and obligations of individuals. </span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">Finally, at the core of the concerns expressed by the citizens who spoke in the consultations, was the consideration that health management should in any case remain in the hands of country representatives and not be addressed globally, as local communities can react better to crisis emergencies.</span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">All these considerations, together with the numerous comments in favour of the adoption of an international agreement, should help the member states engaged in the treaty negotiations to discuss a zero draft of the agreement at the third INB meeting in December 2022. Within this backdrop, however, it is difficult to say that the many voices critical of the agreement will be transfused into the content of the agreement, as the first round of public hearings – where equally many critical voices were raised – did not have such an effect either. </span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">At the next INB meeting in December, indeed, INB Biuro will present delegations with a zero draft of the agreement for discussion by Member States, with the aim of presenting a progress report to the 76th World Health Assembly in 2023 and adopting the binding instrument by 2024. On the side of the European Union's contribution to the development of a drafting text, the Institute of Legal Culture Ordo Iuris asked the Europen Commission for access to all documentation relating to the position taken by the European Institution on global multilateral cooperation to agree on the work of an international pandemic treaty within the WHO and advance global health security.</span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><strong>EU support for a global health architecture</strong></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">The documentation received on the topic, shows that the European Union indicated among the general objectives and principles that should frame the agreement, the human right to health, including access to health care and the links between health and human rights (including sexual and reproductive health and rights, as well as a gender-responsive approach to health) and the centrality of the WHO as the leading and coordinating authority in international health cooperation. The indication to include among human right to health and human rights in general sexual and reproductive rights, which in many documents prepared by the WHO include the ‘right to abortion’, opens the door to the possibility to qualify in a binding treaty, like the anti-pandemic agreement will be, this practice. </span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">In addition, The EU suggested to established a dedicated external and monitoring body, comprised of independent experts, to which national and regional authorities would report regulatory actions and policy improvements and mandated to carry out country visits as well as to build a cooperative framework across major donors (e.g. international financial institutions, banks, bilateral donors, philanthropies) and the private sector in order to establish a new international pandemic financing facility to support capacity building. </span></span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-IE" style="font-size:12.0pt" xml:lang="EN-IE"><span style="line-height:115%"><span style="color:black">In this context, it emerges that the EU position on the issue is strongly in favour of the idea of redesigning the health architecture of the future according to a global response model in the face of health emergencies. This approach, however, in addition to being flawed in the handling of the Covid-19 emergency, contrasts not only with many of the interventions of private citizens in public consultations that, instead, identified local and national response as the key to dealing with health crises that may arise, but also poses the risk of arriving at a final agreement that centralises health policy competences in the hands of the WHO, involving in a stable manner in the emergency response, alongside the Member States, the interests of the organisation's private class="text-align-justify"><strong>From 16 to 18 October 2022, the World Health Summit took place in Berlin with the aim of bringing together global health leaders and private stakeholders from all sectors to discuss the challenges of future health threats and find solutions for enhancing global health in order to strengthen international cooperation. The World Health Summit 2022 is the first Summit to be hosted together with the World Health Organization, under the patronage of the Chancellor Olaf Scholz and the President of the Republic of France Emmanuel Macron. As states in the welcome messages of the two political leaders, the main goal of the Summit is to reflect on the interdependency of climate change, food systems, digital transformation, peace and global health in order to consider human, animal and environmental health as fundamentally interrelated and, as France particularly underlined, to continue to support access to health care and services, including comprehensive sexual and reproductive health and rights for women and girls.</strong></p> <p class="text-align-justify">The Ordo Iuris Institute for Legal Culture was involved in following and participating in selected panels on sexual and reproductive rights, financing and strengthening health systems, pandemic preparedness and response, global health communication and digital transformation for health.</p> <p class="text-align-justify">In each of these panels, political figures, representatives of major donors (e.g. international financial institutions, global stakeholders, philanthropists) and members of the World Health Organisation discussed the priorities and future approaches to be taken to address health challenges. Equity, solidarity, leadership and sustainability were just some of the key words that dominated the discussions held in Berlin with the stated aim of strengthening global health systems. The main objective of creating an efficient system of health cooperation and solidarity between states to strengthen scientific knowledge and counter disease threats is an issue that should be addressed in order to rapidly tackle challenges of an international nature. However, the digital transformation for health, the increasingly central role of supranational bodies and agencies, together with the involvement of global private actors in the provision of public health services emerged as major themes of the forum, showing the goal of a progressive trend towards centralised governance to tackle future health challenges. Moreover, the idea of centralising governance that emerged from the summit should not only exist politically between global and national authorities, but consequently also strengthen the role of digital giants and large donors.. In this framework, topics still debated in several countries, such as, for example, mass vaccination or access to contraception and abortion, were not the subject of discussion, but rather starting points to talk about how to implement on a global scale access to these kinds of services that should be universally guaranteed in public health crisis without any debate on their efficiency or health benefits for women and girls.</p> <p class="text-align-justify">Focusing on the topic of so-called sexual and reproductive rights (SRHR), the speakers involved in the discussion hosted by the WHS reflected on the integration of comprehensive SRHR services into universal health coverage reforms,. Natalia Kamen, executive director of the United Nations Population Fund, pointed out that the State of World Population report published by her agency shows that half of the world's pregnancies are unplanned and unwanted, pointing to 'women's choice' as the solution to this. On the other hand, Bärbel Kofler, German Federal Ministry for Economic Cooperation and Development, explained that Germany's priorities in advancing the agenda item linking SRHR to Universal Health Coverage are based on two levels: on the one hand, strengthening bilateral agreements with countries that need financial support to implement this plan, and on the other hand, funding multilateral funds such as organisations like Planned Parenthood. At the forum it emerged that universal access to sexual and reproductive health and rights is a key component in the implementation of the Sustainable Development Goals. Limited access to such services, due to several factors, including religious and cultural constructs related to contraceptive use, gender inequality, lack of affordability and other barriers, are the new obstacles to be tackled to address the urgency of investing equitably and sustainably in health and wellbeing, according to the intersecting global vision presented.</p> <p class="text-align-justify">Regarding the global commitment to strengthen and finance health systems in the context of the response to Covid-19, the World Health Summit session devoted to this topic strongly emphasised the role played by public-private actors, such as the Gavi Vaccine Alliance, in supporting  primary health care, receiving funding from public institutions and distributing mass vaccines. The key role of actors like this has been described as a leadership role for the future of health policies and a key part of epidemic control, especially in developing countries, without however reflecting on the influence that non-state actors like the Bill and Melinda Gates Fundation, which pledged USD 750 million to the creation of Gavi in 1999, or the Rockefeller Foundation exert on these entities when they fund them with millions of dollars. The issues of independence and transparency of the involvement of large private financiers in the management of public health were not addressed in the ensuing debates, where instead the desire to guarantee these actors room for action in fostering access to health services in concert with national public institutions was reaffirmed. We should bear in mind that these entities want to have a direct impact on the rights and freedoms of individuals.</p> <p class="text-align-justify">The debate between members of twelve different international parliamentary assemblies and networks and the deputy director of the World Health Organisation renewed and strongly emphasised the need to work together to sign a legally binding anti-pandemic treaty in order to tackle future outbreaks that risk developing into pandemics and establish a system of instruments that can bring greater coordination and cooperation to communities. It is worth to mention, that Mariam Jashi, a former member of the Georgian Parliament, raised issues against the political manipulation of the pandemic and the unscientifically based policy measures witnessed in many cases. However, the debate did not address the many concerns from countries and civil society about the risks of centralisation of powers around the WHO and the consequent devolution of competences from nation states to supranational bodies. The WHO, in fact, was unanimously presented as the main coordinating authority in international health. In line with these positions, the President of the European Council, Charles Michael, stated in his speech that: "The WHO is at the heart of our system of international law, it is the guiding and coordinating authority to address global health challenges. The European Union is determined to play a leading role in an inclusive process to strengthen the WHO especially in preparedness for and response to health emergencies, which is why we have launched the idea of an international treaty on pandemics". Within this framework, attention was also drawn to the importance of taking human rights and gender equality into account when drafting the treaty.</p> <p class="text-align-justify">In conclusion, although several sessions of the World Health Summit reflected on the importance of strengthening  national health systems and enhancing the capacities and tools of local communities, the main discussions focused on the idea of strengthening global health cooperation, which, while taking into account local communities and national parliaments, should only be considered more effective if it is led at the global level by the WHO at the health policy level. In this landscape, the role of non-state actors and large philanthropic donors, such as the Bill and Melinda Gates Fundation, acting on a global scale, has been further strengthened in the discussion on the implementation and support of health policies of WHO member states and, especially, developing countries. Within these discussions, however, no doubts were raised about the promotion of access to abortion and contraception for women and adolescents.  Instead, the need to include SRHR (under which the right to abortion is indicated in many documents prepared by WHO) in Universal Health Coverage resounded, even though the issue of access to abortion continues to be debated or limited in many countries.</p> <p class="text-align-justify">The health policy model promoted in the WHS is that of a centralisation of ever greater competences, ranging from the provision of services such as vaccinations, to scientific study and research, from national to international institutions where funding from member states competes with funding from private philanthropic organisations which have has provided the European Commission with a legal opinion on a new EU initiative to protect global health.</strong></p> <p class="text-align-justify"><strong>· The project, which is planned to be adopted still in 2022, implements an agenda identical to the WHO pandemic treaty and the proposals of the Conference on the Future of Europe.</strong></p> <p class="text-align-justify"><strong>· The actions for health announced by the European Commission include access to abortion and global health policy governance.</strong></p> <p class="text-align-justify"><strong>· In addition to critical remarks, the Institute also made suggestions for positive action that the EU could take under the new strategy.</strong></p> <p class="text-align-justify">The EU Strategic Framework for World Health, which the Institute has previously informed about, seems to be one of the most important projects for the European Commission this year. The announced, unusually high pace of adopting the initiative (still in 2022) and further work testify to the rush of the Commission, but also suggest that the main draft strategy on global health has already been prepared, and the work on it correlates in time with the controversial project of the so-called WHO pandemic treaty. Also in numerous recommendations of the Conference on the Future of Europe, EU officials repeatedly referred to health issues, including calling for the extension of the EU's competences in this area.</p> <p class="text-align-justify">The initiative processed by the European Commission envisages, inter alia, the Union's commitment to "equality in health, including women's health", which points to the promotion of abortion. The Commission also calls for recognition of the interconnection "between humans, animals and plants and their shared environment". This goes hand in hand with the assumptions of the so-called the anti-pandemic treaty of the World Health Organization, which also provides for the introduction of central public health management.</p> <p class="text-align-justify">For this reason, in the opinion submitted to the European Commission, the Ordo Iuris Institute pointed to the departure of the initiative's draft from real public health problems in the world, recalling that in 2010 the EU was able to accurately diagnose such problems. As part of the new initiative, in place of previous proposals related to e.g. greater access to primary health care, there were demands to implement pro-abortion UN recommendations or to globalize and centralize management in cases similar to the COVID-19 pandemic.</p> <p class="text-align-justify">In its opinion, the Institute also formulated positive proposals for actions that the EU could take under the announced strategy. These included preventing the influence of the pharmaceutical lobby in relation to drug supply chains and their strategic pooling, as well as reforming the curriculum in medical professions, which would improve the working conditions of doctors and, at the same time, limit the possibility of their work outside the state that financed their medical education .</p> <!-- END OUTPUT from the Intergovernmental Negotiating Body, established in order to develop an international instrument for global health coordination under the leadership of the World Health Organization, took place in Geneva.</p> <p class="text-align-justify">At the meeting in Geneva, the discussion of the Member States started by examining a working draft drawn up on the basis of contributions previously collected from countries and private entities admitted to the INB's work. First of all, the analyzed draft outlines a set of general principles which should be inspired by the treaty and what provisions it should contain. The vision that guides the entire document is strongly focused on "respect for human rights, solidarity and justice", which in the international legal landscape have often constituted general terms, interpreted in such a broad sense that they included safeguards not recognized in the international convention (e.g. the right to abortion).</p> <p class="text-align-justify">Another general and vague principle set out in the contract and recognized as key to achieving the indicated goals is the so-called "right to health", which should be understood - as the INB presidium writes - "as a state of complete physical, mental and social well-being." The described "right to health" should be considered in the light of the Sustainable Development Goals - which include universal access to abortion - and the principles of "gender equality" as a starting point for an effective pandemic preparedness and prevention structure. On this subject, the Working Draft concludes that: "Pandemic prevention, preparedness and response will take into account the specific needs of women and girls, while a country-specific, gender-responsive, participatory and fully transparent approach".</p> <p class="text-align-justify">Following the initial recognition of states' sovereignty in public health matters, the draft agreed to recognize the central role of WHO in pandemic prevention, preparedness and response as an international steering and coordination body, convening meetings and generating scientific evidence. In the same context, the working project speaks of "measures to establish, regularly update and extend the implementation of the Global Peer Review Mechanism to assess national, regional and global preparedness capabilities and gaps, by connecting nations to support a government-wide approach".</p> <p class="text-align-justify">Another critical point in the working draft that countries discussed in the second reissue session is item 13 on "Pandemic and public health coping skills". misinformation or disinformation are key elements in achieving and maintaining the objective of the international instrument to be adopted. At this point, when developing international, regional or national legislative, administrative, technical and / or other measures to prevent a pandemic, Member States should take take into account measures to counter "disinformation, disinformation and fake news, and to promote and facilitate pandemic education and public awareness programs". According to the text, states should also be involved in developing measures to "design communications and messages for the public".</p> <p class="text-align-justify">During the sessions, delegations made many comments on the content of the agreement, with almost all agreeing to a stronger focus on human rights and justice. Among the stakeholders who spoke, Gavi Alliance and Women in Global Health stressed the need to respect gender equality - all genders, a spokeswoman for Women in Global Health said - in order to incorporate this principle into all provisions. As for the clause or the non-binding nature of the contract - the discussion on this is not broadcast by INB.
