A gender ideology-free alternative, also for Poland, is the International Convention on the Rights of the Family," concludes Advocate Nikodem Bernaciak, senior analyst at the Research and Analysis Centre of the Ordo Iuris Institute.</p> <p class="text-align-justify">The Senate of the Czech Republic rejected the draft resolution to consent to the ratification of the Istanbul Convention. Of the 71 senators present, only 34 supported the proposal - 2 less than the required majority. 28 senators opposed and 9 did not cast a vote. The ratification process of the gender convention was initiated last year by the government, which forwarded the proposal to parliament on 21 June. According to Article 10 of the Czech Constitution, the consent to ratify an international agreement must be given by the entire parliament, thus not only the Chamber of Deputies, but also the Senate. In August, the resolution was debated by a committee of the Chamber of Deputies, which is due to discuss the matter again in February, this time responding to the Senate's veto.</p> <p class="text-align-justify">During the debate on the draft resolution, the Constitutional and Legal Affairs Committee took a position. It was presented by Senator Zdeněk Hraba (ODS). According to the position, the Istanbul Convention "is an ideological document that in practice will not help victims of domestic violence". Senator Adéla Šípová (Piraci), on the other hand, presented the position of the Committee on European Union Affairs, which also opposed ratification, stating that the Convention "does not regulate anything that would not already be part of our criminal legislation in the field of violence against women and domestic violence", but instead "may give rise to significant contradictions in interpretation".</p> <p class="text-align-justify">Senate Vice President Jiří Oberfalzer, in justifying his opposition to the Convention, pointed to the fact that it repeatedly uses the term 'gender' instead of 'sex', thereby blurring gender differences. He also cited the judgment of the Bulgarian Constitutional Court of 27 July 2018, which found the Convention incompatible with the Bulgarian Basic Law for analogous reasons. He stressed that the ideology permeating the Convention makes it clear that "if we do not address our children with indefinite pronouns and multiple names until they are sure of their gender, or if we do not send them to various educational courses on gender identification, we are committing domestic violence and this can be a crime". Senator Jitka Chalánková also cited the example of Slovakia, which by a majority of 95 out of 150 of all MPs rejected a draft resolution to ratify the Convention already four years ago - on 25 February 2020.</p> <p class="text-align-justify">The Czech portal 'Seznam Zprávy' revealed that at least one senator had in his possession an analysis on the Istanbul Convention by the Ordo Iuris Institute for Legal Culture. This refers to the material attached to the international petition 'Stop Gender. Stand for Family" (StopGenderConvention.org), launched on 9 June 2020 and translated into 17 languages - including the Czech language. The organisers of the petition recalled that 'the Convention directly attacks marriage and the family, seeing the differences between men and women as the source of violence' and 'it makes gender ideology the basis of state policy by making the objective biological concept of gender irrelevant and replacing it with an understanding of sexuality as a socio-cultural construct. It mandates the implementation of an ideological gender perspective at all levels of state policy".</p> <p class="text-align-justify">The Ordo Iuris Institute, as an ethical alternative to the ideological gender convention, already proposed a draft International Convention on the Rights of the Family in 2018, which would, on the one hand, guarantee effective protection against domestic violence and, on the other hand, emphasise that a strong family is the space that protects all its members most effectively against violence. The bill in 2020 was submitted to the Sejm, having received the support of 150,000 citizens. In the Tenth Chamber of the Sejm, the draft was given the number of print 25 and is due to be debated in the Sejm on 7 February 2024.</p> <!-- END OUTPUT from violence. </strong></p> <p class="text-align-justify"><strong>- Work on the draft has been ongoing since last year, when the document was published by the European Commission.</strong></p> <p class="text-align-justify"><strong>- The directive raises a number of doubts, including due to the language used, most notably the document's use of vague terms and numerous references to the gendered Istanbul Convention.</strong></p> <p class="text-align-justify"><strong>- In addition, the document proposes criminalizing deliberate incitement to violence and hatred on the Internet on the grounds of "gender," which could serve as a pretext for significantly restricting freedom of expression.</strong></p> <p class="text-align-justify"><strong>- The Council, following the Commission, also demands, among other things, the promotion of "appropriate" behavioral changes in society or the use of "gender-sensitive" language by officials.</strong></p> <p class="text-align-justify"><strong>- The Council's abandonment of regulating the crime of rape within the directive is also a significant change.</strong></p> <p class="text-align-justify">The biggest concern in the revised directive is the widespread and inconsistent use of the term "gender" (according to which gender is a socio-cultural construct), instead of the word "sex," meaning biological sex. The term "gender" itself appears as many as 25 times in the directive, including several times as part of vague and ideological formulations, such as "gender-based violence," "gender equality," "gender roles" or "gender stereotypes." The directive also contains numerous references to the Istanbul Convention, which sees the sources of violence, among other things, in traditional gender roles. Significantly, in the Council's amendments, the word "sex," which often appears together with the word "gender," was deleted in many places, after which the recommended version of the document retained only the second term.</p> <p class="text-align-justify">Also of concern was the wording of Article 10, under which states are required to punish intentional incitement to violence or hatred on the Internet on the basis of "gender." Such provisions of the directive raise legitimate concerns that it could serve as a tool introduced through a side door, aimed at preventing any criticism of ideological assumptions. Such solutions pose a significant threat to freedom of expression.</p> <p class="text-align-justify">The directive also includes provisions requiring states to take appropriate measures to, among other things, combat harmful gender stereotypes ("harmful gender stereotypes"), promote "appropriate" behavioral changes in society (Article 36), and ensure that officials address victims in a "gender-sensitive manner" ("gender-sensitive manner," Article 37).</p> <p class="text-align-justify">Another important change is the abandonment of the directive's inclusion of a definition of the crime of rape based solely on lack of consent. This is due to protests from some countries, which claim that the European Union has no competence in this matter, and that setting a precedent could increase Brussels' influence.</p> <p class="text-align-justify">The European Economic and Social Committee also submitted its opinion on the directive last year. In its prepared conclusions, it made far-reaching proposals, pointing out, "we note with concern that the definition of violence against women does not take into account the current restrictions on the free and safe termination of pregnancy, as well as the harassment, primarily near clinics, experienced by women who voluntarily choose this solution."</p> <p class="text-align-justify">- The draft directive presented raises a number of concerns. Particularly dangerous is the extensive use of the vague and ideologically charged term "gender." The provision ordering states to punish intentional incitement to violence or hatred on the Internet on the basis of "gender" is also dangerous, which, as a result of the vagueness of the term, could result in a far-reaching restriction of freedom of expression," points out Patryk Ignaszczak of the Ordo Iuris Center for International Law.</p> <!-- END OUTPUT from connection with the resistance of many states to the adoption of the Convention, the European Commission is to present a draft directive as a form of alternative adoption of its provisions.</b></span></span></p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><b>· The EU is also seeking to ratify the document as an organisation, which would constitute a forcible imposition of its solutions on states.</b></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">‘MEPs and the European Commission are aware that a growing number of countries are distancing themselves from the Istanbul Convention. They see it as a document whose main objective is not to combat and prevent violence but to promote gender ideology. Moreover, this is being done at the expense of the victims of violence, who, as a result of promoting the ineffective or outdated solutions of the Istanbul Convention, are not being helped by modern legal solutions which correctly identify the sources of violence so that they can be effectively counteracted. Instead, the Union seeks to forcefully impose the Istanbul Convention on member states by trying to join it as an international organisation’, comments Anna Kubacka from the Ordo Iuris Centre for International Law. </span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">During the debate, a lot of time was devoted to the issue of ratification of the Istanbul Convention by the European Union, which, according to the European Commission and the European Parliament, would be the culmination of the fight for equality and the fight against violence that has been guiding this term of the European Parliament. EU dignitaries are ignoring the fact that numerous states – including EU Member States – question the effectiveness and ideological wording of the Convention, and some of them, like Bulgaria, have refused to apply it on the grounds that it is unconstitutional.  Ratification of the Convention by the EU is supposed to bypass the objections of these countries. </span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">The Union has encountered a number of procedural problems in this matter, as pointed out by the Court of Justice of the European Union. As a result, preparations have begun for an alternative form of adoption of the Convention’s provisions, as reported by EU Equality Commissioner Helena Dalli. In early 2022, the EC will present a draft directive aimed at avoiding, preventing and combatting violence against women based on the Istanbul Convention, which would be, as Helena Dalli said, the ‘gold standard’ in this area. </span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">During the debate on violence against women and girls, many MEPs rightly stressed the need to effectively combat all forms of violence, be they psychological, physical or virtual. Both in the speech of the representative of the European Commission, Helena Dalli, and in the statements of the MEPs, there was a lack of reference to several specific forms of violence that women currently face, both within and outside of the EU. This was highlighted by Simona Baldassarre (ID), who pointed out that large-scale violence against women involves coercion, both external and economic, which leads women into prostitution or <a href="https://stopsurrogacy.org/pl/"><span style="color:#0563c1">surrogacy</span></a>. Jadwiga Wiśniewska (ECR) also criticised the European Commission and the European Parliament for overlooking or even pretending that such forms of violence as forcing underage girls into marriages with adult men, genital mutilation, and violence on the Internet, especially in the context of pornography, do not exist. These phenomena are by no means uncommon in EU countries today. </span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">The representative of the Group of the Progressive Alliance of Socialists and Democrats, Pina Picierno, expressed an extremely harsh position, even by the standards of the EP debate. In her opinion, ‘women are dying, being murdered by men (...) who do it in the name of the culture of patriarchy’. These words are fully in line with the rhetoric adopted by the EP majority in October this year. At the time, the EP passed a <a href="https://ordoiuris.pl/rodzina-i-malzenstwo/pe-apeluje-o-niestosowanie-domniemania-niewinnosci-wobec-mezczyzn-i-wdrazanie"><span style="color:#0563c1">resolution</span></a> on the impact of the ‘intimate partner’ on women and children and on custody rights, calling for the abolition of the presumption of innocence against men accused of violence (even before any proof has been shown) and calling for their right to custody of their own children to be taken away.</span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">‘Introducing such measures would be clear systemic discrimination against men solely on the basis of gender. The European Union’s efforts to promote gender equality have long ceased to correspond to women’s real expectations. Voices of women, who e.g. appeal for consideration of the problem of <span style="background:white"><span style="color:#4d5156">“</span></span>work-life balance<span style="background:white"><span style="color:#4d5156">”</span></span> or appreciation of care and educational work done at home, are ignored, while the European Commission and the European Parliament constantly fight for universal access to abortion, despite the fact that abortion is a complete denial of women’s rights and gender equality. For some time now, we have also been observing a tendency to ‘make genders equal’ through attempts to introduce systemic discrimination against men and a de facto anti-equality policy towards them’, margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><b>· During the ongoing plenary session, the EP debated and adopted a draft resolution on the issue.</b></span></span></span></p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><b>· This resolution is another document in which the EP disregards the limitations of competences imposed on the EU by the Treaties and expresses itself freely in areas reserved for the Member States, for example, family law, criminal law, childcare, health policy, protection of life.</b></span></span></span></p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><b>· The resolution calls, for example, for judgements to be made on the basis of grounds alone, without proof of guilt, which contradicts the fundamental principles of the presumption of innocence and non-discrimination.</b></span></span></span></p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><b>· The resolution also calls on member states to implement the ideological theory of gender and once again puts pressure on the European Commission to take steps to include 'gender-based violence' in the catalogue of the so-called European crimes.</b></span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">'This document, although it is an act that is in no way binding, has become the official position of the EP. Therefore, it can be assumed that the direction indicated by its wording will also be continued in other EU activities, including those that have a real impact on the shape of the law and political decisions. In this resolution, we find for example a very worrying call for the abolition of the principle of the presumption of innocence against men accused of violence, even before any evidence has been shown, and for the right of custody of their own children to be revoked. The entire resolution appears as a document aimed at introducing systemic discrimination against men through the instrumental use of the problem of violence. Instead, violence should be prevented, and the victims should be helped, irrespective of gender or any other features. Everyone has the right to a fair trial,' commented Anna Kubacka, an analyst at the Centre for International Law.</span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">The resolution condemns 'in the strongest terms' gender-based violence, domestic violence and violence against women (point 1 of the resolution). The content of the document shows that it is no coincidence that the EP omits the issue of violence against men. The authors of the resolution postulate the de facto exclusion of the principle of the presumption of innocence in a situation where the perpetrators of domestic violence are men. Point 32 of the document stresses that 'the EP urges that decisions on shared custody be postponed until the issue of partner violence has been properly investigated and a risk assessment has been carried out'. This opens the door to many abuses, and in fact the mere accusation of violence can lead to a man being deprived of custody by a court designed to 'avoid decisions against the mother' (cf. letter L of the resolution).</span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">In addition, in letter Q of the resolution, the EP points to the allegedly harmful practice of the court's ruling, even when they see no objection to it, on joint custody or parental responsibility, despite the fact that one parent (the woman) has been a victim of violence by the other parent (the man). However, the child's right of contact with the father (as well as the father's right of contact with the child) in a situation in which such contact does not constitute a threat to the child's welfare - which is assessed by the court in each case - is very important and cannot be automatically excluded solely on the basis of a hypothetical further threat of violence against the woman.</span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">The authors of the resolution also demand that victims of violence have access to 'sexual and reproductive health services'. The authors of the document used the English abbreviation SRHR for 'sexual and reproductive health and rights'. The addition of the word 'rights' to the international term 'sexual and reproductive health' (SRH) fundamentally changes the meaning of the wording used. Among the main demands hidden behind the term SRHR is the demand for abortion on demand.</span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">The resolution also calls on countries such as Bulgaria to ratify the Istanbul Gender Convention (letter Z and point 5 of the resolution), despite the fact that the Bulgarian Constitutional Court has explicitly ruled that the Convention is incompatible with the Bulgarian Constitution.  Parliament also condemns Poland for considering withdrawing from the Convention. At the same time, it ignores the substantive arguments raised by many countries in connection with the ideological content of the act, its outdated solutions and, above all, the lack of proper identification of the sources of violence, which is the reason for the ineffectiveness of the solutions it contains. It is important to note that, according to research carried out by the Fundamental Rights Agency and the OECD, the rate of violence against women in Poland is one of the lowest in Europe, which is a result of the much broader and more effective anti-violence solutions applied in our country than those proposed in the Istanbul Convention.</span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">The resolution also calls on Member States to implement ideological gender theory and once again puts pressure on the European Commission to take steps towards including 'gender-based violence' in the catalogue of the so-called European crimes (Article 83(1) of the TfEU). The Ordo Iuris Institute stated the dangers of such an amendment. This time, however, the EP not only demands that undefined 'gender-based violence' be recognised as a European crime, but also points out that the Istanbul Convention is to be a determinant of 'minimum standards' for the directive in this matter. This means that the EU wants to impose the application of its solutions on countries that opposed the ideological content of the Convention.</span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">This document is yet another example of the European Union's disregard for the provisions of the Treaty, in which the Member States have clearly defined which competences they reserve exclusively for themselves. Both family law, including the issue of childcare, substantive criminal law and health policy are a prerogative of the Member States. The European Parliament, by expressing its position in these areas, and even by formulating demands for the implementation of specific solutions related to them, is consciously exceeding its competences, and in the case of Bulgaria is even calling for a breach of the Basic Law.</span></span></span></p> <!-- END OUTPUT from style="font-family:Calibri,sans-serif"><span lang="EN-GB" style="font-family:&quot;Times New Roman&quot;,serif" xml:lang="EN-GB">• </span><b>In its resolution, the PE is to put pressure on the European Commission (EC) to launch a procedure for amending Article 83(1) of the TFEU through addition of ‘gender-based violence’ to the list of European crimes.</b></span></span></p> <p style="margin-left:36.0pt; text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><span lang="EN-GB" style="font-family:&quot;Times New Roman&quot;,serif" xml:lang="EN-GB">• </span><b>The amendment will allow the European Commission to set forth minimum standards for prosecution and criminalisation of new types of crimes by way of a directive.</b></span></span></p> <p style="margin-left:36.0pt; text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><span lang="EN-GB" style="font-family:&quot;Times New Roman&quot;,serif" xml:lang="EN-GB">• </span><b>Article 83(1) of the TFEU has been recently seen as the back door to the introduction of such solutions to the legal systems of the Member States to which those Member States object.</b></span></span></p> <p style="margin-left:36.0pt; text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><span lang="EN-GB" style="font-family:&quot;Times New Roman&quot;,serif" xml:lang="EN-GB">• </span><b>Ordo Iuris has stated on numerous occasions that the ‘gender’ perspective is ineffective in combating violence because it fails to properly identify the sources of crime.</b></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><b>Consequences of the amendment</b></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">At the beginning of May, the FEMM Committee published a draft resolution designed to put pressure on the European Commission to exercise its rights and put forward an initiative to amend Article 83(1) of the Treaty on the Functioning of the EU. Yesterday the draft was adopted by the Committee in a vote which means that it will soon be voted on by the whole EP.</span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">It must be noted that every amendment of any EU treaty changes law of the highest-rank because treaties are the primary legislation of the EU. Article 83(1) of the TFEU includes a list of European crimes, i.e. areas of crime which are prosecuted in all EU Member States and for which the EC has a right to define minimum standards by way of a directive, for instance the minimum sentence. After its transposition to national law, the directive must be applied by every Member State.</span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">The article currently lists such crimes as terrorism, trafficking in human beings, illicit drug trafficking, illicit arms trafficking, corruption, counterfeiting of means of payment. For those areas of crime, there is no doubt as to the need for their criminalisation or combating, and the legal definition clearly sets the criteria determining what is and what is not a crime. Unfortunately, Article 83(1) of the TFEU has been recently seen as the back door to criminalising such behaviour, conduct and opinions in the legal systems of the Member States which those countries do not want criminalised. </span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><b>Terms without precise definitions</b></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">In April we mentioned that the EC was commencing works on adding ’hate crimes’ and ‘hate speech’ to the said Article 83(1) of the TFEU (<a href="https://ordoiuris.pl/wolnosc-sumienia/wolnosc-slowa-zagrozona-komisja-europejska-chce-zakazu-tzw-mowy-nienawisci"><span style="color:#0563c1">for more see HERE</span></a>). Without a binding and well structured definition, they leave too much room for interpretation and as such they may censor and limit or even eliminate public debate and thus infringe on the freedom of expression and freedom of speech.  </span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">In the resolution proposed by the FEMM, the EP is to “call” the EC to add ‘gender-based violence’ to the list of European crimes and, after the Treaty is supplemented, issue a directive setting the minimum standards for such crimes, e.g. the minimum sentence. Just as hate speech, this issue also entails the definition problem as ‘gender-based violence’ is a vague term which encourages extremely free and broad interpretation of its meaning. Besides, the authors of the draft resolution themselves state that the directive addressing this category of crime is to address “sexual and reproductive health and rights” (SRHR), so one vague term (’gender-based violence’) contains yet another vague term, which is not defined in any binding international legal act and is additionally highly controversial (‘sexual and reproductive health and rights’). </span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">It is not without significance that SRHR is customarily understood to encompass postulates for access to abortion on demand or obscene sexual education. So it can be expected that the attempt to introduce the crime of ‘gender-based violence’ to the legal systems of countries such as Poland is in fact a way to force Poland to criminalise refusals to abort a child or prevention of sexual education in its most obscene variant, i.e. according to WHO’s standards. This is yet another attempt to interfere in the health policy of the Member States, and obviously an illegitimate one because it exceeds the authority granted to the EU under the treaties. On top of that, depending on how the directive is worded, the pressure on the introduction of permissive sexual education may violate the rights of parents to bring up children in accordance with their own beliefs. </span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">The directive is also intended to implement the “standards of the Istanbul Convention,” to which a number of countries, including Poland, have raised and are still raising multiple objections. As shown by the numerous analyses and data collected over the years of pursuing the anti-violence policy based on the gender-based violence paradigm, the convention is an obsolete, ineffective or even counter-effective document because it fails to properly identify the sources of violence and as such is unable to eliminate them and prevent violence. The pressure to introduce the standards of the Istanbul Convention, despite the vast evidence demonstrating its ineffectiveness and the aversion of the Member States to its provisions, once against shows that the true purpose of that document is to introduce the gender ideology to the legal systems of the Member States. Introducing the crime of ‘gender-based violence’ to the Polish legal system will result in permanent presence of the legal category of ‘gender,’ which by definition undermines the foundation of our native family law based on the existence of two sexes. Putting the term ‘gender’ in use may result in legal uncertainty regarding the wording of the basic official template forms as well as Article 18 of the Polish Constitution, which states that marriage is a relationship of a woman and a man.</span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"><b>Actual purpose of the changes</b></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">The actual purpose of the attempt to amend the Treaty is also exposed by the argumentation included in the draft resolution. We can read the following in the draft expected to be signed by the EP in September:</span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">“violence against women and other forms of gender-based violence are the result of the unequal distribution of power, patriarchal structures, and gender stereotypes, that have led to domination over and discrimination against women by men; (...) this situation is aggravated by social and economic inequalities” (source: <a href="https://oeil.secure.europarl.europa.eu/oeil/popups/ficheprocedure.do?reference=2021/2035(INL)&amp;l=en"><span style="color:#0563c1">HERE</span></a>).</span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">The resolution is to be voted on in the EP on 13 September. If the EC submits to the political pressure of the EP, we may expect a roadmap of the proposed TFEU amendments and, afterwards, a draft directive. Ordo Iuris will take part in all public consultations and a memorandum will be sent to the Members of the European Parliament laying down the argumentation in support of rejecting the resolution. </span></span></p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif"> </span></span></p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">Recently, we have been increasingly facing the EU’s attempts to interfere in the health policy and the family law of the Member States, even though the Union is well aware that it does not have the authority to meddle with those areas. The interference attempts based on directives, case law (the famous Romanian Coman case) and proposal of a regulation intended to force us to formally recognise parenthood of same-sex people were all followed by two more attempts to circumvent the authority limitations and the will of the Member States through change of the primary law. Fortunately, changing the treaties requires unanimity and we expect that for both hate speech and gender-based violence not only Poland will vote against the amendment.</span></span></p> <p style="line-height:115%"><strong>Last month the United Nations Committee against Torture held a periodic review of implementation of the Convention against Torture by Poland.  In the beginning of August, the Committee, which is responsible for the monitoring of implementation of the Convention issued their Concluding Observations indicating areas of the implementation of the convention which in their opinion required improvement and formulating recommendations of future actions for Poland.</strong><br /><br /> The Concluding Observations did not fail to reference access to killing of the unborn through abortion and questions of domestic violence.  These two topics are being raised by various Committees of the United Nations Organization independently of the scope of their mandates. In the opinion of the committee members’ violence against women and absence of effective access to the killing of an unborn baby through abortion, must be such an immense suffering and a cause of such psychological and physical pain that it requires analysis in light of the convention against torture and other inhuman, cruel and degrading treatment.  The same committee however, did not manage to develop the same perception regarding the killing of unborn babies, who at the age of 8 weeks react to touch and at 20 weeks have a developed nervous system.  This means that during the abortion which is killing them they are subjected to uncommonly cruel and painful treatment, connected on many occasions with dismembering their bodies and sucking them out of their mothers womb.<br /><br /> In the case of killing of unborn babies during abortion the committee members had 3 concerns: (1) absence of an effective procedure of access to the killing of an unborn baby through abortion if the doctor has a conscientious objection, (2) excessive length of the period (up to 30 days) that the Commission of Medical Doctors may take to issue an opinion after a protest against an opinion or medical diagnosis is filed based on Article 31 of the Law of 6 November 2008 on the Rights of the Patient and the Spokesperson for the Rights of Patients (Journal of Laws of 2019 position 1127), (3) difficulties in access to information on how to kill an unborn baby through an abortion.<br /><br /> However, the comparison of the reservations of the committee members with available information leads to different conclusions.  In accordance with the information delivered to the committee by the representative of the Health Ministry if a doctor expresses a conscientious objection there is currently a de facto solution in place, which puts an obligation on the health care provider to inform the mother where she should go to kill her baby through abortion.  Additionally, the mother can obtain such information through a nationwide telephone support line named Patient Phone Information, operated by the office of the Spokesperson for the Rights of Patients.  The above mentioned practice was not reflected in the recommendations of the Committee members.  Neither was the noteworthy fact that this practice is unconstitutional and it contradicts the verdict of the Constitutional Tribunal of October 7, 2015 [signature act K 12/14).  As already mentioned in previous analyses, the Tribunal stated in its justification of the verdict that the duty to identify a person or a place where objectionable practice is being offered should not rest on the healthcare provider who expressed conscientious objection but on the institutions of public authority, especially the National Healthcare Fund.  Moreover, the discharge of such an obligation by health care providers could lead to a violation of the freedom of conscience of their doctors, to a violation of medical secrecy and violation of personal data protection rules by gathering and storing by one healthcare provider of sensitive information about doctors employed by a different one.  The reference to the excessive length of time (up to 30 days) which Commission of Medical Doctors may take to review a protest against an opinion or a diagnosis refusing statutory grounds for the killing of an unborn baby was mentioned mainly in the context of the last statutory justification, i.e. the conception of a child as a result of a forbidden act.  According to the Committee members the maximum of 30 days to issue the statement by the Commission of Medical Doctors is making it difficult or even impossible to perform the killing of an unborn baby through abortion, as the period in which this can be done is limited by the age of the unborn baby and can be only done during the first 12 weeks of the life in prenatal stage.  As a side note the committee members have expressed an erroneous opinion that the limitation during the first 12 weeks of the baby’s life is valid for all three of the statutorily grounds for admissibility of abortion.  According to the Committee members a reasonable deadline to issue such a statement should be up to 10 days. However, when reviewing the reports of the Council of Ministers on the implementation of the so called Act on the Planning of the Family and its results in the period from 2014 to 2017 (which is a period subject to monitoring by the Committee) it should be noted that the Spokesperson for the Rights of the Patient received only 2 protests regarding the killing of an unborn baby through abortion in 2014.  The first was reviewed within 13, the second within 14 days.  In 2015 one protest was filed and it was reviewed in 23 days.  It’s worth mentioning here that the protest was filed on 23 December 2015 and the commission made a decision on 15 January 2016.  In 2016 and 2017 no protests were filed.  Addressing the last comment of the committee it is worthwhile to mention that there is a Patient Telephone Information, which is also providing information concerning access to killing of unborn babies through abortion.<br /><br /> Regarding violence against women, the Committee members were concerned that domestic violence is not regulated by the statues as a single forbidden act, including criminalization of marital rape and were pointing out the relatively small number of convictions for domestic violence.  Although the members of the committee in their Concluding Observations did not justify the need to introduce one category of unlawful act including all domestic violence, it may be inferred from their arguments for the adoption of a single unlawful act of torture, that the concern here is to minimize the possibility of a situation when some such deeds are going to elude penalization.  The Committee members’ concerns may be considered as purely theoretical.  The Criminal Code provides for at least 18 unlawful acts encompassing domestic violence in their scope (including physical, psychological, sexual and economic violence).  To address this theoretical concern one can argue that it is specifically the detailed nature of regulation on domestic violence enabled by a greater number of unlawful acts than just one, which allows for a more exhaustive regulation of the undesirable phenomenon of violence.  The remark of the Committee members on the number of criminals convicted for resorting to domestic violence needs to be recognized as very superficial.  According to the data of the Ministry of Family, Labor and Social Policy contained in the Report on the Execution of Nationwide Program to Counteract Violence in the Family the majority of people accused of domestic violence in the period of 2014 to 2017 were convicted.  In 2014, 14,309 of the 17,030 accused were convicted.  In 2015, it was 13,755 of the 16,677, in 2016, 12,486 of 15,071 while in  2017, 12,630 of the 15,287 accused were convicted.  Moreover, as suggested by the research of the European Union Agency for Fundamental Rights conducted in 2014, Poland at the backdrop of the entire European Union has one of the lowest ratios of domestic violence suffered by women from their current or former partner and it reaches 19% percent (with the European Union average at the level of 33%).  It is worth additional underscoring that Poland is characterized by the highest ratio of reporting of domestic violence to the police in the entire European Union.  Poland also has a small number of cases of sexual molestation of women over 15 years of age and of such cases during the 12 months preceding the interview (half the European Union average and the third lowest result together with Slovenia).  Poland also compares very favorably in the statistics concerning violence against girls under the age of 15.  It could be stated that compared to other European union countries physical beating of a girl in Poland is very rare.  Only 14% of the research women admitted that they experienced physical violence during childhood.  Data regarding psychological violence indicate that the vast majority of Polish families do not witness this kind of acts.  Only 5% of researched women have encountered such behaviors among their family members.  Similarly only 37% of adult Polish women have declared that they experienced psychological violence from the side of their former or current partner.  The research conducted proves that Polish women feel safe.  Only 3% stated that they frequently felt fear of becoming a victim of physical or sexual violence and as many as 86% have never felt this way.  Most of them (over 60%) do not avoid certain places and situations because of fear of becoming a victim of such actions.<br /><br /> Due to the above Observations the members of the Committee adopted recommendations for Poland, one of which deserves special attention.  It is the recommendation for Poland to refrain from withdrawing from the Convention on Prevention and Counteraction of Violence against Women and Domestic Violence (the so-called Istanbul convention) and to consider decriminalizing abortion.   The first recommendation in practice leads to the weakening of counteraction of domestic violence.  The Ordo Iuris Institute have stated on multiple occasions that the Istanbul convention in its most fundamental assumptions undermines the institution of the family, shows it as a source of violence and undermines the rights of the parents to raise their children according to their beliefs and religion.  This way the convention is weakening the family which according to the research of the Department of Justice and the Health Department of the United States of America and the Organization for Safety and Cooperation in Europe (OSCE) assures the best support to all members and protection from all kinds of violence including domestic.  Implementing the second recommendation would lead in turn to a situation of violation of the international and domestic law, where certain groups of people would be discriminated against based on their age, stage in life and state of health in the area of one of the most fundamental human rights, which is the right to life.  Moreover their right to life would depend on the frivolous decision of another human being, who could dispose of their life at will, treating it as a common object of property.  Abolishing legal protection of the right to life of unborn children as a consequence would result in an ever widening discrimination and limitation of this right for other persons, already born, whose health condition would be equally fragile.<br /><br /> Finally, it is worth turning our attention to two important questions which can assist in appropriate analysis of the Concluding Observations discussed.  Firstly it needs to be remembered that the final comments are not legally binding to the states.  They are only a reflection of how a given group of experts which is currently included in the membership of the Committee interprets the effective realization of the convention provisions.  Secondly the Committee‘s recommendation on  domestic violence and access to killing of unborn babies through abortion are exceeding the Committee’s mandate.  The scope of their activity is determined by the provisions of the convention both in their material and procedural nature.  The convention against torture is clearly defining what constitutes torture.  Article 1 of the convention lists a few conditions which must be met jointly in order to constitute an act of torture.  First of all such action has to be based on causing severe pain and suffering and must be directed to obtaining information or confession, exerting punishment, intimidation or exerting pressure or any other goal which would result from any kind of discrimination.  Moreover such actions must be executed by functionaries of the state or other persons in the official capacity or from such persons order or in accordance with their explicit or implicit agreement.  The situation is similar regarding other acts of cruel, inhuman or degrading treatment determined in article 16 of the convention.  Such a clear determination what constitutes torture does not leave any doubts that domestic violence or lack of possibility to kill an unborn baby through abortion does not meet the above mentioned criteria to be considered an act of torture or other acts of cruel and human or degrading treatment.  The strength of the pain caused or the suffering and the pain felt cannot alone constitute an act of torture as understood according to the convention.</span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 0.0001pt"> </p>
