The essence of this principle is that an individual, referred to in the literature as a subject of the law, cannot justify his or her actions or omissions by invoking ignorance of legal norms. Without entering here into the question of the actual validity or application of this principle in France, where the head of state is currently declaring the introduction of a 'right' to abortion, it may be stated that the maxim quoted undoubtedly also expresses a certain more universal truth about life, as the authors of the 1789 Declaration of the Rights of Man and of the Citizen already noted. The question then remains: does ignorance - or in other words: contempt for the law - harm all or some?</strong></p> <p class="text-align-justify"><strong>The contrived 'right to abortion' and human rights</strong></p> <p class="text-align-justify">By way of introduction, it should be made clear that the term 'right to abortion' is an artificial creation and has no basis in any binding instrument of international or Polish law and - in my opinion - in the French Declaration of Human and Citizen's Rights of 1789, to which the current French Constitution refers. On the contrary, the human rights system adopted by the international community upholds human life, stipulating in many agreements, treaties, conventions, etc. binding on the signatory states that human life is subject to legal protection. Article 2(1) of the European Convention on Human Rights can be cited as a striking example: "everyone's right to life shall be protected by law. No one shall be deprived of his or her life intentionally save in the execution of a sentence of a court following his or her conviction of a crime for which this penalty is provided by law. It should be noted that this international agreement mentions the protection of everyone's right to life by law. In Poland, therefore, we have, first of all, the so-called Basic Law, i.e. the Constitution, which in Chapter II, entitled 'Freedoms, rights and duties of a human being and citizen', indicates the right of everyone to life and provides for the legal protection of life guaranteed to everyone (Article 38). The protection of the value of the most important for the individual - life - furthermore stems from a number of other Polish laws, with the Criminal Code at the forefront.</p> <p><strong>French constitution with a 'place' for abortion?</strong></p> <p class="text-align-justify">Against the background of the Constitution of the Republic of Poland, the constitution of the French Republic is interesting. The fundamental law of France, in force since 4 October 1958, is essentially exclusively of a systemic nature and does not contain a chapter, analogous to the Polish Constitution, regulating the issues of human and civil rights and freedoms. Instead, such provisions are indicated in the preamble of the Constitution, not directly, but by reference to the 1789 Declaration of the Rights of Man and of the Citizen. The first sentence of the preamble to the French Constitution reads: "The French people solemnly proclaim their commitment to the rights of man and the principles of national sovereignty set out in the Declaration of 1789 (...)"[1].</p> <p class="text-align-justify">Leaving an assessment of the act itself and the events surrounding its adoption completely aside, it is worth looking at the provisions it contains. Already in the preamble one finds an interesting passage, stating:"The representatives of the French people, formed into the National Assembly, recognising ignorance, forgetfulness or contempt of human rights as the only causes of public misery and governmental corruption, have resolved to set forth in a solemn Declaration the natural, inalienable and sacred rights of man, so that this Declaration, constantly presented to all members of the body politic, will constantly remind them of their rights and duties (...)"[2].Two provisions of the Declaration seem to be the most relevant in terms of the subject under discussion: article 1, which recognises that "human beings are born and remain free and equal in rights.Social distinctions can only be based on considerations of the common good', and Article 4 stating that 'freedom consists in being able to do anything that does not harm others.Therefore, the exercise of the natural rights of each individual has no other limits than those which ensure the exercise of the same rights by other members of society. These limits can only be defined by law". </p> <p class="text-align-justify">In other words, in my view, it logically follows from the quoted Article 1 of the Declaration that, since "human beings are born free", human beings are equally individuals at the stage prior to the birth process (it follows from this sentence that it is human beings who are born and not "clusters of cells" who become human beings through the fact of birth).Further, Article 4 of the Declaration clearly defines the limits of the exercise of the individual's freedom - this is the condition of not harming others (in the original language: "la liberté consiste à pouvoir faire tout ce qui ne nuit pas à autrui"). Significantly, it seems that the word 'autrui', i.e. 'others', used in this provision, should not enter into the discussion of artificially created dilemmas as to whether the word 'everyone' used in the context of the right to the protection of life, e.g. in the Polish Constitution, includes the unborn human being or not. </p> <p class="text-align-justify">This argument is all the more justified because the second sentence of the said Article 4 of the Declaration refers to the enjoyment of the natural rights of every human being, and, as we know, natural rights are possessed by every being with human DNA solely by virtue of the fact that it belongs to the human race.Thus, the French Declaration draws attention to the existence of natural rights, which are now so often called into question.</p> <p class="text-align-justify"><strong>"Right to abortion" in the French constitution?</strong></p> <p class="text-align-justify">This was an idea floated a few days ago by President Emanuel Macron, who had already become famous for wanting to introduce a provision guaranteeing such a right into the EU's Charter of Fundamental Rights (CFR), which is at the top of the hierarchy of EU legislation. It would appear that by calling for this change to the EU CFR, the French President has either fully ignored the obviously contradictory provisions on human dignity and the right to life, or was thinking of interfering extensively with this piece of legislation, which, however, would certainly have met with resounding opposition from some Member States. In any case, he has clearly not abandoned the subject and now intends to implement the idea of eliminating some Europeans even before birth on his own territory.</p> <p class="text-align-justify">The idea of enshrining a 'right to abortion' in the French constitution seems all the more surprising given that, as already mentioned, the constitution does not, as a rule, address the issue of human rights, but regulates questions of state organisation. Arguably, 'adding' such a legal construction to the Declaration of Human and Citizen's Rights is out of the question for various reasons, but perhaps there is also some argument that the provision for an essentially non-existent 'right to abortion' simply conflicts with the provisions of the Declaration referred to by the French people in the preamble to the Constitution.</p> <p><strong>Let us hope that Poland does not follow the French example.</strong></p> <p>Our Constitution clearly stipulates in Article 38 that the state shall ensure the legal protection of life for everyone. In practice, this means, as pointed out by the Constitutional Court in its judgment in K 1/20, that "it is incumbent on the organs of the state to legislate in such a way that it protects life, and the life of every human being regardless of the situation in which they find themselves". Article 38 of the Constitution thus contains an obligation for the authorities. However, the axiology of the Polish Constitution, the rich jurisprudence of the Constitutional Tribunal on the protection of life, the relevant statutory provisions do not prevent some parliamentary representatives, journalists, activists, etc. from proclaiming slogans about the introduction of abortion legislation in a completely free way, e.g. bypassing the legislative process.</p> <p><strong>Ignorantia iuris nocet - or is it?</strong></p> <p class="text-align-justify">The profound ignorance of the law that is sometimes observed not only in our country or in France, but is understood broadly - as a conscious and deliberate mockery of certain principles, sometimes developed over many years and at the cost of many sacrifices - is bound to cause harm. The question is - to whom?Staying on the subject of unborn people, who are gradually being deprived of the legal protection of life in country after country, the answer is that it harms them.But not only.As the framers of the French Declaration of 1789 noted, 'ignorance, forgetfulness or contempt of human rights are the only causes of public misery'. Contempt for natural rights and the state laws that protect them may not result in consequences coinciding with the literal meaning of the Roman paremia, but it will affect entire societies.      </p> <p class="text-align-justify">R.pr. The declaration is intended to commit countries to the full implementation of Agenda 2030 and the Sustainable Development Goals (SDGs). The summit was a response to the impact of the numerous and interrelated crises the world is facing. The underpinnings of Agenda 2030 are the Rio Conference, held in 2012, and the 2019 Global Sustainability Report, titled "The future is Now: Science for Achieving Sustainable Development."</p> <p class="text-align-justify">The summit was divided into six sections. World leaders adopted a "Political Declaration," pledging to achieve, over the next seven years, the 17 Sustainable Development Goals and 169 related sub-goals that form the essential core of the 2030 Agenda. They take into account the economic, social and environmental dimensions of sustainable development.</p> <p class="text-align-justify">The motive for action is to be a shared commitment to eradicating poverty, hunger and inequality, both within and between countries, and building peaceful societies. Sustainable development is to focus on overcoming the weaknesses and problems of the current world.</p> <p class="text-align-justify">The main issues discussed at the summit were energy transition, renewable energy, access to education, new technologies, facilitating the digitization of the global economy, digitizing the world, implementing urbanization regulations, and adopting a new financial architecture.</p> <p class="text-align-justify">One of the top priorities of the Declaration issued at the end of the summit is, expressed in paragraph 15, the demand for consistent implementation of human rights and "gender equality," as well as the promotion of so-called sexual and reproductive rights, which the UN believes should be given greater consideration in the implementation of the various goals of the Agenda. </p> <p class="text-align-justify">The summit summary document also reaffirmed the Addis Ababa Action Agenda, which is an integral part of Agenda 2030, dedicated to financing and sustainable development issues, focusing forces and actions on climate change. The declaration is written in the spirit of resolutions and commitments, and is intended as a kind of transition from discussion to action - so that the goals the UN sets for itself will be realized in accordance with Agenda 2030.</p> <p class="text-align-justify">A number of heads of state and world leaders spoke over the two days. One of them was Hungarian President Katalin Novák, who stressed the essence of peace, the role of the UN and pointed out the steps that the countries that came to the summit must take. She also noted what a great problem the demographic decline is becoming for the world, and the importance of the family, its rights and freedom. She defined clearly what is the most important task of countries when it comes to parents.</p> <p class="text-align-justify">"We protect the freedom of parents. We firmly believe that the right to raise children belongs not to the state, NGOs, the media or the knowledge industry, but to the parents." - Katalin Novák stressed.</p> <p class="text-align-justify">The Hungarian president also pointed out the right focus for the world to grapple with.</p> <p class="text-align-justify">"Elon Musk may be right when he says that the demographic decline is a more serious problem than the climate crisis. Little attention is paid to the real and irreversible change in the world. If there are no children, there will be no future. What is the point of taking care of the Earth if we don't have children and grandchildren to pass it on to? (...). In Europe and in many of your countries, the demographic winter has turned into an ice age," the politician noted.</p> <p class="text-align-justify">- The President's speech was an interesting voice at the 78th UN session. The clear and decisive approach to the most important issues presented by her delineates a new outlook on real problems. The speech delivered at the summit is consistent with what the Hungarian president pointed out at the 77th UN session," pointed out Dr. Przemysław Kulawinski of the Ordo Iuris Center for International Law.</p> <p class="text-align-justify"> "It is not at all obvious that today, in times of war, energy and food crises, organizations set up to avoid war and preserve peace focus on ideological indoctrination. This is not what is needed today. Instead, we need to regain the ability to distinguish between the essential and the irrelevant, the important and the unimportant, reality and fiction." - said the Hungarian president last year.</p> <p class="text-align-justify">The challenges currently facing the country's leaders are significant, and time is short. The UN General Assembly adopted a resolution on international cooperation on access to justice, remedies and support for victims of sexual violence. The document, under the guise of addressing violence against women and girls, calls on states to "promote and protect reproductive rights," including providing access to "safe and effective methods of modern contraception," "emergency contraception" (which are essentially early abortifacients) and "safe abortion." Thus, the resolution pushes an arbitrary interpretation of international law that recognizes abortion as a human right. While no international treaty grants anyone the "right to abortion" or the "right to contraception," in practice, for many years some international bodies have argued that these rights derive from the right to privacy and even the right to life.</p> <p class="text-align-justify">The Ordo Iuris Institute has already sent four letters to Polish President Andrzej Duda urging him to oppose this interpretation of human rights at the UN. In both letters, the Institute warned that while UN General Assembly resolutions have no formal binding force, in practice they can become a tool for the development of customary law, which is already binding on states. In turn, international custom could force Poland to recognize a "right to abortion" or a "right to early abortion remedies," even though it has not signed any treaty establishing such rights. The only way to avoid such a scenario is for Poland - represented internationally by its president, among others - to express unequivocal opposition to such interpretations of human rights treaties. </p> <p class="text-align-justify">The Polish president, however, has not taken the steps called for by the Ordo Iuris Institute. On behalf of the head of state, a renewed response was given by Malgorzata Paprocka, secretary of state in the Office of the President. In a letter dated January 23, she pointed out that "cases of selective interpretation of international documents, carried out in violation of the principles of interpretation contained in the Vienna Convention ... do not invalidate the binding force and meaning of these principles." In addition, Minister Paprocka stressed that the principles of interpretation expressed in the Vienna Convention "prevent individual words from being taken out of context and thus creating human rights that are not supported by international agreements."</p> <p class="text-align-justify">In response to the letter, the Ordo Iuris Institute sent another letter, explaining that the inaction of the President of Poland and other state bodies responsible for foreign policy will, over the course of several years, result in the formation of a common law norm that will deprive unborn children of their right to life, forcing countries such as Poland to legalize abortion on demand, regardless of constitutional regulations. The Institute also pointed out that the interpretation of regulations by international organizations in violation of the rules of interpretation of the Vienna Convention on the Law of Treaties does not actually lead formally to its repeal and deprivation. However, this does not change the fact that, in practice, the Convention is losing relevance, and the so-called dynamic method of treaty interpretation is gaining, for which, in order to determine the content of a provision, the most important thing is not the text, but the social context, as determined by the members of international organizations. Although, applying the principles of interpretation expressed in the Vienna Convention, it is impossible to derive a right to abortion from human rights treaties, it did not prevent the UN General Assembly, the UN Human Rights Committee, the Committee on Economic, Social and Cultural Rights, the CEDAW Committee and many other international bodies from deriving such a "human right" from these treaties.</p> <p class="text-align-justify">- We consider as overly optimistic the Chancellery's position that the principles of interpretation expressed in the Vienna Convention "prevent individual words from being taken out of context and thus creating human rights that are not supported by international agreements." The practice of international bodies testifies to the contrary. However, the law firm downplays its significance, basing its position on outdated rulings of the European Court of Human Rights and one ruling of the International Court of Justice on racial discrimination, an issue unrelated to the dangers of international human rights bodies seeking to impose a "right to abortion" on states. In response, the Institute noted that despite the resolution's formally non-binding nature, its adoption could contribute to the creation of a "customary right to abortion," which Poland will be forced to recognize if it does not object to the concept in time. On behalf of the head of state, Małgorzata Paprocka, secretary of state in the President's Chancellery, responded, pointing out in a letter dated November 21 that the resolution is non-binding, and furthermore explicitly stipulates that the right of access to abortion mentioned therein "applies only when it is permissible under national law." In addition to this, Minister Paprocka stressed that even if a customary right to abortion were to be carved out, the Polish authorities could "terminate" it by analogy with the termination of a treaty.</p> <p class="text-align-justify">In response to the letter from the president's representative, the Ordo Iuris Institute sent another letter, explaining that the resolution, despite its non-binding nature, could play a fundamental role in recognizing abortion as a human right. This is because the act comes from the highest UN body, the General Assembly, which represents the international community of the entire world. For this reason alone, the importance of this resolution should not be underestimated. In the letter, the Ordo Iuris Institute also explained that the resolution's caveat about limiting access to abortion to cases permitted by national law could be disregarded by international bodies in the future.</p> <p class="text-align-justify">"More and more international bodies are pushing for the recognition of the possibility of killing an unborn child as a human right - the UN Human Rights Committee, the UN Committee on Economic, Social and Cultural Rights, the UN Committee on the Elimination of Discrimination against Women, the Parliamentary Assembly of the Council of Europe, and now the UN General Assembly. We believe that there is a real risk of forming a customary interpretation of human rights treaties that "injects" access to abortion into Poland's recognized fundamental rights such as the right to respect for private life, the prohibition of torture, the right to health or even the right to life. An international custom is born when a majority of states accept it, if only tacitly, without expressing opposition.  Such custom has full binding force, equal to treaties. By this sublime means, Poland may be forced in the future to legalize abortion on demand, if only against the will of the majority of the population, in accordance with the principle of "human rights are not argued with." According to the well-established position of the doctrine of international law, the only effective way to avoid binding Poland to the "customary right to abortion" is for the Polish authorities - preferably by the President of the Republic - to unequivocally oppose such an interpretation of human rights.  We hope that our legal argumentation will convince the President to take concrete steps," interpretation of the Convention made by the International Court of Justice.</strong></p> <p class="text-align-justify"><br /> Four days after the Russian aggression on February 24, 2022, Ukraine submitted a request to the International Court of Justice (ICJ) regarding the interpretation, application and fulfillment of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide. In the application initiating the proceedings, Ukraine first demanded that the ICJ rule and state that no acts of genocide within the meaning of Art. 2 of the Convention. Accordingly, the Russian Federation may not lawfully take any action under the Convention, in or against Ukraine, to prevent or punish an alleged genocide. Ukraine also demands a ruling and a statement that the so-called The "special military operation" conducted by Russia since February 24, 2022 is based on a false claim of genocide.</p> <p class="text-align-justify">Pursuant to Art. 63 of the ICJ Statute, in all cases where the interpretation of the Convention is questioned, each of the signatory states has the right to intervene in the proceedings. Considering Ordo Iuris' involvement in collecting materials on Russian war crimes since the beginning of the war in Ukraine (which led to the creation of an archive documenting war crimes committed against the Ukrainian population by the Russian army), the Institute asked the state authorities to consider the possibility of joining the ongoing proceedings . In this way, Poland would have an influence on the final interpretation of its statements to be made by the International Court of Justice.</p> <p class="text-align-justify">- The filing of the application by Poland, together with the applications already submitted by Latvia, Lithuania, New Zealand and the United Kingdom, will lead to a binding interpretation of the Genocide Convention on all parties, with particular emphasis on the aspects of genocide claims in Ukraine. In particular, it is worth noting that the signatories of the Convention have a common interest in ensuring the correct interpretation of the provisions of the Convention, which, after all, contains freedom of conscience and religion.</b></p> <p class="text-align-justify"><b>· The Ordo Iuris Institute intervened in the case as a friend of the court, stressing that countries in whose history Christianity played an important role have the right to cherish their traditions.</b></p> <p class="text-align-justify"><b>· The European Court of Human Rights agreed with the Institute, pointing out that states have a wide margin of discretion in the area of relations between government and religion.</b></p> <p class="text-align-justify">In 2018, five Irish citizens – four politicians from left-wing parties and one activist from an atheist social organisation – complained to the European Court of Human Rights about the obligation to take an oath with an invocation to God for certain offices in the state. According to the complainants, Articles 12 and 31 of the Irish Constitution, providing that candidates for the office of President or member of the Council of State must take an oath ‘in the presence of Almighty God’ before taking up the office, violate their right to religious freedom.</p> <p class="text-align-justify">The Ordo Iuris Institute intervened in the case as a friend of the court. In the submitted opinion, the Institute provided an overview of legal regulations from around the world on oaths taken before taking up an office, pointing out that there are still mandatory references to God in many of them, e.g. Norway, Liechtenstein, Georgia or San Marino. The Institute explained that the obligation to swear an oath to God does not infringe religious freedom, but serves to accentuate the core values that influenced the founding and formation of a given country. European countries have the right to nurture their traditions, and they should be allowed a wide margin of freedom in this respect.</p> <p class="text-align-justify">The European Court of Human Rights declared the complaint inadmissible, pointing out that the complainants could not be considered ‘victims' of a violation of Article 9 of the Convention in a situation where neither of them was a candidate for either the presidency or the Council of State. The Tribunal added that Europe is diverse in terms of its cultural and historical development, and therefore a wide margin of discretion should be left to states in the area of the relationship between government and religion.</p> <p class="text-align-justify">- For many years, left-wing activists have been trying to force secularisation on states by filing complaints with the Strasbourg Tribunal. From their point of view, any presence of religious symbolism in the public space violates their freedom of conscience and religion. A few years ago, a Finnish woman living in Italy sought to eliminate crucifixes from school classrooms, claiming that the mere presence of a crucifix constituted an ‘indoctrination’ of her child. In 2011, the Grand Chamber of the Tribunal ruled that the presence of a cross in a school classroom does not violate anyone's rights, and that states have the right to cherish their religious traditions if Christianity is part of their heritage.
