According to the police notes, the information about the mother provided by the Norwegian service was not confirmed.</p> <p class="text-align-justify">The mother presented documents showing that she does not use drugs, as well as a number of certificates confirming that the child has a stable situation in Poland.The girl is under her mother's care, and is provided with medical care, kindergarten and extra-curricular activities.Based on the probation officer's interviews and evidence attached by the child's mother, the Warsaw District Court waived the initiation of proceedings to review the mother's family situation over her daughter.Nonetheless, in July 2023, law enforcement authorities in the Kingdom of Norway issued a European Arrest Warrant after the mother due to the alleged kidnapping of her daughter by the mother.This prompted Polish police to detain the mother and the father visiting the daughter on August 9, 2023 in Warsaw.  The girl was placed in an orphanage which was a traumatic experience for her, as she missed her mother a lot during her separation from her parents, especially, and refused to eat, cried and demanded contact with her mother.</p> <p class="text-align-justify">Norway has for years struggled with the abuse of Barnevernet, which immediately removes children from their parents on suspicion of neglect or mistreatment.The agency then transfers the children to a foster family and initiates an adoption procedure.The children's parents usually retain the right to maintain contact with the child, but to an extremely limited extent - under the supervision of a social worker, infrequently and briefly, e.g. one hour-long meeting a year, two 3-hour meetings a year, two 2-hour meetings a year.According to the ECHR, this practice is incompatible with Article 8 of the European Convention on Human Rights. The state should create conditions for the reunification of a child with his biological parents, and only as a last resort should the child be permanently transferred to a foster (adoptive) family. On the basis of the probation officer's interviews and evidence attached by the child's mother, the Warsaw District Court waived the initiation of proceedings to review the mother's family situation over her daughter.</p> <p class="text-align-justify">Since then, the situation of the child and mother was stable. The minor continued her education in kindergarten and developed properly under the care of her mother. Despite the child's normal situation, in July 2023, the law enforcement authorities of the Kingdom of Norway issued a European Arrest Warrant after the mother due to the alleged kidnapping of her daughter by the mother. This prompted Polish police to detain the mother and the father visiting the daughter on August 9, 2023 in Warsaw.</p> <p class="text-align-justify">The parents were detained and taken into custody to await questioning, while the child was taken to the Janusz Korczak Children's Home No. 2 in Warsaw. Norwegian services were informed of the parents' detention and that the child was in foster care. Although the minor was in the proper care of her mother in Poland, there was a risk that a Norwegian official would take custody of the minor and return with her to Norway without the parents.</p> <p class="text-align-justify">On August 10, the parents were questioned with the participation of their defense attorney Maciej Kryczka. After giving explanations, evidence and legal arguments, the District Prosecutor's Office decided to release the parents to freedom.</p> <p class="text-align-justify">Despite their stay at liberty, the parents were unable to take their daughter from the Children's Home due to the lack of a Polish court decision in this regard. The child missed her mother in particular. She refused to eat meals, cried and demanded contact with her mother.</p> <p class="text-align-justify">On August 11, 2023, at the request of the mother's attorney, the National Prosecutor's Office and the management of the orphanage where the daughter was staying, the District Court issued a decision to release the minor from the orphanage and hand her over to her mother.  Currently, the parents are staying with their daughter at large.</p> <p class="text-align-justify">"Thank you to all those involved in helping Norwegian citizens. Once again, the Kingdom of Norway is instrumentally using the criminal law to take custody of a child and isolate him from his family in a manner contrary to his welfare without any rational reason. Special thanks are due to prosecutors Filip Wolski, Malgorzata Slowinski of the National Prosecutor's Office, and the District and Regional Prosecutor's Office, who joined the request for the surrender of the daughter to her mother before the family court. Many thanks to the Children's Ombudsman Nikolai Pawlak for his intervention, and to the management of the Janusz Korczak Children's Home No. 2 in Warsaw for their cooperation while taking care of the child. The efficient cooperation of all entities in the case led to a happy conclusion of this stage of the proceedings and the safeguarding of the interests of the child and the parents." - commented the family's attorney, Maciej Kryczka, who cooperates with the Ordo Iuris Trial Intervention Center.</p> <p class="text-align-justify">The proceedings in the family's case have not ended. Norwegian Barnevernet officials then separated the siblings, placing them in various foster families and a foster care center. The parents' court battle over the children lasted 1.5 years, as twice hearings were postponed for consecutive long months for procedural reasons. Once the hearing was postponed due to the illness of the lawyer representing Barnevernet. Despite the seriousness of the situation, no substitute attorney was provided. Another hearing was canceled due to the illness of the judge. All this time, the children were in foster care, waiting for the parents to prove to the court that they had properly exercised their parental authority.</p> <p class="text-align-justify">The children were not returned to the family home until July 2022, when the Norwegian court's ruling became final. A month later, the family arrived in Poland The children did not receive the necessary medical and psychological assistance until after they returned to their home country. The one-and-a-half-year stay in various foster environments was a traumatic experience for the three minors. The girls were emaciated, the youngest with a severe intestinal and gastrointestinal disorder, all had symptoms of post-traumatic stress disorder as a result of constant scrutiny by Barnevernet, and the eldest had experienced violence in a juvenile detention center in Norway.</p> <p class="text-align-justify">- What this family experienced at the hands of Barnevernet in Norway is unimaginable and fit for a movie script. The children were in various foster environments for 1.5 years, where they also encountered incompetence on the part of their foster parents. The youngest girl in one family was constantly vomiting, and instead of giving her help, she was told to go everywhere with a bucket and clean up after herself. She was not given medical attention, although she was repeatedly dehydrated. The girl is currently recovering and requires specialized treatment. Ms. Catherine's older daughter was taken into the care of a woman who led a social lifestyle and had more alcohol than food in her refrigerator. It is indisputable that in this case the children were not provided with better conditions outside the family environment, and it should even be said that taking the children away from their parents was incompatible with their welfare," stresses attorney Magdalena Mickiewicz of the Ordo Iuris Trial Intervention Center.</p> <p class="text-align-justify">Despite the conclusion of the proceedings in Norway, Barnevernet officials sent a letter to the Polish authorities expressing concern about the children's situation. They also failed to inform state authorities of the final conclusion of the family's case in Norwegian courts.  Due to local jurisdiction, the Braniewo District Court opened an ex officio family case to issue guardianship orders against the parents of the three children. The family began to be visited by a probation officer, causing the children and mother to revive traumatic memories of Norway.</p> <p class="text-align-justify">Lawyers of Ordo Iuris have shown through evidence that the children's mother has taken all measures to stabilize the children's situation, and is more than concerned with the welfare of the minors. The children are fulfilling their compulsory education, have been diagnosed at the psychological-educational counseling center and are under the constant care of a psychologist.</p> <p class="text-align-justify">The case before the Braniewo District Court was successful. After submitting extensive evidence, the court had no doubts about the regularity of the children's care and the lack of grounds for issuing guardianship orders. </p> <p class="text-align-justify">- The Braniewo District Court, in oral reasons for the order, questioned whether placing children in such a large number of foster care environments was consistent with the welfare of children. It is worth recalling that in 2021. Institute represented a victimized child who had been taken from his parents in Norway, and upon his return revealed behavior indicative of sexual abuse suffered in foster care. Ordo Iuris lawyers continue to monitor cases pending before the European Court of Human Rights from complaints against Norway in connection with the activities of Barnevernet. As a rule, artificial insemination is carried out using the gametes of the ordering party (sperm and egg), but sometimes it happens that gametes of an anonymous donor are used.</p> <p class="text-align-justify">In a case recently decided by the ECtHR, the applicant and her cohabitant from Norway left for the United States, where they placed an order for a child with the so-called foster mother. The child was conceived by an in vitro procedure using an egg from an anonymous donor and the applicant's partner's sperm, and was born to a surrogate mother. Under the agreement, the mother waived parental rights to the principals and the applicant and her partner were entered as parents on the birth certificate issued by the Texas state authorities. In the meantime, the applicant and her partner broke up. In Norway, surrogate is illegal - so the authorities have not recognized the legal consequences of surrogate parental rights. The Norwegian woman could therefore obtain the status of the child's parent only through adoption, but the child obviously required the consent of the child's father. In the applicant's opinion, she should have the right to adopt the child, even if the father explicitly opposed her, which was to result from her right to respect for private life (Article 8 of the European Convention on Human Rights). The Tribunal did not agree with it and stated that there had been no violation of Art. 8 of the ECHR.</p> <p class="text-align-justify">- This judgment is, in principle, good news, because it confirms the competence of states to combat the practice of surrogacy, which is offensive to the dignity of women and children. If someone circumvents the national law prohibition of using women as a so-called a surrogate, ordering the conception of a child abroad, the country of origin has the right to refuse to recognize the legal consequences of such an agreement. However, the Tribunal in Strasbourg differentiates between a client who is not related to the child and a related client whose gametes were used in in vitro fertilization. Unfortunately, the Norwegian Barnevernet works on a vicious cycle: first, it takes the child, limiting meetings with the parent to a few short visits a year, and after a few years, regardless of the parent’s efforts, it irrevocably gives the child up for adoption, pointing to the lack of ties between them – which, after all, was caused by the activities of the office”, emphasised Weronika Przebierała, Director of the Centre of the International Law the Ordo Iuris Institute. </span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">In the spring of 2015, the Norwegian Child Welfare Services (Barnevernet) took away their 2.5-month-old daughter from her parents, as a result of a midwife's denunciation accusing them of neglecting the child. The decision was a surprise because in February, the same office, after conducting an inspection, assessed the care for the child as "adequate". In the justification of the decision, Barnevernet pointed to irregularities in the development of the girl's motor skills caused by "the lack of interaction and social impulses from the parents". The office transferred the child immediately to a foster family, granting the parents the right to two one-hour meetings a month under the supervision of an employee of the office. The parents made an appeal against the decision to the court, which dismissed it, but due to the judge's partiality, the decision was soon quashed by the second instance court, which ordered the case to be re-examined. In 2017, the court of first instance upheld Barnevernet's decision again, limiting the parents' right to contact with the child to three one-hour supervised meetings a year. The court indicated that the parents showed a "reduced level of parenting skills", as evidenced by "a problem with the interaction between them and the child" during the meetings held under the supervision of a social worker. According to the court, communication problems were at the root of disturbances in the development of the child’s motor skills. The court noted that the child's mother was deaf and communicated with the child using sign language but found that this was not related to her difficulty interacting with her daughter. </span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">In 2018, the parents filed a complaint with the European Court of Human Rights, accusing the Norwegian authorities of violating their right to respect for private and family life (Article 8 of the European Convention on Human Rights). The Ordo Iuris Institute intervened in the case and, with the consent of the president of the fifth section of the Tribunal, submitted an amicus curiae brief containing legal arguments for the protection of parental rights. Ultimately, the Tribunal issued a judgment in which it agreed with the Institute's position. As a consequence – once again – it ruled that Norway violated Art. 8 of the Convention and awarded the parents 25,000 euro in compensation. In its justification, the Tribunal stated that Barnevernet had grounds for taking away the daughter from her parents but had no grounds for such a radical limitation of their right to maintain contact with the child. The ECtHR noted that limiting contacts to three one-hour meetings a year was incompatible with the primary goal of social welfare, which should be the pursuit of family reunification. basis of unconfirmed information about alleged domestic violence. The parents were deprived of the right to information about the whereabouts of the child taken away from them. They had no information as to why the child had been picked up from school by officials, they did not know where the child was and what condition he was in. Norwegian police have banned officials and the school from informing parents about the details of the proceedings. The child was placed in Norwegian foster care. Eventually, the parents managed to clarify the matter and get the child back. Fearing further abuse from Barnevernet, they returned to Poland.</span></span></p> <p style="margin-bottom:8.0pt; text-align:justify; margin:0cm"> </p> <p style="margin-bottom:8.0pt; text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">After returning to the country, the child began to draw silhouettes of characters in sexual contexts and of sexual organs, arousing the legitimate concern of the parents. A meeting with a psychologist showed that in this way he was trying to express the harm suffered. Further consultations revealed the dramatic circumstances in which the child fell victim to paedophilia in Norwegian foster care. It was then that the parents decided to turn to the Ordo Iuris Team for the Protection of Children and Youth for help. The lawyers verified the evidence and informed the prosecutor’s office about the possibility of a crime having being committed.</span></span></p> <p style="margin-bottom:8.0pt; text-align:justify; margin:0cm"> </p> <p style="margin-bottom:8.0pt; text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">However, the prosecutor’s office refused to initiate proceedings, pointing out that the parents did not report the case in Norway immediately after the incident. The prosecutor did not seem to understand that the disclosure of the events took place only when the boy felt safe, i.e. after returning to Poland. Moreover, the prosecutor did not refer at all to the testimony of the child, despite the fact that his truthfulness was confirmed by experienced psychologists. The Institute has filed a complaint with the court against the prosecutor’s decision.</span></span></p> <p style="margin-bottom:8.0pt; text-align:justify; margin:0cm"> </p> <p style="margin-bottom:8.0pt; text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">“The prosecutor’s office, instead of substantive arguments, used an unsophisticated pretext to dismiss the case. The reason seems to be the embarrassment of conducting high-profile proceedings against Norwegians, with the participation of Norwegian law enforcement agencies and the children’s office. It should be expected that the court will overturn the decision of the prosecutor’s office and order it to continue the proceedings”, emphasised advocate Franciszek Michera from the Ordo Iuris Litigation Intervention Centre.</span></span></p> <p style="margin-bottom:8.0pt; text-align:justify; margin:0cm"> </p> <p style="margin-bottom:8.0pt; text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="font-family:Calibri,sans-serif">The European Court of Human Rights took into account the legal opinions prepared by Ordo Iuris, ruling in July in three cases concerning Barneveret’s removal of children from their parents. The Court has once again indicated, in line with the conclusions of the Institute’s special report, that Norway violates Article 8 of the European Convention on Human Rights, which guarantees the style="line-height:115%">The cases concerned children taken away from their parents in Norway because of their immature attitude or difficult personal circumstances. Barneverent first limited contact to a few meetings per year and then terminated parental rights because the emotional bond had broken down.  </span></span></b></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt">• <span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><b><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%">The Ordo Iuris Institute constantly monitors the proceedings of the European Court of Human Rights and reports its participation as a ‘friend of the court’ in cases that coincide with its statutory goals.  </span></span></b></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt">• <span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><b><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%">This is not the first time that ECHR takes into account the opinion sent by Ordo Iuris. Recently, the Institute informed about the case of Romanian LGBT activists, in which ECHR shared Ordo Iuris opinion.  </span></span></b></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%">In July, the Court issued three more judgments in which it upheld the opinion presented by Ordo Iuris. All three cases concerned allegations that Norway had violated Article 8 of the European Convention on Human Rights, i.e. the right to respect for private and family life. The Institute was admitted to each of these cases as a friend of the court. This allowed us to present comments on the general principles, which complaints related to child custody should be examined, and to compare the practices of public authorities and courts, to child custody in Norway and Poland. It revealed significant deficiencies in Norway's activities in this field. Importantly, the mentioned Article 8 of the Convention for the Protection of Human Rights and Fundamental Freedoms states that every individual has the right to respect for private and family life.</span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%">The case of R.O. v. Norway concerned the intervention of social welfare, which took the child away from the mother shortly after birth, due to her difficult personal situation (depression, drug abuse, inability to take care of hygiene in the flat, no permanent job). The child was placed in the care of the grandparents on the father's side. The district court allowed the mother visits, but only six times a year for two hours each. The mother started to work on herself but was not given the chance to regain custody of her child. Such an extreme restriction of the mother's contact with her child from the very beginning of life appears, in the ECtHR's view, to be an attempt to deprive the mother completely of the bond between herself and her child.</span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%">In the case of K.E. and A.K. v Norway, the child welfare authority Barnevernet removed a newborn child from its parents on the grounds of 'inability to meet its physical and psychological needs. The county court limited the parents' contact with their child to four meetings of one hour a year. The Court faulted the court for failing to make any effort to create conditions to facilitate the possibility of future reunification between the mother and child.</span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%"> In the case of F.Z. v. Norway, social welfare decided that a 19-year-old boy and a 17-year-old girl were not mature enough to look after two children. The first child was taken away by Barnevernet shortly after birth, and the second child was taken away while she was still pregnant. The parents were entitled to six meetings a year with their first child, and to one meeting a week with their second child - always under the supervision of an official. Over time, however, the office also restricted contact with the second child because she "did not maintain eye contact" during the supervised meetings. </span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%">When the second child was almost 5 years old, Barnevernet decided to completely terminate the couple's parental rights, due to their "inability to establish an emotional bond" with their child. All decisions were approved by the district court. The Strasbourg Court accused the Norwegian authorities that they had never created the conditions for the development of any emotional bonds between the parents and their child, so it was not surprising that after five years they were no longer there. The Court doubted whether such a bond could be established in the course of rare, brief, and supervised meetings.</span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%">Significantly, this is already another time that the ECHR has taken into account the opinion of the Ordo Iuris Institute in its judgment. A recent example is a judgment concerning a counter-manifestation of a Romanian organization that protested against the broadcast of a film promoting LGBT ideology. The Court found that the state failed to adequately secure the event and did not conduct a thorough investigation of the case, but found the charge of an alleged violation of Article 3 of the Convention (prohibition of torture) unfounded. As regards the allegation under Article 3, the ECtHR's position is consistent with the opinion submitted in these proceedings by the Ordo Iuris Institute.</span></span></span></span></span></p> <p style="text-align:justify; margin:0cm 0cm 8pt"><span style="font-size:11pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif"><span lang="EN-US" style="font-size:12.0pt" xml:lang="EN-US"><span style="line-height:115%">"Recent ECtHR judgments confirm that Norway has a systemic problem with respect for parental rights. The Norwegian welfare system is based on the assumption that once a child is taken away, he or she should in principle never return to the parents, and that maintaining contact should only serve to make the child aware of his or her biological roots. In the proceedings before the Court, we have taken the position that even distressed parents who have been negligent in caring for their child have a right to a second chance. The State must give them a realistic opportunity to get their child back if they make progress in working on themselves. The Court has once again upheld this position. Among other things, the website features information on how to obtain support, and an interactive map of violence prevention centres. The Institute has also prepared a handbook on that matter.</span></strong></span></span></span></p> <p class="text-align-justify" style="text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">It is most often the case that the victims of violence are women, children, the elderly, and people with disabilities. However, men also experience violence. 73% of cases concern women (14% men, and 13% minors, regardless of sex). Police figures show that, among domestic violence cases, psychological violence is dealt with most often, with over 81,000 individuals having fell victim to it in 2020. Around 57,000 people experienced physical violence. Alcohol abuse is a considerable problem in this respect. Over 70% of police interventions last year saw the perpetrators of domestic violence under the influence of alcohol.</span></span></span></span></p> <p class="text-align-justify" style="text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">Given the scale of this issue, the Ordo Iuris Institute has launched the Precedent Case Programme, part of which is the stopprzemocy.org website. It also features an interactive map of social and public institutions where victims of domestic violence may get support, along with contact details. It lists the support measures available for victims of domestic violence, with emphasis placed on legal instruments. It describes the mechanisms used in cases of violence not qualified as crime: the “Blue Card” police procedure, injunctions compelling violence perpetrators to leave residential premises, and proceedings before family courts. The handbook also contains details on the steps that may be taken with respect to cases of violence qualified as crime, together with template pleadings filed in such situations.</span></span></span></span></p> <p class="text-align-justify" style="text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">The programme, which aims at actually combatting violence, is a response to the ideological violence prevention methods. The Istanbul Convention, drafted in the spirit of gender ideology, views natural gender roles within the society as sources of violence, disregarding the actual reasons for domestic violence, confirmed by research, such as addiction, family breakdown, and sexualisation of women in the media.</span></span></span></span></p> <p class="text-align-justify" style="text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">The programme was inaugurated during press conferences in five Polish cities (Warszawa, Poznań, Gdańsk, Lublin, and Katowice), where Ordo Iuris has for years been engaging in successful efforts. The programme addresses the needs of those which have not received adequate support from the institutions that have been established for that very purpose. This was the second attempt by the Kingdom of Norway to bring the mother back to the country. Norwegian authorities had sent a European Arrest Warrant for her, but later withdrew it. Woman was represented in court by the Ordo Iuris Institute.</b></span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">The case began in January 2018, when she came to Poland to protect her son and two daughters against Barnevernet (Norwegian Child Welfare Services). Social services instigated proceedings against her, as she failed to disclose the acts of violence perpetrated by the father on her children. Given the administrative decision on the termination of her parental rights, she decided to leave for Poland and seek protection for her family life. At the same time, she brought an appeal against the aforesaid decision to a Norwegian court which, having sent an arrest warrant for the woman, dismissed the appeal, as she failed to appear before the court.</span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">After the family had arrived in Poland, Norway sent a European Arrest Warrant for the mother, who was ultimately apprehended by the police in October 2018. The court, however, decided not to detain her, and she was freed the very next day. The children were nonetheless handed over to an emergency kids shelter.</span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">Half a year later, the District Court in Myślibórz decided that, for the time of the proceedings, the children may return to their mother. In August 2019, Norway withdrew its European Arrest Warrant. In the meantime, the father brought an action to a Norwegian court with a view to having his parental rights granted. However, in line with the Hague Choice of Court Convention, as she changed her permanent address, Norwegian authorities have had no legal authority to resolve cases concerning her children since at least 2018. </span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">Despite this, the authorities in Oslo sent another arrest warrant for the mother. The Regional Court in Zielona Góra refused to execute it, having found that the case at hand could not be considered a case of abduction, as at the date of the family’s departure for Poland no ruling or decision which would terminate the mother’s parental rights had been issued. In their statements before the court, the lawyers of the Ordo Iuris Institute further recalled that the Kingdom of Norway is known for systemic violations of human rights, as evidenced by the thirty-five cases concerning the efforts of Barnevernet that are pending against the state before the European Court of Human Rights. They also argued that similar conclusions have been reached by the Office for Foreigners and the Minister of Foreign Affairs, who granted asylum to Ms Garmo and her daughter Eira. </span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">This is not the first case where Polish courts refused to extradite families that have fled to Poland. The first such case, and thus the most precedential, was the one of Denis Lisov, a Russian man who had fled with his three daughters from Sweden to Poland, where the children were placed in a Muslim foster family due to their mother’s illness. In turn, the den Hertog family came to Poland from the Netherlands. Their autistic son was unjustifiably placed in a Dutch childcare facility. Case-law shows that Polish courts have been convinced in the past to carry out detailed verifications of cases concerning extradition of individuals for the purpose of conducting criminal proceedings against them.  </span></span></span></p> <p style="text-align:justify; margin:0cm"> </p> <p style="text-align:justify; margin:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">“The decision to extradite the mother to Norway would most surely lead to her separation from her children, as she would be almost certainly temporarily detained. The children would be handed over to the father, and then to Barnevernet, given the acts of violence the father had perpetrated against them beforehand. As a result, as we pointed out, any and all ties between the mother and the children would be severed. The documents collected in the case files show that both the children’s court-appointed guardian, as well as their teachers and the school pedagogue have indicated that there are strong ties between mother and her children. In our opinion, her extradition to Norway could therefore constitute a violation of Article 8 of the European Convention on Human Rights,” said adw. The cases concern two families broken up by the child protection office - Barnevernet, on the basis of false accusations of mental problems of the parents. In the first case, the evidence for this was supposed to be "excessive" concern for the children's health. These rulings confirm the phenomenon of systemic violations of human rights in Norway.</span></span></b></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">The first case concerned the marriage of a Swede and a Romanian, who moved to Norway in 2013. They moved to the country with their three sons, who were 13 years old, 8 years old and 6 years old. Shortly after the move, Barnevernet issued an order to immediately take the three boys from their parents because of alleged "insufficient insight into their problems." According to officials, the parents' concern for the children's health was excessive. In the eldest son, the parents began to notice symptoms that might indicate the occurrence of Ehlers-Danlos syndrome, a genetic disease manifested by excessive flaccidity and tenderness of the skin and by joint instability. The parents also noticed similar symptoms in their younger sons.</span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">After Barnevernet's intervention, the children were transferred to foster care, and the parents were granted the right to two hours of meetings per month, which were soon limited to four half-hour meetings per year. During the meetings, the parents could not communicate with the boys in their native language - Romanian. The couple appealed the decision to court. In the course of the proceedings, the expert's opinions confirmed that, contrary to Barnevernet's suggestions, the parents did not have mental problems, and their oldest son actually required special care, although it was not determined whether he suffered from EDS. Moreover, it was determined that the eldest boy did not handle well the separation from his parents and wished to return home as soon as possible.</span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">In 2015 the Superior Court ruled that Barnevernet's decision to take the children from their parents was unfounded. However, the court also ruled that only the eldest boy could return home because the other two allegedly had already bonded with their new place of residence. At the same time, the court granted the parents the right to six six-hour meetings with the two sons per year, under the supervision of a social worker.</span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">Due to this decision, the children's father lodged a complaint with the European Court of Human Rights in Strasbourg. The ECHR ruled that Norway had violated the father's right to respect for his family life, as guaranteed by Protocol No. 8 to the Convention for the Protection of Human Rights and Fundamental Freedoms. The court drew attention to the inconsistency in the Norwegian court's ruling, which on the one hand declared Barnevernet's decision to be entirely unfounded, and on the other hand annulled it only in the part concerning the oldest boy. In addition, the judges reminded that the state has the duty to make efforts to reunite the child with its biological parents. Meanwhile, throughout the whole separation period, the authorities did not make any efforts in this direction - the allowed meetings between the parents and their children were rare and they could not communicate with each other in their native language.</span></span></span></span></p> <p style="margin-top:0cm; margin-right:0cm; margin-bottom:8.0pt; margin-left:0cm; text-align:justify"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">The second case concerned a Norwegian married couple, who in 2008 had their 2.5-year-old son taken away by Barnevernet, because of their alleged mental illness. In 2014 The Superior Court upheld Barnevernet's decision, indicating that after six years of separation, the child allegedly felt more connection with his foster carers than with its biological parents.
