Already the initial draft indicated that the aim of the regulation would be to bring about the acceptance of adoptions carried out in another country by same-sex couples.</p> <p class="text-align-justify">Despite the fact that, in light of the Treaty on European Union (TEU) and the Treaty on the Functioning of the European Union (TfUE), substantive family law is the exclusive competence of the Member States, the European Commission planned a profound interference in the family law system by forcing Member States to formally accept factual situations in which another state has recognised same-sex parenthood.</p> <p class="text-align-justify">In a draft EU regulation, published in December 2022, the EC asserts that the document is intended to offset the problems associated with moving to other EU countries in situations where parental rights granted in one country could be challenged in another. The regulation would apply to adoptive parents, which means that it will also cover situations of same-sex couples to whom some states grant the right to adopt and others do not. Regardless of how the issue of institutionalisation of such unions and the possibility of adoption of children by such couples is regulated by Poland, the regulation will enforce the acceptance of parenthood recognised in another EU state.</p> <p class="text-align-justify">The regulations contained in the draft will also normalise surrogacy - the 'purchase' from a 'surrogate mother' of a child for whom the purchasers then obtain parental rights. Although surrogacy is not currently allowed in EU countries, once the regulation is adopted, changes to a Member State's national laws will be sufficient to open the way for wider acceptance of surrogacy.</p> <p class="text-align-justify">The announced regulation is also intended to include a solution to circumvent resistance from states that do not accept the EU's attempts to interfere in national law. The lack of possibility to transcribe a foreign civil status record in a situation where the Polish legal system does not provide for the existence of the institution of 'same-sex marriage' or parenthood of persons other than a woman (mother) and a man (father) is to be circumvented through the implementation of the so-called European certificate of origin of a child. Such a certificate would be an alternative to the birth certificate - a document with legal significance throughout the European Union.</p> <p class="text-align-justify">The proposed regulation is another example of a violation of the Treaty provisions by exceeding the powers conferred on Union bodies by the Member States. It is a matter for national law to determine who may lawfully be a spouse and parent. The attempt to adopt such solutions will constitute a blatant and most blatant overstepping of the Union's competences to date. In this regard, the Ordo Iuris Institute is monitoring the work on the regulation. According to the latest information, a vote is expected to take place in the Council of the European Union during the Belgian Presidency, which runs from January to June this year.</p> <p class="text-align-justify">"The regulation is a step towards institutionalising same-sex unions and granting such couples the right to adopt. For the time being, the European Union requires the recognition of same-sex unions formalised abroad, by accepting the recognised parentage of these individuals in another country - while leaving domestic unions free. In the future, however, it may try to push this boundary further. What we have here is a kind of test of the limits of Member States' resistance to regulations that exceed the competences granted to the Union. The initiators themselves have already commented on several occasions that they expect opposition from states such as Poland during the vote in the Council, while the adoption of this regulation requires unanimity. The authors of the document in question also emphasise that, as a result of subsequent case law of the European Court of Justice, it has been clarified that European Union law takes precedence over national laws of any rank, and thus also over the constitutions of the Member States. It is worth noting, however, that there are numerous rulings by constitutional courts, e.g. Italy, in which national judges have severely restricted the rules for the application of the principle of primacy, particularly in relation to the constitution. In this context, it is worth recalling, for example, the verdict of the Constitutional Tribunal from 2004, in which it was clearly stated that the Constitution remains - by virtue of its special power - the supreme law of the Republic of Poland in relation to all international agreements binding the Republic of Poland (and thus also the treaties constituting the primary law of the European Union).</p> <p class="text-align-justify">The authors of this document also emphasise that subsequent case law of the European Court of Justice has clarified that European Union law takes precedence over national law at all levels, and thus also over the constitutions of the Member States.</p> <p class="text-align-justify">Member States' constitutions.It is worth noting, however, that there are a number of judgments by constitutional courts, e.g. Italy, in which national judges have strongly restricted the rules on the application of the principle of primacy, particularly in relation to the constitution. In this context, it is worth recalling, for example, the verdict of the Constitutional Tribunal of 2004, in which it was clearly stated that the Constitution remains - by virtue of its special power - the supreme law of the Republic of Poland in relation to all international agreements binding the Republic of Poland (and thus also the treaties constituting the primary law of the European Union).</p> <p class="text-align-justify">The Report goes on to state that the principle of the primacy of Community law is not enshrined in the primary law of the European Union (the Treaties), relying primarily on the case law of the European Court of Justice. This principle is expressed in Declaration No. 17 to the Treaty of Lisbon amending the Treaty on European Union and the Treaty establishing the European Community, which, however, as the authors of the Report themselves admit, does not give it the appropriate legal force (as it would have had it been included in the Treaties).</p> <p class="text-align-justify">The authors of the Report consider that in order to ensure respect for the principle of primacy of Community law, it is necessary to change its legal status. The codification of this principle in primary law (the Treaties) could therefore contribute to clarifying the relationship between the European Union and national legal orders and mitigate the conflicts that arise in this regard. In other words, the formulation and inclusion of the principle of primacy of Community law in primary law would raise its legal standing, as it would be expressed expressis verbis in the Treaties.</p> <p class="text-align-justify">The authors of the Report acknowledge that the principle of primacy of Community law suffers from certain limitations, which is apparent from the case law of the constitutional courts of the Member States, citing Germany, Denmark, Hungary, Poland and Romania as examples.</p> <p class="text-align-justify">In the light of the above-mentioned considerations, the authors of the Report conclude by stating, inter alia, that the principle of primacy is always binding on all Member State authorities and that the implementing power of EU law cannot vary from one Member State to another. In addition, the Commission should closely monitor the judgments of national courts with regard to the primacy of EU law and initiate infringement proceedings under Article 258 TFEU in response to judgments of national constitutional courts challenging this principle. It also appears that the principle of the primacy of Community law should be incorporated into the EU Treaties and that it is for the CJEU to define the scope of the principle, given its exclusive competence to give the final interpretation of EU law. At the same time, it states that this issue cannot be left to national courts on the basis of their interpretation of EU law or national laws. There is also the thesis that challenging CJEU judgments on the basis of national constitutional objections regarding respect for EU competence or national constitutional identity actually undermines the authority of the CJEU.</p> <p class="text-align-justify">In this context, the European Commission is thus placed in the role of guardian of the Treaties, with the task of ruthlessly enforcing violations of the principle of primacy when this principle is included in the primary law of the European Union.  </p> <p class="text-align-justify">The recommendations contained in the Report arouse far-reaching astonishment, as the fundamental laws of the Member States of the European Union are, as a rule, the supreme law of these states, standing higher in the hierarchy of normative acts than international agreements, which also applies to the treaties that constitute the basis for the functioning of the European Union. In this context, we should bear in mind the jurisprudence of the Constitutional Tribunal of the Republic of Poland, which has clearly emphasised that in the light of the 1997 Constitution of the Republic of Poland, it is the Constitution that is the supreme law, which also applies to EU treaties.</p> <p class="text-align-justify">21 November this year. In the published document, the EC points out that the promotion and protection of children's rights is one of the key objectives set out in the Treaty on European Union. The recent experience of the COVID-19 pandemic has exacerbated challenges and inequalities, increased domestic violence and online child abuse, as well as cyberbullying. In view of these threats, the Commission has pledged to put forward an initiative to promote the development and strengthening of integrated child protection systems, which will encourage all relevant authorities and services to better cooperate in a system that prioritizes children. To this end, the Commission will draw up a recommendation to support Member States in establishing and improving their systems for the protection of wildlife.</p> <p class="text-align-justify">Particularly dangerous may be the desire of the European Union to impose the application of the model of solutions adopted in Norway and Germany and to create a "children's office" that would interfere in the lives of Polish families. Many years of observation of the functioning of such a model, including the establishment of the Norwegian Barnevernet office or the German Jugendamt, shows the dysfunctionality of such solutions and the destructive effects on families in the long-term perspective. The Ordo Iuris Institute has already successfully intervened more than once in cases concerning the protection of parents' rights violated by these institutions, including before the Strasbourg Court. A series of rulings by the Court shows unequivocally that the Norwegian authority violates the rights of parents who find themselves in difficult life situations, their children are taken away from them and transferred to foster families, without giving them a chance to improve. It is the duty of the state to create conditions and a suitable environment for rebuilding the bond between biological parents and the child. This shows that the model on which Norway and Germany, among others, based their family policies is becoming a systemic problem of respect for parents' rights.     </p> <p class="text-align-justify">The functioning of the aforementioned institutions has also been criticized by the European Parliament, which in 2018 adopted a resolution condemning the German state's discrimination against parents from other countries, and criticizing the unfounded separation of children from their parents. Also, the Council of Europe has criticized the actions of member states in failing to respect children's rights to ensure an unbreakable bond with their parents and the need to ensure judicial control over welfare offices.  Ordo Iuris points out that it would therefore be definitely unacceptable to introduce such solutions on Polish soil, which is what the European Commission is trying to achieve by limiting the competence of individual member states in this regard.</p> <p class="text-align-justify">In the Institute's opinion, the European Commission's actions on new initiatives should be preceded by an analysis and review of the existing law, an assessment of the necessity of introducing new solutions at the EU level and a detailed determination of the potential effects of introducing new regulations, and in the discussed context - the protection of children's rights. Therefore, the Institute notes the need for the Commission to address and analyze the following issues: protection of the physical integrity of the child, ensuring an environment that is friendly to the relationship between parents and children, stricter penalties for those convicted of child abuse, protection of children from cyberbullying, limiting access to pornography, protection of unborn children, protection of children's mental health, prohibition of so-called "transitions" in minors. transitions in minors, dialogue and relationship-building among peers, banning advertising with children, curbing child trafficking, tightening penalties for groups involved in child sex trafficking or coercing children into labor.</p> <p class="text-align-justify">- The welfare of the child is a value that must be protected in a special way. It should be clearly emphasized that current EU legislation and the national laws of the Member States already sufficiently define this matter and provide effective and efficient safeguards for the interests and rights of the child. Of particular concern may be the fact that the European Commission will seek to interfere with national legal orders by limiting the rights of parents. Possible solutions proposed by the Commission must have a comprehensive dimension, taking into account the systems and institutions already in place, as well as the diversity of societies in individual member states," noted Dr. Przemysław Kulawinski of the Ordo Iuris Center for International Law.  </p> <p class="text-align-justify">The Institute will monitor the work on the project. If it turns out that the EU's competencies are being exceeded, Ordo Iuris will prepare an appropriate opinion regarding the indicated issue and a proposal for possible solutions. Within the framework of the so-called "State of the Union," Ursula von der Leyen addressed the most important issues related to the current situation in the European Union, such as the European Green Deal, the economy, migration and Russian aggression against Ukraine. At the same time, Ursula von der Leyen stressed the need to further broaden and deepen integration within the European Union. The president also thanked efforts to deepen so-called gender equality and pointed to immigration as a solution to labor market problems.</strong></p> <p class="text-align-justify"><br /><strong>Green Deal the most important issue in the Union</strong></p> <p class="text-align-justify"><br /> At the beginning of her address, the European Commission President noted that today's European Union reflects the vision of those for a better future after World War II, referring to European integration. The upcoming elections to the European Parliament will be the moment when voters will decide what kind of future and what kind of Europe they want.</p> <p class="text-align-justify"><br /> The address itself focused on several key topics covering the most relevant problems, challenges and future projects. Among them, Ursula von der Leyen mentioned issues such as the European Green Deal, the economy, artificial intelligence and digitization, social affairs, migration issues or Russian aggression against Ukraine.</p> <p class="text-align-justify">As the first and most important project, the President of the European Commission presented the European Green Deal, a set of initiatives aimed at achieving climate neutrality by 2050. The European Green Deal itself was presented as an answer to the call of history. In this context, Ursula von der Leyen recalled various natural disasters related to climate change. Among them, she mentioned the recent fires and floods in Greece and Spain or other negative weather phenomena taking place in many European Union countries, stating that "this is the reality of a boiling planet." The European Commission president also highlighted the economic aspects of the green transition, stressing that it was created as an opportunity to maintain future prosperity, also mentioning investment and innovation. At the same time, she pointed out that modernization and decarbonization can go hand in hand, and that the Commission will support European industry in this process. She cited wind energy as an example of European success in this matter, while stressing that some changes are needed in view of the new challenges. The President of the European Commission therefore announced the European Wind Power Package, which is to be based on cooperation with industry and member states and includes skills, financing and ensuring stable supply chains.</p> <p class="text-align-justify"><strong>Immigration and gender</strong></p> <p class="text-align-justify">An important part of the address was the issue of migration. The European Commission president mentioned armed conflicts, climate change and instability as factors that force people to relocate and seek protection in other countries. Von der Leyen cited the new Pact on Migration and Asylum, which, in her view, is the result of work and a kind of golden mean between the need to protect borders and the need to protect people, between sovereignty and solidarity or between security and humanity. In doing so, the President of the European Commission mentioned the hybrid attack by Belarus on the Union's external border, while pointing out that European bodies should be strengthened to combat human trafficking and law enforcement.</p> <p class="text-align-justify">During her speech, the President thanked the "groundbreaking and pioneering" work in the area of "gender equality," noting that it means a lot to her as a woman. Here she referred to the Directive on Women on Boards and the European Union's accession to the Istanbul Convention. In a further section of the address, she also cited the Directive on Equal Pay and Transparency of Remuneration and the Directive on Combating Violence Against Women. At the same time, Ursula von der Leyen said that the work to date on the matter in question is far from complete and, in her view, we must continue to move forward together.</p> <p class="text-align-justify"><strong>Relations with China</strong></p> <p class="text-align-justify">Ursula von der Leyen also mentioned problems related to unfair competition. As an example, she cited unfair practices by China in the area of solar energy or the electric car sector. In the latter case, she accused the Chinese of undercutting the prices of these cars due to, among other things, state support and the resulting flooding of global markets with their products. The President therefore announced that the Commission is launching an anti-subsidy investigation into electric vehicles coming from China. During her address, she said at the same time that it is equally important, however, to keep the lines of communication and dialogue with China open.</p> <p class="text-align-justify">- Europe is open to competition. Not for a race to the bottom. Reducing risks, but not stretching - this will be my approach in talks with Chinese leaders at the EU-China summit this year," Ursula von der Leyen said. With this, the European Union is entering a new phase of green transformation.</p> <p class="text-align-justify">Later in her address, the European Commission President focused on issues relating to environmental protection, emphasizing the importance and richness of the environment in many different member states. She then turned her attention to the role of food security and self-sufficiency in this area, paying tribute to the farmers who provide food for Europeans every day through their work. In her view, the Union needs more dialogue and less polarization on agricultural issues. Therefore, Ursula von der Leyen noted that a strategic dialogue should be launched on the future of agriculture in the European Union.</p> <p class="text-align-justify">Another theme of the address was issues related to the economy, social affairs and competitiveness. Among these issues, the European Commission President identified three challenges that Europe will face in the coming year. They are labor and skills shortages, inflation and making it easier for companies to do business.</p> <p class="text-align-justify"><strong>Socio-economic issues </strong></p> <p class="text-align-justify">In the context of labor market problems, von der Leyen stressed the importance of the EU's NextGeneraton program, commonly known as the Recovery Fund, which is a response to the economic crisis caused by the COVID-19 pandemic. The chairwoman positively assessed the effects of this project, highlighting the increase in employment and shortages of appropriately skilled workers in a wide variety of industries, such as IT, healthcare and tourism. In her view, access to the labor market needs to be improved, which is especially true for young workers and women. In this connection, Europe also needs skilled immigration and appropriate and far-reaching changes in areas such as technology, society and demographics.  Dialogue between the various social partners needs to be revisited, which is why a new Social Partners Summit will be convened next year in Val Duchesse, in reference to the earlier meetings and negotiations through which the process of European integration began after World War II.</p> <p class="text-align-justify">Ursula von der Leyen highlighted the European Central Bank's efforts to keep inflation under control. She also mentioned energy-related problems, including Europe's dependence on Russian gas, which has been used by Vladimir Putin as a weapon in the context of Russian aggression against Ukraine. The European Commission president hailed the stabilization of gas energy prices and investments in renewable energy sources as successes.</p> <p class="text-align-justify">As for the facilitation of doing business, Ursula von der Leyen noted that by the end of the year a new body will be established, the SME envoy, which will be tasked with informing the European Commission president about the most important problems of this group of entrepreneurs. Meanwhile, each new piece of European Union legislation will be analyzed from the point of view of competitiveness by an independent commission. In the coming months, legislative proposals will also be announced, aimed at reducing by 25% the number of information obligations imposed on companies. The Commission Chairwoman went on to mention the need to provide companies with access to key technologies, which requires joint funding at the European Union level. This refers to the European Commission's idea, proposed in June of this year, to create a Strategic Technology Platform for Europe (STEP). The need to secure access to strategic raw materials and materials was also mentioned during the address.</p> <p class="text-align-justify">Later in the speech, Ursula von der Leyen addressed issues related to digitization and artificial intelligence. The President emphasized the importance of digital technologies, given that their development is associated with the emergence of new challenges, such as disinformation, the spread of harmful content or threats to the confidentiality of our data. In this aspect, she highlighted Europe's pioneering role in protecting citizens' rights in the digital world. In her view, Europe should lead global efforts to adopt a framework for artificial intelligence and based on protective barriers, governance and guiding innovation.</p> <p class="text-align-justify"><strong>Further expansion of the EU?</strong></p> <p class="text-align-justify">Later, Ursula von der Leyen referred to Russian aggression against Ukraine, stressing that this country can rely on the European Union.- We will support Ukraine every step of the way," the president pointed out.</p> <p class="text-align-justify">Von der Leyen also emphasized the European Union's efforts to help Ukrainian war refugees, as well as Ukraine itself. At the same time, she said, the future of Ukraine, like the future of Moldova and the Western Balkans, is in the European Union. In this context, she noted that each time the European Union has expanded, it has been and continues to be linked to deepening integration. Therefore, the next enlargement to new member states should be a catalyst for progress in this matter. In the longer term, it will also be necessary to amend the treaties.</p> <p class="text-align-justify">Particularly noteworthy are the words of the President of the European Commission, spoken at the very beginning of the address, and referring to the upcoming elections to the European Parliament. As Ursula von der Leyen said, they will be an opportunity for voters to express their opinion about what kind of Europe they want.</p> <p class="text-align-justify">These words could become crucial, especially if it turns out that in the new European Parliament, elected in the next elections, more seats will be won by groups advocating a reduction in European integration or even outright Eurosceptic parties, contesting the existing policies of the EU establishment. This year's meeting was devoted to a discussion of the independence of the judiciary, the anti-corruption framework, media freedom, the functioning of NGOs in Poland, the situation on the Polish-Belarusian border or, finally, the disbursement of funds to NGOs.</p> <p class="text-align-justify">In their speeches, the Institute's representatives stressed, among other things, that civil society in Poland enjoys great freedom to take action, regardless of what demands it formulates. The Institute also supports legislative measures to raise the standard of transparency of NGO funding, especially foreign funding. The introduction of such solutions would be particularly important in an era of strong disinformation and mutual accusations of obtaining foreign funds, and would also increase the transparency of public debate by imposing an identical obligation for domestic and foreign entities, which would counter any accusations of possible violations of the free flow of capital and the right to free association.</p> <p class="text-align-justify">The last version of the rule of law report was published in July 2022. It addressed four main areas that have a significant impact on respect for the rule of law: national justice systems, the anti-corruption framework, pluralism and media freedom, and institutional issues related to checks and balances of power important for the smooth functioning of democracy. A new element of the third edition of the report was the identification of specific recommendations for member countries in the above areas. The meeting was organized as part of the national consultations preceding the preparation of the European Commission's report on the state of the rule of law in the EU in 2022 and 2023. The purpose of the meeting was to discuss the issues covered in the report. </p> <p class="text-align-justify">The recommendations the Commission made to Poland in July included: separating the functions of the Minister of Justice and the Prosecutor General, and ensuring the functional independence of the prosecutor's office from the government. The EC also recommended introducing legislation to regulate lobbying and a standard online system of asset declarations for public officials, as well as MPs and senators. Among the recommendations, moreover, were ensuring independent and effective preliminary and judicial proceedings, as well as ensuring fair, transparent and non-discriminatory procedures for granting broadcasting licenses to media entities. EU officials claimed that Poland was discriminating against people with homosexual tendencies and experiencing "gender identity" disorders. Evidence of this discrimination was to be found in alleged "LGBT-free zones." This is an obvious lie by the LGBT activists themselves, who, by the way, openly boasted on social media that thanks to them the Commission is screening Poland. Fortunately, their triumph was only temporary - at the end of January, the European Commission closed its investigation into the alleged "LGBT-free zones."</strong></p> <p class="text-align-justify"><strong>This is how fake news is made</strong></p> <p class="text-align-justify">When many Polish local governments reacted with opposition to Rafał Trzaskowski's radical gender agenda "LGBT+ Declaration," no one could have predicted that the ideologues would go so far as to launch such damaging attacks on small municipalities or districts. The outrageous lies began with happenings by LGBT activist Bart Staszewski, who prepared yellow signs reading "LGBT-free zone" - translated into English, French and Russian. He then drove around towns that had passed pro-family resolutions and affixed his signs under city name boards. He published photos and short videos of these actions online. Soon the photos reached far beyond the country's borders. Many Europeans truly believed that Polish towns and cities posted such signs on their borders.</p> <p class="text-align-justify">Other LGBT activists created an "Atlas of Hate" - an interactive map of Poland on which they marked in red all municipalities, districts and provinces that had passed pro-family resolutions, declaring them places where people who identify with the LGBT movement are not tolerated. Among them were also local governments that adopted the Local Government Charter on the Rights of Families - despite the fact that the resolution, prepared by Ordo Iuris lawyers, does not even mention the LGBT movement in a word.</p> <p class="text-align-justify">Despite our efforts, successive Polish courts ruled that placing a local government in the "Atlas of Hate" did not violate its good name. Brussels officials also threatened pro-family local governments with the loss of EU money. The situation was becoming increasingly difficult....</p> <p class="text-align-justify"><strong>European Commission closes infringement procedure against Poland</strong></p> <p class="text-align-justify">The European Commission's decision surprised confident LGBT activists and radical media. "Did the Commission believe that there is no problem of discrimination in Poland?" - asks the Oko Press website bitterly, citing the opinion of an activist from the Campaign Against Homophobia and one of the authors of the slanderous "Atlas of Hate."</p> <p class="text-align-justify">The closure of the EU procedure is undoubtedly a great victory for pro-family local government officials and lawyers of the Ordo Iuris Institute, who immediately after its initiation provided the Polish government with a legal analysis containing substantive answers to all the questions posed by EU officials. As Oko Press and Gazeta Wyborcza columnists admit, the government in its correspondence with the European Commission "duplicated the line of defense used by local governments and Ordo Iuris, which represents them before the courts."</p> <p class="text-align-justify"><strong>Let's hold the liars accountable</strong></p> <p class="text-align-justify">The end of the EC's infringement procedure must be the beginning of a new stage in the fight for the good name of the slandered local governments and the good pro-family policy of Polish municipalities, districts and provinces. We will be reminded of the European Commission's decision in the courts, where five proceedings are still pending in the lawsuits of the authors of the "Atlas of Hate," whom we sued on behalf of local governments adopting the Local Government Charter on the Rights of Families, prepared by Ordo Iuris lawyers.</p> <p class="text-align-justify">Lawyers of Ordo Iuris sued left-wing activists in seven lawsuits, in which - on behalf of the authorities of pro-family local governments - we demand that the authors of the "Atlas of Hate" apologize, in particular read out in front of the European Parliament building, and pay reparations to social causes.</p> <p class="text-align-justify">Today only five of the seven proceedings are pending, as the authorities of two local governments have given up the fight for their good name. Unfortunately, this is largely the result of financial blackmail, threats and a wave of slander by radical activists. That's why we cannot stop fighting for the good name of these local governments, which, despite the enormous reprisal, are still not afraid to stand on the position that the family is a value that public authorities should support. In one of the proceedings that is still ongoing, the last appeal hearing has already taken place, and the verdict is expected to be announced on March 7.</p> <p class="text-align-justify">Our lawsuits have already had a very concrete communication effect - the main page of the slanderous "Atlas of Hate" today shows information about the three ongoing trials. As a result, anyone who enters this lying site will immediately know that they are dealing with information of - euphemistically speaking - questionable reliability.</p> <p class="text-align-justify"><strong>The Union believes the lies of the radicals</strong></p> <p class="text-align-justify">We also continue to fight the myth of "LGBT-free zones" on the international stage. We intervene every time this fake news returns in the international debate. And it repeats itself, unfortunately, on a regular basis. Many have come to believe in the veracity of the fake "LGBT-free zone" road signs. As a result, there are still people in Europe who are sanctimoniously convinced that there are villages and towns in Poland where people with homosexual tendencies and experiencing "gender identity" disorders are not allowed to enter. Such lies have been repeated many times in the European Parliament - and not only in speeches by MEPs.</p> <p class="text-align-justify">We were able to read about the existence of alleged "LGBT-free zones" in two European Parliament resolutions. We challenged both of them to the Court of Justice, which thus had the opportunity to confirm what we have been reminding you of for years - resolutions of the European Parliament have no legal force whatsoever and are merely political declarations by MEPs. In the case of the second resolution, the Court originally tried to overrule the case on formal grounds, but after our appeal, the Second Chamber of the CJEU agreed with the Ordo Iuris lawyers and remanded the case for a new decision.</p> <p class="text-align-justify">One thing is certain - lies about Poland do not go without a legal response.</p> <p class="text-align-justify">Adv. The European Commission announced the start of work on a regulation on the recognition of parentage between member states. The draft's initial assumptions already indicated that the regulation would aim to bring about the acceptance of adoptions made in another country by same-sex couples.</p> <p class="text-align-justify">Despite the fact that, under the Treaty on European Union (TEU) and the Treaty on the Functioning of the European Union (TfUE), substantive family law is the exclusive competence of member states, the European Commission planned a profound interference in the family law system by forcing member states to formally accept states of facts in which another country has recognized same-sex parenthood. </p> <p class="text-align-justify">In a draft EU regulation published in December 2022, the EC asserts that the document is intended to level the problems that come with moving to other EU countries in situations where parental rights granted in one country could be challenged in another. The regulation would apply to adoptive parents, meaning that it will also cover situations of same-sex couples, to whom some countries grant the right to adopt and others do not. Regardless of how the issue of institutionalization of such unions and the possibility of adoption of children by such couples is regulated by Poland, the regulation will enforce the acceptance of parenthood recognized in another EU country.</p> <p class="text-align-justify">The regulations included in the draft will also affect the normalization of surrogacy - the purchase from a "surrogate mother" of a child to whom the buyers then obtain parental rights. Although surrogacy is currently not allowed in EU countries, once the regulation is adopted, changes to a member state's national laws will suffice to open the way to wider acceptance of the practice.</p> <p class="text-align-justify">The announced regulation is also expected to include a solution for bypassing resistance from countries that do not accept the EU's attempts to interfere with domestic law. The impossibility of transcribing a foreign civil status record in a situation where the Polish legal order does not provide for the existence of the institution of "same-sex marriage" or parenthood of persons other than a woman (mother) and a man (father) is to be circumvented through the implementation of the so-called European certificate of origin of a child. Such an act would be a form of alternative to the birth certificate - a document with legal significance throughout the European Union.</p> <p class="text-align-justify">The proposed regulation is yet another example of a violation of the treaty by overstepping the powers given to Union bodies by member states. Determining who can legally be a spouse and parent is a matter for national law. Attempting to adopt such solutions will constitute a blatant and most blatant overstepping of the Union's competence to date.</p> <p class="text-align-justify">"The regulation is a step toward institutionalizing same-sex unions and granting such couples the right to adopt. For the time being, the European Union requires the recognition of same-sex unions formalized abroad, by accepting the recognized parentage of these individuals in another country - while it leaves domestic unions free. In the future, however, it may try to push that boundary further. We are dealing with a kind of test of the limits of member states' resistance to regulations that exceed the powers granted to the Union. The drafters themselves have already commented on several occasions that they expect opposition from countries such as Poland when voting in the Council, while adoption of this regulation requires unanimity. The Hague Conference has been debating issues related to the legal regulation of surrogacy in practice for years, and in the course of its recent work, its Expert Group also put forward the idea of implementing an "international birth certificate."</p> <p class="text-align-justify">The Ordo Iuris Institute monitors both the work of the Hague Conference and the EU, reacting on an ongoing basis and providing its analysis and memoranda to the relevant actors. In the case of the EU, the form of defense against this unauthorized interference in family law should be a firm opposition by member states in the Council. In the coming days, the Institute will provide the European Commission with its comprehensive opinion on the draft, and will also provide the Polish government and Euro-parliamentarians with a memorandum relating to the proposed regulation.</p> <p class="text-align-justify">- The proposed regulation is another example of a violation of treaty provisions by exceeding the powers given to Union bodies by member states. member states.</strong></p> <p class="text-align-justify"><strong>· The 2030 Agenda is a roadmap with an agenda for solving the world's most pressing - in the assumption of its authors - economic, social and environmental problems.</strong></p> <p class="text-align-justify"><strong>· In reality, it is an extremely powerful political tool for putting pressure on UN countries, and among the Sustainable Development Goals are tasks that attempt to push for, among other things, access to abortion.</strong></p> <p class="text-align-justify"><strong>· Poland has so far been implementing the SDGs without succumbing to ideological pressure from the EU and other organizations, working through, among other things, programs for prenatal care.</strong></p> <p class="text-align-justify"><strong>· The Ordo Iuris Institute has provided the EC with an opinion on the planned initiative and Poland's implementation of the SDGs.</strong></p> <p class="text-align-justify">The European Commission is holding a public consultation on the initiative "Voluntary EU Review on the Implementation of the 2030 Agenda for Sustainable Development," under which it plans to look at and assess the implementation of individual Sustainable Development Goals by EU member states and the EU itself.</p> <p class="text-align-justify">Significant doubts have already been raised about the very form of adoption of the Agenda 2030 report, as already at the first stage of its creation many countries clearly opposed the inclusion of "reproductive rights" and "sexual and reproductive health" in the SDGs. What's more, twenty countries, including the Holy See and a group of Arab states, opposed to the inclusion of these controversial concepts in the SDGs. In the end, the document was adopted by acclamation.</p> <p class="text-align-justify">Among the seventeen Sustainable Development Goals are Tasks 3.7 and 5.6 on women's health, under which the state should guarantee women and girls universal and effective access to "sexual and reproductive health" services, as well as ensure the effective exercise of "reproductive rights." International organizations have already made repeated attempts, so far unsuccessful, to include the so-called right to abortion within the scope of these terms. In the absence of a legal definition of the aforementioned terms, their area is determined differently by individual UN states. An example of this is Poland, which, as part of the implementation of Objectives 3.7 and 5.6, taking measures aimed at protecting women's procreative health, has launched such programs focused on prenatal care or better medical services for pregnant women.  The European Commission's attempt to assess the implementation of the SDGs may signify an intention to influence their future implementation by Poland and other countries, which have so far resisted attempts to smuggle into the SDGs an ideological understanding of certain provisions (especially those related to procreative rights or equality).</p> <p class="text-align-justify">"The example of Poland with regard to goals 3, 5, but also others, shows that the SDGs can be implemented effectively and efficiently without succumbing to ideological pressure. Poland is actively working to implement the Sustainable Development Goals adopted as part of Agenda 2030. Moreover, Poland can be considered an example of effective implementation of the SDGs while maintaining its legal, cultural and social identity. The projects implemented by Poland do not serve a narrow group of people with specific characteristics, but, as a rule, affect the whole society, leveling inequalities, difficulties and problems realistically affecting Polish families and individual citizens. It is worth preserving this direction," commented Anna Kubacka of the Ordo Iuris Center for International Law.</p> <!-- END OUTPUT from European Commission has published information on an initiative entitled. "Equality Bodies - Binding Standards". Subsequently, on the basis of a published document ('roadmaps') outlining the Commission's legislative ideas, the public was given the opportunity to participate in a public consultation and send in their views. However, the most interesting is yet to come, as for the fourth quarter of 2022. Commission has announced the adoption of the initiative. This means that we should soon already have concrete ideas and solutions that the Commission will be seeking to implement.</strong></p> <p class="text-align-justify"><strong>What worries the European Commission?</strong></p> <p class="text-align-justify">In the communication on the occasion of the publication of the initiative, it was pointed out that equality bodies have the task of promoting equal treatment by helping victims of discrimination, carrying out independent studies, publishing independent reports or making recommendations.</p> <p class="text-align-justify">Indeed, the EU Directives require all Member States of the Union and countries in the European Economic Area (EEA) to have designated equality bodies to promote equal treatment. Equality bodies were first established under the Directive on the implementation of the principle of equal treatment between persons irrespective of racial or ethnic origin (2000/43/EC). At that time, they were entrusted with promoting equal treatment by assisting victims of discrimination, carrying out independent surveys, publishing independent reports and making recommendations on discrimination. The three subsequent equality directives entrusted the equality bodies with the same tasks (promotion of equality). Three subsequent equality directives gave the equality bodies the same tasks (promoting equality) in their respective fields: the Directive implementing the principle of equal treatment between men and women in the access to and supply of goods and services - in the area of goods and services (2004/113/EC), the Directive on implementing the principle of equal opportunities and equal treatment of men and women in matters of employment and occupation - in the area of employment (2006/54/EC) and the Directive on applying the principle of equal treatment between men and women engaged in an activity in a self-employed capacity - in the area of self-employment (2010/41/EU). The latter two added an additional mission to exchange information with the relevant European bodies.</p> <p class="text-align-justify">What worries the EC is the challenges related to the functioning of these bodies, as their mandate, powers, status, independence, resources and effectiveness vary from one EU country to another. The aim of the Commission's initiative is therefore to strengthen the equality bodies by setting minimum standards for how they operate in relation to all aspects of discrimination and areas covered by EU equality legislation.</p> <p class="text-align-justify">It is worth noting that the take-up of this topic is most likely the result of action by the equality bodies themselves. As early as 2016, Equinet, the European network of specialised equality bodies, argued that equality bodies needed more effective regulation. It was pointed out at the time that current EU legislation does not guarantee equality bodies full independence, which translates into a lack of efficiency and sufficient powers to effectively protect victims of discrimination. In the document prepared at the time, 'Developing standards for equality bodies. Equinet working document'[4] the authors pointed out the problems and limitations arising from the fact that the Directives only provide for minimum standards with regard to the competences of equality bodies and their limited independence in action. EU law, on the other hand, does not guarantee them full independence, effective action, sufficient powers and adequate resources. The European Commission's initiative appears to be a response to the claims made by equality bodies.</p> <p class="text-align-justify">However, given that the mission of equality bodies is essentially only to promote equality, is greater independence and agency really necessary and is this the right direction?</p> <p class="text-align-justify"><strong>Action plans</strong></p> <p class="text-align-justify">The roadmap for the initiative (then still referred to as the roadmap) published in 2021[5] shows that equality bodies face a number of obstacles in their current state of operation, which, let us emphasise again, is limited to the promotion of equality.</p> <p class="text-align-justify">The European Commission points out that the problems equality bodies would like to address include too much freedom for states in terms of the mandate, powers, independence, effectiveness and resources of these bodies. As a result, "most equality bodies face challenges in terms of their effectiveness in carrying out their missions" and "there are significant differences between Member States in terms of the mandate, powers, independence, resources and effectiveness of their equality bodies, resulting in unequal protection against discrimination across the EU". Furthermore, it is "very difficult for the Union to monitor/evaluate the performance of equality bodies due to their wide diversity and lack of "binding minimum standards" and "the equality data currently collected by the Equality Bodies does not allow for proper monitoring of the activities of the Equality Bodies or of the state and evolution of discrimination in the EU".</p> <p class="text-align-justify">Such an approach would be understandable if it were not for the fact that equality bodies have, as the Commission itself points out, a remit to "promote equal treatment by assisting victims of discrimination, carrying out independent research, publishing independent reports or making recommendations". With such a mission outlined, it would seem that adequate resources (human and financial) and powers (access to data) are indeed crucial to the proper functioning of such bodies. These issues regulated at EU level would indeed guarantee certain minimum standards, but it is questionable whether such central EU regulations are really necessary. The fact that, today, different EU member states have different, specific and thus adapted to the prevailing culture, customs and needs in a given country does not necessarily mean that this is inappropriate. Rather, the opposite can be assumed - such an individualised approach in regulation is in principle beneficial. The only drawback seems to be what the EC draws attention to in passing, so to speak - namely the central monitoring of the activities of equality bodies and the state and evolution of discrimination in the EU. In a nutshell, the lack of top-down, uniform regulations imposed on all Member States is therefore a thorn in the EU's side, as it prevents the exercise of total control over these bodies and the aggregation of data on the "state and evolution of EU discrimination". However, the concepts of 'equality' or 'discrimination' themselves are evolving very dangerously in the EU, aggregating more and more absurd meanings and further 'fields' of inequality (such as the undefined and extremely broadly defined 'hate speech' or 'hate crimes'). Consequently, the granting of more competences and capacities to bodies which, in turn, would become largely dependent on the EU (which would be responsible for a large part of the regulation of their activities and, on the other hand, would monitor their activities) could mean another attempt to influence the EU Member States, which to this day resist ideologically exploited slogans of "discrimination", which in reality aim at granting privileges to certain social groups.</p> <p class="text-align-justify"><strong>"Kindness" has not succeeded</strong></p> <p class="text-align-justify">The interpretation indicated seems to be confirmed by the Commission itself, which indicates in its action plans that "the 2021 Staff Working Document underlines that the 2018 Recommendation, which is a non-binding act, has only been partially implemented by the Member States. Only four Member States are preparing legislative reforms in line with the Recommendation and around ten Member States have initiated some changes'. It is worth noting that the Commission's recommendations were and remain non-binding - Member States are under no obligation to implement them, they can disagree with them, they can ignore them, and they do not have to explain their actions (or lack thereof) in any way in this regard. The European Commission, meanwhile, assumes that a failure to listen to non-binding recommendations may give rise to the development of standards which, already in the form of binding regulations, would introduce the changes expressed in the recommendations. However, the Commission must be credited with having largely bent over backwards to address the lack of human resources, which is indeed a major contributor to the limited activities of equality bodies in EU countries. These bodies often fail to fulfil their tasks (e.g. carrying out surveys) due to a lack of human resources to carry out such surveys in a professional and systematic manner.</p> <p class="text-align-justify"><strong>Direction for change</strong></p> <p class="text-align-justify">The European Commission should soon present the conclusions of the public consultation already carried out and the opinions provided to it, and we will probably know them together with a preliminary draft of the new rules. Only then will it be possible to assess to what extent these regulations are actually intended to improve the legitimate work of the equality bodies, and to what extent they are handing over control to a central authority in Brussels.
