A 20-year-old girl, a resident of the autonomous republic of Bashkortostan in Russia, became pregnant by her boyfriend. Her parents, however, disapproved of the relationship, due in part to the man's suspicions of ties to the criminal world. When they learned that he had been arrested, they decided to force their daughter to kill her unborn child.  The girl vehemently opposed it, but the father forced her to do it with violence. On May 1, 2010, the parents took the girl in a car, which they drove to the state hospital in Tujmaz to have her aborted. During the trip, the girl continued to protest, to which her father threatened to throw her out of the speeding car to induce a miscarriage if she did not stop. Despite the threats, she did not give up - on the way she managed to send a text message to her brother asking for help, and upon reaching the place, she announced to the doctor-gynecologist on duty and the nurse on duty that she wanted to continue the pregnancy and absolutely did not wish for an abortion. The doctor and nurse, however, convinced the patient to kill the baby. The girl's mother - in the absence of the father, who stayed in the hallway outside the office - revealed that if the abortion did not take place, her husband would murder them both. Fearing for her own life, the girl agreed to have the abortion. She never gave birth to any more children - in later years she had two miscarriages, until she was finally diagnosed with permanent infertility.</p> <p class="text-align-justify">Later that day, police arrived at the parents' apartment in response to a notification from the girl's brother, alerted by her text message. After questioning the parents, their daughter and her brother, the police dropped the investigation, concluding that although the abortion had occurred, the parents "had no bad intentions," but "believed they were acting in the best interest of their child."  Shortly thereafter, however, the police reopened the investigation and discontinued it again, this time pointing out that the abortion had been performed by a specialist doctor, in an accredited clinic, within the statutory time limit, and only if one of these conditions had not been met could a crime be said to have been committed.</p> <p class="text-align-justify">In 2011, the girl sued the Tujmaz hospital for compensation for mental and physical suffering caused by an abortion performed without her consent. The first instance court dismissed her claim, pointing out that the woman "consented to the abortion in fear of her father's threats, from which it follows that her consent to the abortion was voluntary." However, the court of second instance overturned the verdict and awarded her a token compensation of 20,000 rubles (about 2,300 zlotys), finding that her health had not been seriously damaged by the abortion.</p> <p class="text-align-justify">In 2012, the girl filed a complaint with the European Court of Human Rights. In 2022. Court ruled that Russia had violated Article 3 of the Convention (prohibition of ill-treatment) and awarded her 19,500 euros in reparations (about 91,000 zlotys). The Court said that forcing the applicant to have an abortion, in violation of elementary standards of medical law, constituted "an outrageous case of inhuman and degrading treatment, which not only resulted in serious damage to her health - the loss of her unborn child - but also involved long-term psychological and physical consequences."</p> <p class="text-align-justify">- The Court could not have ruled otherwise in this case, which was a clear case of a staggering violation of the mother's rights. There is a loophole in Russian law whereby simply performing an abortion without a woman's consent is not a crime unless it caused serious harm to her health. However, the Court rightly found that such a loophole did not absolve the Russian police from having to take action, which was a duty under Article 3 of the Convention.  It is only unfortunate that the Court failed to recognize that any abortion also constitutes a violation of the unborn child's right to life. However, it is worth appreciating that this is the first time that the life in the mother's womb has been referred to as an "unborn child" in the reasoning of an ECHR judgment, whereas until now impersonal phrases such as "fetus" had been used," said Weronika Przebierała, director of the International Law Center of the Ordo Iuris Institute.</p> <p class="text-align-justify">Case of S.F.K. v. class="text-align-justify"><strong>· The Ordo Iuris Institute has provided the European Commission with a legal opinion on a new EU initiative to protect global health.</strong></p> <p class="text-align-justify"><strong>· The project, which is planned to be adopted still in 2022, implements an agenda identical to the WHO pandemic treaty and the proposals of the Conference on the Future of Europe.</strong></p> <p class="text-align-justify"><strong>· The actions for health announced by the European Commission include access to abortion and global health policy governance.</strong></p> <p class="text-align-justify"><strong>· In addition to critical remarks, the Institute also made suggestions for positive action that the EU could take under the new strategy.</strong></p> <p class="text-align-justify">The EU Strategic Framework for World Health, which the Institute has previously informed about, seems to be one of the most important projects for the European Commission this year. The announced, unusually high pace of adopting the initiative (still in 2022) and further work testify to the rush of the Commission, but also suggest that the main draft strategy on global health has already been prepared, and the work on it correlates in time with the controversial project of the so-called WHO pandemic treaty. Also in numerous recommendations of the Conference on the Future of Europe, EU officials repeatedly referred to health issues, including calling for the extension of the EU's competences in this area.</p> <p class="text-align-justify">The initiative processed by the European Commission envisages, inter alia, the Union's commitment to "equality in health, including women's health", which points to the promotion of abortion. The Commission also calls for recognition of the interconnection "between humans, animals and plants and their shared environment". This goes hand in hand with the assumptions of the so-called the anti-pandemic treaty of the World Health Organization, which also provides for the introduction of central public health management.</p> <p class="text-align-justify">For this reason, in the opinion submitted to the European Commission, the Ordo Iuris Institute pointed to the departure of the initiative's draft from real public health problems in the world, recalling that in 2010 the EU was able to accurately diagnose such problems. As part of the new initiative, in place of previous proposals related to e.g. greater access to primary health care, there were demands to implement pro-abortion UN recommendations or to globalize and centralize management in cases similar to the COVID-19 pandemic.</p> <p class="text-align-justify">In its opinion, the Institute also formulated positive proposals for actions that the EU could take under the announced strategy. These included preventing the influence of the pharmaceutical lobby in relation to drug supply chains and their strategic pooling, as well as reforming the curriculum in medical professions, which would improve the working conditions of doctors and, at the same time, limit the possibility of their work outside the state that financed their medical education .</p> <!-- END OUTPUT from Constitutional Tribunal of October 2020. In each of these cases, the lawyers of the Ordo Iuris Institute provided the judges of the ECtHR with the opinion of a "friend of the court", in which we showed that the wide scope of protection of the unborn life in Poland is not only in line with the expectations of the majority of Poles, but also restores human dignity and corresponds to the often concealed legal norms international, which is on the side of human life - including the unborn.</strong></p> <p class="text-align-justify">However, it is too early for triumphalism. The real war to protect life is yet to come. The five decisions of the ECtHR were made possible thanks to the negligence of the abortionists themselves. According to the press release of the ECtHR, there may be ... over a thousand similar proceedings. In the remaining cases, the applicants are supported by entire staffs of lawyers wishing to undermine the constitutional protection of life in Poland.</p> <p class="text-align-justify">Polish feminists organized an action aimed at invalidating the judgment of the Constitutional Tribunal on eugenic abortion, using the European Court of Human Rights. To this end, they prepared a model complaint to the ECtHR and encouraged women to flood the Tribunal in Strasbourg with complaints against Poland, in which they claim that the ban on eugenic abortion violates, inter alia, Art. 3 of the European Convention on Human Rights, prohibiting torture and inhuman treatment. Most of the complaints already communicated to the Polish government do not even concern women who have been refused eugenic abortion. The applicants for torture and inhuman treatment most often recognize… “stress and fear of getting pregnant”.</p> <p class="text-align-justify">Abortion promoters do not want to remember about the preamble of the most widely accepted act of international law around the world - the Convention on the Rights of the Child - which states that "a child, due to its physical and mental immaturity, requires special care and care, including appropriate legal protection. , both before and after birth ”.</p> <p class="text-align-justify">If the judges of the ECtHR agree with the absurd statements of abortionists, Poland may be forced to legally limit the right to life. Therefore, we cannot remain passive.</p> <p class="text-align-justify">A judgment granting even one complaint may shake the entire achievements of international law and overturn the ruling of the Polish Constitutional Tribunal, which will have, nome omen, fatal consequences for Polish children.</p> <p class="text-align-justify">Complaints to the Tribunal in Strasbourg are the method the left has chosen to undermine the constitutional order over Poles' heads. This does not only apply to the defense of life, but also to such matters as the identity of marriage, the admissibility of surrogate maternity trafficking, adoption of children by same-sex couples, euthanasia, and even the presence of the cross in public space ...</p> <p class="text-align-justify">That is why we closely monitor all proceedings initiated by the European Court of Human Rights and join in all proceedings which at stake are the protection of life in Poland, the constitutional identity of marriage and family, freedom of speech or freedom of conscience and religion.</p> <p class="text-align-justify">Often we are the only organization in Europe which, in these often unprecedented proceedings, stands on the side of the fundamental values ​​for the entire European civilization - life, family and freedom. On the other hand, the judges of the ECHR face the pressure of a number of extreme left-wing organizations which are striving for a world ideological revolution and undermining the entire existing, natural social order. Given that our opinions are increasingly cited in the Court's rulings, I believe that we will be able to effectively remind ECtHR judges that their job is to defend human rights and not to force Wade judgment caused a great stir in the public, mainly American opinion. It was published in early May on the website politico.eu. Regardless of the final shape of the Supreme Court's decision, the conclusion formulated in the title stems directly from the circumstances widely cited in the explanatory memorandum to the bill.</strong></p> <p class="text-align-justify"><strong>The myth of the pro-abortion United States</strong></p> <p class="text-align-justify">Its author - one of the judges - presented a number of arguments and evidence confirming the defectiveness of the judgment issued by the Supreme Court of the United States in the case of Roe v. Wade in 1973. In this judgment, the Supreme Court found that the 14th Amendment to the US Constitution of 1868 guarantees women the right to abortion as an element protected under this Amendment to the right to liberty. In a subsequent 1992 US Supreme Court judgment in the Planned Parenthood v. Casey case, abortion rights were largely upheld. An analysis of the content of the right to liberty based on historical facts shows, however, that the right to abortion adopted in the USA at the beginning of the 1970s is fundamentally at odds with the tradition of protecting the lives of unborn children established in the common law system.</p> <p class="text-align-justify">Despite the fact that the draft opinion does not have to coincide with the final shape of the soon-to-be judgment, its author - judge Samuel Alito emphasized an extremely important issue concerning the "history" of the right to abortion in the common law system. Therefore, regardless of the final decision of the Supreme Court, the facts cited in the opinion regarding the history of US legislation relating to abortion should not, rationally, change. At best, they can be kept silent, or additional ones can be cited, assuming that the topic has not been exhausted yet.</p> <p class="text-align-justify"><strong>History on the side of life</strong></p> <p class="text-align-justify">Outlining the position of the majority of the panel, the draft opinion noted that the invocation of the 14th Amendment to the US Constitution as the basis of the right to abortion requires showing that the right was "deeply rooted in [American] history and tradition and whether it is necessary in" an orderly freedom system »[of the American people]”. Judge Alito argues that historical issues in this respect are necessary to define the new component of the "liberty", which is protected under the 14th Amendment, and which is a broad concept, defined in various ways. . The author of the opinion contrasted the natural human tendency to misidentify the real scope of this concept with subjective feelings as to what this scope should be in the correct, in accordance with the intention of the legislator, interpretation of the concept of "freedom". For this reason, he noted, the Supreme Court has long remained skeptical about recognizing rights not explicitly mentioned in the US Constitution.</p> <p class="text-align-justify">Turning then to considerations aimed at answering the fundamental question of whether the right to abortion belongs to American history and tradition, and therefore whether it is part of the "freedom" protected under the 14th Amendment, Judge Alito referred to the following facts. In the nineteenth century, the vast majority of states passed laws that made abortion criminally liable at any stage of pregnancy. By 1868, when the 14th Amendment was ratified, three-quarters of the states, ie, 28 of a total of 37, had passed laws criminalizing abortion regardless of the stage of pregnancy in which it was performed. Of the 9 states that did not penalize abortion in 1868, 8 introduced criminal liability until 1910. In support of the arguments presented, Appendix A to the draft opinion provides a chronological list of state laws that penalized abortion at any stage of pregnancy, in force in 1868. i.e. the date of adoption of the 14th Amendment, as well as those passed until 1910. The tendency to limit abortion by criminalizing it was also visible in the territories that became the last 13 States - all of them introduced criminal liability for abortion at any stage of pregnancy, starting with the Kingdom of Poland Hawaii in 1850 and ending with New Mexico in 1919 (for these states, the author of the draft provided a chronological list of laws prohibiting abortion in Appendix B). As is clear from the findings of the Supreme Court taken from the justification of the judgment in the case of Roe v. Wade, until the end of the 1950s, all states, except four and the District of Columbia, prohibited abortion "anywhere and at any time, except in cases of saving or saving the mother's life" [6]. This consensus regarding the criminality of abortion continued until the Roe v. Wade judgment in 1973. Also at that time, i.e. in the early 1970s, the vast majority - in 30 states - of abortion was still prohibited by at any stage of pregnancy, except in the case of saving mother's life.</p> <p class="text-align-justify"><strong>Abortion law is not a component of freedom</strong></p> <p class="text-align-justify">Taking into account this historical context, the author of the draft opinion concluded that "the right to abortion is not deeply rooted in the history and tradition of the American people", on the contrary - "the uninterrupted tradition of prohibiting abortion under penalty of perjury lasted from the earliest days of common law until 1973. ". Hence, if the Supreme Court ruling in Roe v. Wade had had the "history and tradition of the nation" in mind, it would have to come to such conclusions as in the landmark decision in Washington v. Glucksberg, which the author of the opinion paraphrased as follows: "attitudes towards [abortion] has changed (...), but our laws consistently condemn and continue to prohibit this practice. "</p> <p class="text-align-justify">The rules on the legality of abortion were changed by a court decision. However, this does not affect the fact that the right to abortion established in the early 1970s is not based on American history and traditions. Both of these elements of the identity of the American people will remain unchanged. They determine that the right to abortion is not a component of the "freedom" protected by the 14th Amendment. In order to verify these reports, the Ordo Iuris Institute sent a request for access to public information to the Ministry of Health and the capital city hall. The ministry replied that it did not have information on this subject, while the Warsaw authorities replied that everything was done in accordance with the law. Similar inquiries were directed to the relevant healthcare entities in the territory of Poland.</p> <p class="text-align-justify">In the exceptional situation caused by the armed conflict in Ukraine, numerous media reports suggested a possible increase in the number of abortions performed on the basis of the provision allowing for abortion in a situation of pregnancy resulting from rape. Therefore, the Institute undertook standard activities aimed at finding out the scale as well as the legality of this phenomenon. Applications for access to public information on this subject were sent to 370 hospitals. Importantly, in accordance with applicable law, abortion on the basis of the so-called a criminal premise is allowed under certain formal conditions specified in the Act on Family Planning. Their omission would, in fact, result in the acceptance of "on demand" abortion that is contrary to the Polish legal order.</p> <p class="text-align-justify">“Contrary to false accusations, it should be emphasized that, according to Polish law, possible liability for illegal abortions rests with the doctors who perform them, and not with the women undergoing them. It is particularly inappropriate because it is clearly visible that the abortion circles strive to implement their demands in Poland, ruthlessly using the trauma of Ukrainian women fleeing the war, ”comments Jan Melon, analyst at the Center for Medical Law and Bioethics at the Ordo Iuris Institute.</p> <p class="text-align-justify">Ordo Iuris constantly monitors compliance with the law with regard to the conditions for permitting abortion. As part of this activity, at the beginning of 2021, the Institute published the "Audit of abortion deprivation of life", in which it presented numerous doubts about the functioning of the eugenic premise in practice, including resulting from the abuse of this premise by doctors. The conditions for the admissibility of abortions remaining in the Act on Family Planning are consistently within the scope of the Institute's interests and activities.</p> <p class="text-align-justify">"The right to access public information, including information on the activities of medical entities performing public tasks, is one of the rights guaranteed by the Constitution of the Republic of Poland. In order to achieve its statutory goals, Ordo Iuris is also entitled to ask questions about the activities of public medical entities, especially when it comes to the subject matter that is one of the The EP also called on Poland once again to legalise abortion, which it illegally describes as a ‘human right’, and it considers lack of free access to the possibility to kill children by abortion as a violation of the rule of law. The MEPs also adopted an amendment to the resolution concerning the alleged relationship between the judgement of the Constitutional Tribunal prohibiting the performance of eugenic abortion and the death of a 30-year-old mother and her unborn child, which took place in the hospital in Pszczyna in September.</span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">In its resolution, the EP adopted a narrative reproduced by the media and organisations lobbying for access to abortion, despite a clear indication by the representative of the family of the deceased that the Court’s judgement did not affect the situation as well as numerous opinions from the medical and legal environment confirming it. Moreover, there is still a clear premise in Polish law for saving the mother’s life and health, which may result in the death of the conceived child. The pro-abortion environment is trying to use the tragedy of the family from Pszczyna in an instrumental way to replicate the pattern that occurred in Ireland, where a pregnant mother also died as a result of a medical error. However, despite the fact that this error was clearly proven, massive disinformation has led to legal changes significantly limiting the protection of life. In its resolution, the EP stated that ‘doctors did not perform the life-saving abortion because they were waiting for the death of the foetus due to restrictions concerning legal abortion and their deterrent impact on doctors in Poland’ (compare letter J of the resolution). The statement that the Polish law prevents doctors from saving the mother’s life and health when at risk is clearly untrue. Furthermore, by its resolution the EP supports the view that the explanation of the reasons for the tragedy in Pszczyna was unnecessary. The European Parliament arbitrarily excludes by its position any fault on the part of people responsible for decisions concerning the patient and ignores the fact that the investigation in this case is ongoing.</span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">‘It is worth noting that although the abortion lobby is exceptionally strongly represented in this term of the European Parliament, further resolutions containing demands for legalisation of abortion on request and violating the exclusive competences of the Member States to determine their health policy are gradually losing support. The extent of the opposition to the increasing ideological commitment of the European Parliament was most visible during the vote on the so-called Matić report in June. In yesterday’s vote, the resolution condemning Poland for fictitious violations of human rights and respect for the provisions of the Polish Constitution gained much fewer votes in favour, i.e. 373, than an almost identical text adopted one year ago, for which as many as 455 representatives of the European Parliament had voted. Taking into account the specificity of the EU, this is a very promising trend,’ said Anna Kubacka from the Ordo Iuris Centre for International Law.</span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">Before the vote on the resolution on the ‘first anniversary of the actual prohibition of abortion in Poland’, the Ordo Iuris Institute sent a memorandum to the MEPs, which indicates legal grounds obliging states to protect life as well as presents the actual scope of the judgement of the Constitutional Tribunal of 22 October 2020 and its impact on the protection of life and health of both the mother and the child. The document also points out that abortion is not a human right and denies the false accusations against Poland included in the motion for the resolution.</span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="line-height:115%"><span style="font-family:Calibri,sans-serif">The MEPs also received from the Institute a publication containing a comprehensive commentary to the resolution adopted one year ago by the EP on the alleged ‘actual prohibition of abortion in Poland’. They are all financed by the international pro-abortion organisation International Planned Parenthood Federation (IPPF). For a number of years, they have been engaging in court cases requesting decriminalisation of infanticide and legalisation of abortion in El Salvador. Moreover, they run campaigns sponsored by the IPPF, in which they present women killing their children as victims of human rights violations in El Salvador, in association with the country’s ban of abortion. </span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">The oldest such court case is the so-called Manuela’s case. It is the only case in which a mother, found guilty of aggravated homicide of her child, was sentenced to nearly 10 years in prison. She had injured her newborn son, abandoned him and let him drown. The court that reviewed her case determined she had committed aggravated homicide based on evidence presented by her family and an opinion that – at the moment of committing the crime – she was aware of her actions and mentally capable of discerning and choosing between good and bad behaviour. <b><span style="color:black">Despite those incriminatory circumstances, the court prescribed the minimum prison sentence applicable to aggravated homicide.</span></b></span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB"><span style="color:black">The Inter-American Commission on Human Rights also agreed that Manuela’s case was not ‘elective abortion’, but instead, aggravated murder of a newborn child. <b>Notwithstanding this opinion, the IACHR appealed to El Salvador to immediately implement reforms in order to prevent prosecution of neonaticide and illegal abortion.</b> The Commission claims that the legal sanctions taken by El Salvador against Manuela for killing her son violate the provisions of the American Convention on Human Rights, even though Article 4 of the Convention explicitly calls for protection of every life from the moment of conception: “[Every] person has the right to have his life respected. This right shall be protected by law and, in general, from the moment of conception. No one shall be arbitrarily deprived of his life”. <b>Accordingly, legal provisions that protect the life of the child are fully compliant with the international human rights system.</b></span></span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">In a letter from organisations supporting El Salvador, the question of the country’s competence to enforce criminal provisions against perpetrators of crimes against newborn children was analysed in the context of its compliance with the international human rights system. The opinion prepared by non-profit organisations is supposed to convince the court that the ban of infanticide in El Salvador not only does not violate the international human rights system, but is an indispensable element of that system, in particular of the American Convention on Human Rights. If the requested regulations are enforced, they might make physicians reluctant to report potential crimes against newborn children. Also, the reform might impose sanctions on those reporting suspected neonaticide in El Salvador.</span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB"><span style="color:black">The organisations list numerous arguments to prove that enforcing penal sanctions for the crime of infanticide is fully justified from the perspective of international law and that it should not be limited. </span></span><b><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">The<span style="color:black"> norm that prohibits</span> the killing of children by their own parents is universal, existing in the international human rights system and applicable in every country.</span></b><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB"> Thus, imposing penalties for the crime of infanticide does not violate the international law. To the contrary, countries are obliged to implement, observe and enforce such provisions. As far as the above-mentioned case is concerned, it is also important to note that all the parties (including El Salvador) have ratified such instruments as the <b>Convention on the Rights of the Child and the International Covenant on Civil and Political Rights, which establish the international obligation to protect the life of the child and the universal right to life of every person.</b> </span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"><span style="font-size:12pt"><span style="font-family:&quot;Times New Roman&quot;,serif"><span lang="EN-GB" style="font-family:&quot;Calibri&quot;,sans-serif" xml:lang="EN-GB">The members of the coalition claim that neonaticide should not be treated differently than crimes against the life of older children or adults. This is supported, for example, by the provisions of the American Convention, which stipulates in its Article 1 that “States Parties undertake to ensure to all persons subject to their jurisdiction the free and full exercise of those rights and freedoms without any discrimination”, and in Article 24, it states that “All persons are equal before the law. Consequently, they are entitled, without discrimination, to equal protection of the law”. As a result, the States-Parties to the American Convention should not only be able but also obliged to enforce norms of the penal law that provide for legal sanctions against acts resulting in the death of newborn children. This also applies to aggravated homicide, similar to Manuela’s case. Another priority should be to encourage parents in a situation of unplanned pregnancy to use alternative solutions without violence against their child, in particular by providing them with financial and psychological assistance or mediation in the adoption procedure. </span></span></span></p> <p style="margin:0cm; text-align:justify; margin-right:0cm; margin-left:0cm"> </p> <p style="margin:0cm; The requirement is connected with Poland’s alleged failure to execute judgements of the Tribunal in Strasbourg. In those judgements the ECHR claims that if a country permits abortion in certain specific cases (for instance a threat to the mother’s health, severe foetal disease or rape), it should create special procedures to guarantee every mother a possibility of killing her unborn child with ease.<p></p></span></p> <p style="margin-top:0cm;margin-right:0cm;margin-bottom:8.0pt;margin-left:0cm;&#10;text-align:justify"><span lang="EN-GB" style="font-size:11.0pt;font-family:&quot;Calibri&quot;,sans-serif;&#10;mso-bidi-font-family:&quot;Times New Roman&quot;" xml:lang="EN-GB">In 2008, the Lower House of the Polish Parliament passed a bill on patient rights and a Patient Ombudsman. The new legislation guaranteed all patients two procedures to verify an unsatisfactory medical opinion – the right to request a second medical opinion or a medical staff conference and the right to object to a medical opinion or statement to the Patient Ombudsman’s Medical Committee.<p></p></span></p> <p style="margin-top:0cm;margin-right:0cm;margin-bottom:8.0pt;margin-left:0cm;&#10;text-align:justify"><span lang="EN-GB" style="font-size:11.0pt;font-family:&quot;Calibri&quot;,sans-serif;&#10;mso-bidi-font-family:&quot;Times New Roman&quot;" xml:lang="EN-GB">However the Committee of Ministers consistently considers the adopted legal solutions as unsatisfactory. It claims that the right to object is underused by patients, which supposedly shows that the measure is not very effective. As a result, the Committee demands better access to the objection procedure. This would make it possible to perform more abortions. The officials also expect the conscience clause laws to be amended so that hospitals where a doctor refuses to perform an abortion would have to provide information about who could kill an unborn child and where.</span><span lang="EN-GB" xml:lang="EN-GB"><p></p></span></p> <p style="margin-top:0cm;margin-right:0cm;margin-bottom:8.0pt;margin-left:0cm;&#10;text-align:justify"><span lang="EN-GB" style="font-size:11.0pt;font-family:&quot;Calibri&quot;,sans-serif;&#10;mso-bidi-font-family:&quot;Times New Roman&quot;" xml:lang="EN-GB">The body of the Council of Europe also requires the gathering of information about the hospitals where physicians refuse to perform abortions by invoking the conscience clause. Furthermore, the Committee wants those hospitals that do not perform abortions to be held accountable under civil law (financial consequences) for failure to abide by the terms of the contracts with the Polish National Health Fund (NFZ), which still cover abortion in the area of gynaecology and obstetrics, in violation of the judgement of the Constitutional Tribunal dated 7 October 2015.<p></p></span></p> <p style="margin-top:0cm;margin-right:0cm;margin-bottom:8.0pt;margin-left:0cm;&#10;text-align:justify"><span lang="EN-GB" style="font-size:11.0pt;font-family:&quot;Calibri&quot;,sans-serif;&#10;mso-bidi-font-family:&quot;Times New Roman&quot;" xml:lang="EN-GB">“Contrary to the claims of the Committee of Ministers, all ECHR judgements entered in abortion cases were enforced by Poland insofar as permitted by the law in effect in Poland, which in principle protects human life from the moment of conception. By addressing such demands to Poland, the Committee of Ministers oversteps its authority. The Tribunal in Strasbourg obligated Poland to introduce a procedure to verify the decisions of physicians, including decisions on no grounds for legal abortion, and Polish authorities responded with the introduction of not one but two such procedures. The Tribunal clearly emphasised that the protection of human life at the prenatal stage was an issue decided by the countries-parties to the Convention. So the Committee has no right to demand any specific solutions from Poland which could in fact impair that protection in Poland. The organisation also urges women to perform this form of abortion even without medical supervision. At the same time, under international law, there is no such notion as the “right to abortion”. Moreover, the EU delegations will cooperate with Member States in order to determine specific priorities in the countries of their operation for a period of five years. These activities will be supported by significant financial resources and political base. From the very beginning, it has been arousing numerous controversies and to this day it is still not clearly defined, while radical circles use it to widely promote abortion and permissive sex education. It should be stressed that due to objections of numerous countries, a separate category of “sexual rights” was not formulated intentionally due to its ideological character. Despite numerous objections, the concept of reproductive rights (and sometimes also sexual rights) is included in the scope of different documents formulated by international bodies, frequently against the will of numerous Member States. An example of its use for purposes contrary to the states’ positions is the recent Nairobi Summit<a href="#_ftn9" name="_ftnref9" style="color:blue; text-decoration:underline" title="" id="_ftnref9"><span class="MsoFootnoteReference" style="vertical-align:super"><span class="MsoFootnoteReference" style="vertical-align:super"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">[9]</span></span></span></span></a> or current works on Universal Health Coverage<a href="#_ftn10" name="_ftnref10" style="color:blue; text-decoration:underline" title="" id="_ftnref10"><span class="MsoFootnoteReference" style="vertical-align:super"><span class="MsoFootnoteReference" style="vertical-align:super"><span lang="EN-GB" style="font-size:11.0pt" xml:lang="EN-GB"><span style="font-family:&quot;Calibri&quot;,sans-serif">[10]</span></span></span></span></a>.
