The Strasbourg Court rejected the complaints of Polish feminists

The European Court of Human Rights announced the rejection of the first five complaints of Polish abortion activists seeking to overturn the judgment of the Constitutional Tribunal of October 2020. In each of these cases, the lawyers of the Ordo Iuris Institute provided the judges of the ECtHR with the opinion of a "friend of the court", in which we showed that the wide scope of protection of the unborn life in Poland is not only in line with the expectations of the majority of Poles, but also restores human dignity and corresponds to the often concealed legal norms international, which is on the side of human life - including the unborn.

However, it is too early for triumphalism. The real war to protect life is yet to come. The five decisions of the ECtHR were made possible thanks to the negligence of the abortionists themselves. According to the press release of the ECtHR, there may be ... over a thousand similar proceedings. In the remaining cases, the applicants are supported by entire staffs of lawyers wishing to undermine the constitutional protection of life in Poland.

Polish feminists organized an action aimed at invalidating the judgment of the Constitutional Tribunal on eugenic abortion, using the European Court of Human Rights. To this end, they prepared a model complaint to the ECtHR and encouraged women to flood the Tribunal in Strasbourg with complaints against Poland, in which they claim that the ban on eugenic abortion violates, inter alia, Art. 3 of the European Convention on Human Rights, prohibiting torture and inhuman treatment. Most of the complaints already communicated to the Polish government do not even concern women who have been refused eugenic abortion. The applicants for torture and inhuman treatment most often recognize… “stress and fear of getting pregnant”.

Abortion promoters do not want to remember about the preamble of the most widely accepted act of international law around the world - the Convention on the Rights of the Child - which states that "a child, due to its physical and mental immaturity, requires special care and care, including appropriate legal protection. , both before and after birth ”.

If the judges of the ECtHR agree with the absurd statements of abortionists, Poland may be forced to legally limit the right to life. Therefore, we cannot remain passive.

A judgment granting even one complaint may shake the entire achievements of international law and overturn the ruling of the Polish Constitutional Tribunal, which will have, nome omen, fatal consequences for Polish children.

Complaints to the Tribunal in Strasbourg are the method the left has chosen to undermine the constitutional order over Poles' heads. This does not only apply to the defense of life, but also to such matters as the identity of marriage, the admissibility of surrogate maternity trafficking, adoption of children by same-sex couples, euthanasia, and even the presence of the cross in public space ...

That is why we closely monitor all proceedings initiated by the European Court of Human Rights and join in all proceedings which at stake are the protection of life in Poland, the constitutional identity of marriage and family, freedom of speech or freedom of conscience and religion.

Often we are the only organization in Europe which, in these often unprecedented proceedings, stands on the side of the fundamental values ​​for the entire European civilization - life, family and freedom. On the other hand, the judges of the ECHR face the pressure of a number of extreme left-wing organizations which are striving for a world ideological revolution and undermining the entire existing, natural social order. Given that our opinions are increasingly cited in the Court's rulings, I believe that we will be able to effectively remind ECtHR judges that their job is to defend human rights and not to force states to adapt their laws to the demands of radicals.
